Properties unsuitable for use as a dwelling due to the execution of alterations or repairs at the liability date. Provide details of the work currently in progress.

Unfinished houses i.e. one off houses under construction and which do

not form part of the trading stock of a business within the meaning of The

Local Government (Charges) Act 2009 and The Local Government (Household Charge) Act 2011. Provide details of work required to complete the project.

The following documents must be included with this declaration:-

  • In all cases photographs to show an external view of each elevation of the property and internal views of each room in the property. Photographs should be provided in respect of all rooms in the house and show the whole room not just part of it. With regard to dampness close up photographs of the effective areas would be beneficial. Please note that the dampness must be to such an extent that renders the houses unfit for us as a dwelling. It is in your own interest to ensure that you provide sufficient photographic evidence to clearly demonstrate an entitlement to an exemption.
  • Where applicable a letter from an Architect / Engineer stating the property is unsuitable for use as a dwelling, detailing in full the nature of the alterations & repairs in progress at the liability date & confirming the proposed completion date of the project. A copy of planning permission & building regulations commencement notice (where applicable) may also be required.
  • Where applicable a letter from an Architect certifying that at the liability date the house was unsuitable for use as a dwelling and that it was not

completed to a standard sufficient to facilitate the contractor in handing over the project to the owner.

  • In all cases site location map with property clearly outlined in red thereon. The map should be a minimum of A4 size & depending on location be either of the following:
  • Rural Place Map to a scale of 1:5000 with the OS ref printed thereon.
    Or
  • Urban Place Map to a scale of 1:5000 with the OS ref printed thereon.
  • Alternatively a copy of the land registry map attached to the deeds of the property maybe furnished in support of your declaration.

I hereby declare that the information provided by me, the owner of the above property, which I am determining as “unsuitable for use as a dwelling” is true and correct to the best of my knowledge and I fully understand that if this statement is incorrectly made by me, I am liable for charges, penalties and fines as set out in the Local Government (Charges) Act 2009 and the Local Government (Household Charge) Act 2011

I further undertake to notify Cavan County Council if this property is refurbished or if repairs are carried out to it which would render it suitable for use as a dwelling OR if the property is occupied again
