THIS CAUSE came on before the Court upon the submission of a Competency Evaluation by the Forensic Administrator of (name of forensic facility). In sum and substance, it is the opinion of the staff at (name of forensic facility) that the defendant is now competent to proceed.

The defendant was previously committed to the Department of Children and Families by prior Order of Court pursuant to Florida Statute section 916.13(1) due to mental illness.

The Court received a report from the Forensic Administrator which indicates that the defendant is now competent to stand trial.

At hearing on the ______day of ______, 20___, the defendant was present before the Court with the counsel of record. Both the state and the defense were awarded the opportunity to present evidence to the Court, both agreed that the Court rely on the written reports filed with the Court. It is, therefore;

CONSIDERED, ORDERED AND ADJUDGED that:

1. The defendant is now competent to proceed, based upon the report.

2. The defendant is remanded to the custody of the (name of detention facility).

3. If continued medication of this defendant is required, provided or prescribed by (name of forensic facility) , for the defendant, appropriate officials of the detention facility shall administer or cause to be administered said medication in accordance with the instructions of the treatment facility, continuing unless and until modified or eliminated by authorized medical authority.
