Executive Session
6:00 PM
The regular meeting of the Mansfield Township Committee was held on the above shown date with the following in attendance: Mayor Robert Higgins, Deputy Mayor Alfred Clark. Committeeman Sean Gable, Committeewoman Janice DiGiuseppe, Committeeman Arthur Puglia, Solicitor Michael Magee, and Clerk Linda Semus.
Mayor Higgins called the meeting to order followed by the following opening statement.
Public notice of this meeting pursuant to the Open Public Meetings Act NJSA 10:4-6 to 10:4-21 has been satisfied. Notice of this meeting was properly given in the annual notice, which was adopted by the Mansfield Township Committee on January 2, 2014. Said Resolution was transmitted to the Burlington County Times and the Trenton Times, filed with the Clerk of the Township of Mansfield, posted on the official bulletin board at the Municipal Complex, filed with the members of this body and mailed to each person who has prepaid any charge fixed for such service. All of the mailing, posting, and filing having been accomplished as of January 8, 2014.
A motion was offered by Committeeman Puglia and second by Committeeman Clark to go into executive session by adoption of the following resolution. Motion carried.
RESOLUTION 2014-9-1
RESOLUTION AUTHORIZING CLOSED EXECUTIVE SESSION
WHEREAS, Section 7 of the Open Public Meetings Act, Chapter 213, P.L. 1975 [NJSA 10:4-12(B)] permits the exclusion of the public from a meeting in certain circumstances; and,
WHEREAS, this public body is of the opinion that such circumstances presently exists;
NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Mansfield, County of Burlington and State of New Jersey as follows:
The public shall be excluded from discussion of, action on and reviewing the Minutes of
the hereinafter specified matters.
- The general nature of the subject matter to be discussed is as follows: pending litigation, on-going litigation and personnel

matter has been resolved and approved for release by the Township Solicitor.
Regular Meeting

Mayor Higgins called the regular meeting to order followed by the Salute to the Flag and a moment of silence.
A motion was offered by Committeeman Puglia and second by Committeeman Gable to come out of executive session.
Attorney Magee explained that the discussion in executive session included pending litigation, on-going litigation, and personnel.
ENGINEER’S REPORT
Filling in for Engineer Staszewski was Engineer Michael Galante, who reported that they are working on the proposal for the reconstruction of White Pine Road and this should be available early next week.
Bids were received on the municipal fire prevention riser pipe renovations. Direction from the Committee to see if funds are available is pending. Falasca Contractors were the low bidders although action will be taken tonight.
Engineer Galantesaid they are waiting for direction for soliciting quotes for the drainage repairs at the Meadows. Solicitor Magee said there will be a meeting with the developer and their attorney and engineer with Administrator Fitzpatrick and Jef Jones on Friday.
Work is to start the week of the 8th on the municipal water service.
The contractor is waiting for a delivery in order to start the Lynwood Farms pump station and they anticipate its arrival the week of the 15th.
They are waiting for the revised roadway improvement plan for Tuscarora Enterprises so that a contribution amount can be determined for that project.
Mayor Higgins spoke of prior conversations about drainage improvements on property off Mansfield Road East. Engineer Galante said they did an analysis for the cost. They predict around $5,000 to $7,000. They can either solicit quotes for the work or do a change order to the existing contract which is what he recommended. Mayor Higgins felt someone from Remington & Vernick to contact Administrator Fitzpatrick with information so we can move forward.
A motion was offered by Committeeman Puglia and second by Committeeman Gableto accept the Engineer’s Report. Motion carried.
ORDINANCES
ORDINANCE NO. 2014-12
AN ORDINANCE TO AMEND THE CODE OF THE TOWNSHIP OF MANSFIELD BY DELETING AND REPEALING SECTION 13.2 OF CHAPTER 60 THEREOF, “STATUTORY PROVISIONS APPLICABLE TO THE MAPLETON AND FOUR SEASONS COMMUNITIES” AND REPLACING IT WITH A NEW SECTION 13.2 OF CHAPTER 60, TO BE ENTITLED “STATUTORY PROVISIONS APPLICABLE TO THE MAPLETON AND FOUR SEASONS COMMUNITIES”
Be it enacted by the Mansfield Township Committee as follows:
Section 1.
The Code of the Township of Mansfield is hereby amended by deleting and repealing Section 13.2 of Chapter 60, Statutory Provisions Applicable to the Mapleton and Four Seasons Communities.
Section 2.
The Code of the Township of Mansfield is hereby amended by adding thereto a new chapter, to replace Section 13.2 of Chapter 60, hereinabove repealed, to be Section 13.2 of Chapter 60, Statutory Provisions Applicable to the Mapleton and Four Seasons Communities, to read as follows:
WHEREAS, the community of Four Seasons within the Township of Mansfield is among one of the newer neighborhoods in the Township; and
WHEREAS, the community of Four Seasons Public Offering Statement prohibits overnight parking on certain streets within the community, and
WHEREAS, the community has experienced an increase of overnight parking on the streets within the community; and
WHEREAS, the original developer of the neighborhood, K. Hovnanian at Mansfield, Inc. has filed a written request with the Township for the application of the provisions of Subtitle One of Title 39 of the Revised Statutes of the State of New Jersey to the semi-public roads, streets, driveways and parking lots in the community to enhance, among other things, the safety of the public; and
WHEREAS, the Department of Transportation has conducted a field investigation with regard to this request and has advised the Township of various regulations that can be recommended for approval:
NOW THEREFORE BE IT ORDAINEDAND ESTABLISHED, by the Township of Mansfield in the County of Burlington and State of New Jersey that the following amendment shall be established and become enforceable:
A. General Parking Regulations.
- All vehicles must park in designated areas and between the lines
provided.
- No person shall stop or stand a vehicle upon any of the streets or
parts of streets described below, except in areas covered by other parking restrictions.

