Each transit vehicle and miscellaneous material and supplies have exceeded their expected useful service life and it will be sold “as is.” The entire risk as to the condition, quality, and performance of these items is with the Buyer. RTD will not be responsible for any repairs to the vehicle. Each vehicle and surplus items must be removed from the property by the winning bidder within two (2) weeks of being selected as a winning bid. Bidder may bid on more than one vehicle and/or surplus item; however each bid must be separately submitted.

In accordance with the California Code of Regulations, title 13, section 2025:

“An on-road heavy-duty diesel or alternative-diesel vehicle operated in California may be subject to the California Air Resources Board Regulation to Reduce Particulate Matter and Criteria Pollutant Emissions from In-Use Heavy-Duty Diesel Vehicles. It, therefore, could be subject to exhaust retrofit or accelerated turnover requirements to reduce emissions of air pollutants.” For more information, please visit the California Air Resources Board website at http://www.arb.ca.gov/dieseltruck.”

RTD will release all maintenance records with each vehicle to the winning bidder(s).

Hold Harmless Clause. The Buyer to whom award is made is responsible for any and all injury to the public, person(s), and property and for all loss or damage arising from any unforeseen obstructions or difficulties either natural or artificial, which may be encountered in the removal of the Item; for damage to person(s) and property resulting directly or indirectly from the removal of the existing tires and the installation of the bidder’s tires; for damage to person(s) and property resulting directly or indirectly from the removal of the Items from RTD property, for damage from any action of the elements prior to completion of the removal while on RTD property or other storage facility; or for damage from any act or omission (including, but not limited to malpractice, error, or mistake) on the part of the bidder. RTD shall not be liable for any damages or injuries to persons or property caused by Buyer’s purchase and use of the Items, and the Buyer shall defend, indemnify, and hold RTD free and harmless from and against any and all losses, liabilities, expenses, claims, costs, suits, and damages therefore. The Buyer agrees to defend any actions, suits or claims, pay all charges of attorneys and all other expenses and to satisfy and discharge any judgment that may be rendered against RTD, its member agencies, directors, officers, agents, and employees.

Bids will be accepted only by participating in Iron Planet’s auction day (Thursday December 20, 2012). Before auction day, prospective buyers can place priority bids. On auction day, each item is on the block for a three orfive minute time slot, with multiple items often on the block simultaneously. The sale for each vehicle shall be made to the highest responsive bidder. Once the auction is over, Iron Planet will notify winning bidder and handles all the steps of the payment process. Buyers pay into a secure account that they manage. If needed, Iron Planet can also help arrange financing and transportation.
