MINUTES

SPECIAL CONFERENCE COMMITTEE “C”

TIME AND PLACE: / Special Conference Committee “C” convened on February 20, 2009 at 1:10 p.m., at the Department of Health Professions, Perimeter Center, 2nd Floor Conference Center, 9960 Mayland Drive, Henrico, VA 23233.

QUORUM: / All three members of the Committee were present.

Case No.: 119547, 113764, 103162 / Dr. King appeared without counsel to discuss the allegations set forth in a Notice of the Board dated January 6, 2009. The Committee received statements from Dr. King and discussed the allegations with him.
Dr. King then agreed to discuss an additional allegation identified by the Committee and signed a waiver of notice. The Committee received statements from Dr. King and discussed the allegation with him.
Closed Meeting: / Ms. Howard moved that the Committee convene in a closed session. The motion was seconded and passed.

DECISION:
Case No. 119547, 113764, 103162 / Ms. Howard moved to certify that only matters lawfully exempted from open meeting requirements under Virginia law were heard, discussed or considered by the Committee. The motion was seconded and passed.
Ms. Ross reported that the Committee found Dr. King in violation for: practicing outside the scope of his education, training and experience as a general dentist when he used Botox; publishing or causing to be published an advertisement that was misleading to the public when he indicated that he provided Botox cosmetic and Restylane/Dermal fillers as a dental service; failing to properly document the diagnosis and/or treatment rendered to two patients; failing to include on multiple lab slips his address, the date the order was written, and that he was the Dentist requesting the order; and, exceeding the recommended dosage of Midazolam and/or Diazepam for three patients.
The sanctions reported by Ms. Ross were that the Committee ordered that: Dr. King be issued a Monetary Penalty of one thousand dollars ($1000) and that his license be placed on INDEFINITE PROBATION subject to the following terms and conditions: within six (6) months from entry of the Order, Dr. King shall enroll in and successfully complete not less than seven (7) continuing education hours in risk management and recordkeeping, and sixteen (16) continuing education hours in conscious sedation, which includes pharmacology and within twelve (12) months from entry of the Order, an inspector/investigator of the Department of Health Professions shall obtain a sample of patient records for review by the Committee.
Ms. Howard moved to adopt the decision of the Committee. The motion was seconded and passed.