- Vehicles may park on the south side of Arlington Avenue between

.Handicapped Parking. All stalls shall be 12 feet wide as shown on the attached site plan and signed with the R7-8 and R7-8P (Reserved Parking Sign and Penalty Plate), In the designated parking areas for persons who been Issued the Handicapped Parking Permit by the Division of Motor Vehicles.
B. Reserved Parking Regulations.
All vehicles that are granted specialty parking in the reserved parking section, such as police vehicles, ambulances, teachers, etc. must be properly identified. The reserved parking spaces shall only be those shown on the filed site plan attached hereto and on file in the office of the Township Clerk.
C. Through Streets; Stop and Yield Intersections.
- Through Streets. The following streets or parts of streets are hereby designated as Through Streets, Stop Signs shall be installed on the near right side of each street intersecting the Through Streets except where Yield signs are provided for in the designation.

G.Tow-Away Zones.
Any vehicle parked or standing as to obstruct or impede a normal flow of traffic or block, entrances or exit ways, loading
zones, no parking zones, oil -fills, any grassy area pedestrian walkway, or present in any way a safety or traffic hazard may be removed by towing
the vehicle at the owners or operators expense.
H.Authorized Vehicles Only.
The following streets or parts of streets shall be designated as use for
authorized vehicles only. No vehicle other than an authorized vehicle
shall enter upon the below roadway.

