CALL TO ORDER:

John Wieczorek called the meeting to order at 6:00 p.m. at the Mahoning Township Building, 2685 Mahoning Drive East, Lehighton, PA 18235

PUBLIC COMMENT:

Jake Arner shared that he did some research with regards to capital improvement fees. He feels that it would place the township at great risk and views as a great liability.

APPROVAL OF MINUTES:

MOTION

APPROVAL OF TREASURER’S REPORT: January 2013

MOTION

OLD BUSINESS:

Street Openings

Discussion took place on how to calculate fee, how to monitor the progress, does money need to be placed in escrow, need wording of placing the street back to original position. Bruce will get a copy of Lehighton’s ordinance.

Super Walmart Traffic Signal Agreement

Tom Nanovic shared that Lowe’s is now going to assume that agreement, I don’t believe we want to specifically state that agreement is terminated. Bill of Sale question what exactly is being conveyed to the township. Tom will follow up with Tim.

CDBG

MOTION

Franklin Ruch made a motion to contact T&M to prepare final coordination with Ron on repair/overlay program, preparation of specifications, bid tab and sketches, distribution of technical specifications to county and township, spray paint base repair areas and attend pre bid meeting (first five items not to exceed $3000.00). Seconded by John Wieczorek. John Wieczorek, yes; Franklin Ruch, yes; Bruce Steigerwalt, yes; Linda Benner, yes and Todd Weaver, yes 5-0 vote. Motion carried.

Noted that the contractor should be responsible for traffic control and resident notification and parking restrictions. John Wieczorek will be contacting Tim Edinger.

Carbon Animal Shelter (nothing)

Capital Improvement Fees

Frank mentioned he will arrange a meeting with Tim when he is at the PSATS Convention to discuss capital improvement fees in exchange for waivers.

Stormwater

Discussion took place with regards to T&M comments regarding on lot stormwater management facilities and how to proceed forward with implementing a procedure. John Wieczorek suggested scheduling a meeting with Tim, Tom, Bruce and himself to determine a process to move forward.

NEW BUSINESS

Canal Property Easement

Bruce Steigerwalt advised that PENNDOT is looking to get temporary easement on the canal property down to 209 bridge to access piers underneath.

MOTION

Franklin Ruch made a motion to grant temporary easement to PENNDOT and will donate back to the Canal Commission the township’s share of $166.67. Seconded by Bruce Steigerwalt. John Wieczorek, yes; Franklin Ruch, yes; Bruce Steigerwalt, yes; Linda Benner, yes and Todd Weaver, yes 5-0 vote. Motion carried.

Drafted PSATS Letter

MOTION

John Wieczorek made a motion to approve and send proposed letter to PSATS with regards to Judge Matika’s decision. Seconded by Franklin Ruch. John Wieczorek, yes; Franklin Ruch, yes; Bruce Steigerwalt, yes; Linda Benner, yes and Todd Weaver, yes 5-0 vote. Motion carried.

Þ  Shared a quote from Buy Rite shelving of Whitehall. The total cost of the shelving will be $1147.74. Will double check whether or not this can be picked up in Whitehall.

Þ  Addendums for sick and vacation time to be used in half hour increments and changing work hours 7:00 to 3:00 with no lunch at discretion of road master. Question of whether this is year round or seasonal.

Þ  Bruce Steigerwalt shared he received three quotes for steel required to build a workbench. The cheapest is Zoke Ironworks at a cost of $374.15