- Signs.
All signs shall conform to the current edition of the Manual on Uniform Traffic Control Devices pursuant to N.J.S.A 39:4-198 and N.J.S.A. 39:4-183.27. The developer shall erect all such traffic control devices in accordance with this Ordinance.
J. Penalties.
Unless another penalty is expressly provided for by statute, every
person convicted of a violation of this ordinance or any supplement thereto
shall be subject to a penalty of not less than $35.00 nor more than $350.00 or
imprisonment for a period of not more than fifteen (15) days or both.
K. Dedication.
In the event of the dedication of any of the roads, streets, or parking
lots encompassed by this Ordinance to the Township of Mansfield and the
acceptance of such roads, streets, or parking lots by the Township, such
roads, streets, and parking lots shall become subject to the provisions of Title
39 of the Revised New Jersey Statutes in the same way and manner as any
other public street including the penalty provisions of laws and ordinances
applicable to public rights of way, notwithstanding the provisions of Section
J, above.
L. Severability.
Should any portion of this Ordinance be declared invalid or
unenforceable by a Court of competent jurisdiction, the remaining portions
shall remain valid and of full force and effect.
M. Effective Date.
This Ordinance shall become effective upon adoption, approval
by the Commissioner of the Transportation, and publication in accordance
with law.
Mayor Higgins opened the Public Hearing. Hearing no comments, the public
hearing was closed.
Committeewoman DiGiuseppe made a motion to adopt Ordinance 2014-12. The
motion was second by Committeeman Clark.
Barbara Willis, 63 Greenbrook Drive, questioned the purpose of the ordinance.
Committeeman DiGiuseppe explained the ordinance gives the police authority to enforce
overnight parking in Four Seasons from 1am to 5am.
The above motion was carried.
ORDINANCE 2014-13
REFUNDING BOND ORDINANCE PROVIDNG FOR THE REFUNDING OF PRIOR BONDS ISSUED BY THE TOWNSHIP OF MANSFIELD, IN THE COUNTY OF BURLINGTON, NEW JERSEY, APPRORIATING NOT TO EXCEED $6,500,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF NOT TO EXCEED $6,500,000 BONDS OR NOTES OF THE TOWNSHIP FOR FINANCING THE COST THEREOF
BE IT ORDAINED BY THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF MANSFIELD, IN THE COUNTY OF BURLINGTON, NEW JERSEY (not less than twothirds of all members thereof affirmatively concurring) AS FOLLOWS:
Section 1.The Township of Mansfield, in the County of Burlington, New Jersey (the “Township”) is hereby authorized to refund on a current basis all, or a portion of, the Township’s outstanding $5,890,000 General Obligation Bonds issued in 2006 in two series with $5,025,000 General Improvement Bonds, Series A outstanding and $865,000 General Improvement Bonds, Series B outstanding, and maturing in the years 2017 through 2025 (the “Refunded Bonds”) at a redemption price equal to 100% of the principal amount outstanding of the Refunded Bonds and interest through the redemption date for the Refunded Bonds and to pay the costs related to the issuance of the Refunding Bonds (as defined below) and the expenses related to redeeming the Refunded Bonds.
Section 2.An aggregate amount not exceeding $100,000 for items of expense listed in and permitted under N.J.S.A. 40A:251(b) has been included in the aggregate principal amount of refunding bonds authorized herein.
Section 3.In order to finance the cost of the project described in Section 1 hereof, negotiable refunding bonds are hereby authorized to be issued in the principal amount not in excess of $6,500,000 (the “Refunding Bonds”) pursuant to the Local Bond Law.
Section 4.In anticipation of the issuance of the refunding bonds, negotiable bond anticipation notes are hereby authorized to be issued pursuant to and within the limitations prescribed by the Local Bond Law. All refunding bond anticipation notes issued hereunder shall mature at such times as may be determined by the chief financial officer, provided that no note shall mature later than one year from its date. The notes shall bear interest at such rate or rates and be in such form as may be determined by the chief financial officer. The chief financial officer shall determine all matters in connection with notes issued pursuant to this ordinance, and the chief financial officer’s signature upon the notes shall be conclusive evidence as to all such determinations.
All notes issued hereunder may be renewed from time to time, but all such notes including renewals shall mature and be paid no later than the fifth anniversary of the date of the original notes; provided, however, that no notes shall be renewed beyond the first or any succeeding anniversary date of the original notes unless an amount of such notes, at least equal to the first legally payable installment of the bonds in anticipation of which the notes are issued, determined in accordance with the maturity schedule for the bonds approved by the Local Finance Board, is paid and retired on or before such anniversary date; and provided, further, that the period during which the bond anticipation notes and any renewals thereof and any permanent bonds are outstanding, shall not exceed the period set for the maturity of the bonds by the Local Finance Board.
The chief financial officer is hereby authorized to sell part or all of the notes from time to time at public or private sale and to deliver them to the purchasers thereof upon receipt of payment of the purchase price plus accrued interest from their dates to the date of delivery thereof. The chief financial officer is directed to report in writing to the governing body at the meeting next succeeding the date when any sale or delivery of the notes pursuant to this ordinance is made. Such report must include the amount, the description, the interest rate and the maturity schedule of the notes sold, the price obtained and the name of the purchaser.
Section 5.The chief financial officer of the Township is hereby authorized to prepare and to update from time to time as necessary a financial disclosure document to be distributed in connection with the sale of obligations of the Township and to execute such disclosure document on behalf of the Township. The chief financial officer is further authorized to enter into the appropriate undertaking to provide secondary market disclosure on behalf of the Township pursuant to Rule 15c2-12 of the Securities and Exchange Commission (the “Rule”) for the benefit of holders and beneficial owners of obligations of the Township and to amend such undertaking from time to time in connection with any change in law, or interpretation thereof, provided such undertaking is and continues to be, in the opinion of a nationally recognized bond counsel, consistent with the requirements of the Rule. In the event that the Township fails to comply with its undertaking, the Township shall not be liable for any monetary damages, and the remedy shall be limited to specific performance of the undertaking.
Section 6. The Supplemental Debt Statement required by the Local Bond Law has been duly prepared and filed in the office of the Clerk, and a complete executed duplicate thereof has been filed in the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of New Jersey. Such statement shows that the gross debt of the Township as defined in the Local Bond Law is increased by the authorization of the bonds and notes provided in this bond ordinance by $6,500,000, and the obligations authorized herein have been authorized in accordance with that Law.
