I undertake to let Birmingham Sport & Physical Activity Trust (Sport Birmingham) know if any of the information supplied in the response to this questionnaire changes prior to award of the contract and I accept that changes may result in the Applicant being excluded from the competition where the Applicant no longer satisfies the pass/fail criteria in this questionnaire.

Part 2 – Application Questions

Applicants must respond and provide relevant information with regard to all matters set out below. The responses and information MUST be submitted as part of the Tender and this requirement is in addition to any requirement to provide such information set out in the Conditions of Contract. Failure to provide such information with the Tender may result in the tender being rejected.

In addition to the below questions being answered, we will also need a CV and the following question answered in no more than 500 words:

‘Why do you feel you are the right person to impact schools in Birmingham in terms of their attitude to Sport, PE and Physical Activity’?

Please explain how you meet the following

•Be a qualified education professional with experience of working in primary school environments
•Have an understanding of the wider support available to schools around PE and sport and the role of key partners such as the Youth Sport Trust, UK Coaching, Association for PE, Sport England and County Sports Partnerships
•Be impartial in terms of promoting opportunities and packages available to schools to purchase, and encourage schools to engage in activities as identified by BSPAT
•Be experienced in mentoring, action planning, and curriculum development directly in relation to primary school PE and sport
•Be able to work with enough flexibility to meet the needs of primary schools in the sub region who request support
•Be able to offer advice to schools that is in line with best practice, is objective, and does not promote any partnership offer over another
•Willing to work in partnership with Sport Birmingham and local educational organisations to coordinate support for schools in a joined up way.

TO BIRMINGHAM SPORT AND PHYSICAL ACTIVITY TRUST (BSPAT)

5.1. I/We, carrying on business at the address above, by signing this expression of interest (tender) and submitting, hereby agree as follows:

Having examined all the documents relating to the contract described therein, hereby offer to execute the contract in accordance with the said documentation, for the prices inserted by me/us on the Pricing Summary.

5.2. I/We agree that this tender shall, subject to review in accordance with the Contract, be on a firm price basis and will not be subject to any adjustment for any increases or decreases in rates of wages or prices of materials on which the tender has been calculated other than is determined in accordance with the Contract.

5.3. I/We agree to conform to the Instructions for Submitting a Tender in Section 1 of this Tender Document and the Contract Documents (including for the avoidance of doubt the terms and conditions set out in the Form of Agreement) and agree that the insertion by me/us of any conditions qualifying this Tender or any other alteration to any of the Contract Documents shall not affect the said Contract Documents and may cause the Tender to be rejected.

5.4. I/We agree that this tender is submitted on the footing that the offer herein contained shall remain in force without variation for period of (12) weeks from the closing date for the receipt of tenders.

5.5. I/We certify that this is a bona fide Tender and that I/We have not fixed or adjusted the amount of the Tender by or under or in accordance with any agreement or arrangement with any other person.

5.6. I/We also certify that I/We have not done and I/We undertake that I/We will not do at any time before the hour and date specified for the return of this Tender any of the following acts:

(a) communicated to a person other than the person calling for the Tender the amount or approximate amount of the proposed Tender, except where disclosure, in confidence, of the approximate amount of the Tender was necessary to obtain insurance premium quotations required for the preparation of the Tender; or

(b) entering into any agreement or arrangement with any other person that he/she refrain from tendering or as to the amount of any tender to be submitted; or

(c) offering or paying or giving or agreeing to pay or give any sum of money or valuable consideration directly or indirectly to any person for doing or having done or caused or having caused to be done in relation to any other tender or proposed tender any act or thing of the sort described above.

(d) In this Tender Statement, the word “person” includes any persons and anybody or association, corporate or unincorporated, and “any agreement or arrangement” includes any such transactions, formal or informal, and whether legally binding or not.

Appendix 1 - STATEMENT OF GOOD STANDING

General Terms and Conditions are detailed below.

STATEMENT RELATING TO GOOD STANDING — GROUNDS FOR OBLIGATORY EXCLUSION (IN ELIGIBILITY) AND CRITERIA FOR REJECTION OF CANDIDATES in accordance with Regulation 23 of the Public Contracts Regulations 2006.

Grounds for mandatory rejection

By submitting a response to this Tender, the Applicant confirms that the Applicant, its directors and any other person who has powers of representation, decision or control of the Applicant has not been convicted of any of the following offences:

(a)conspiracy within the meaning of section 1 or 1A of the Criminal Law Act 1977 or article 9 or 9A of the Criminal Attempts and Conspiracy (Northern Ireland) Order 1983 where that conspiracy relates to participation in a criminal organisation as defined in Article 2(1) of Council Framework Decision 2008/841/JHA;

(b)corruption within the meaning of section 1(2) of the Public Bodies Corrupt Practices Act 1889 or section 1 of the Prevention of Corruption Act 1906 where the offence relates to active corruption[1];

(c)the offence of bribery, where the offence relates to active corruption[1];

(ca)bribery within the meaning of section 1 or 6 of the Bribery Act 2010

(d)fraud, where the offence relates to fraud affecting the European Communities’ financial interests as defined by Article 1 of the Convention on the protection of the financial interests of the European Communities, within the meaning of:

(i)the offence of cheating the Revenue;

(ii)the offence of conspiracy to defraud;

(iii)fraud or theft within the meaning of the Theft Act 1968, the Theft Act (Northern Ireland) 1969, the Theft Act 1978 or the Theft (Northern Ireland) Order 1978;

(iv)fraudulent trading within the meaning of section 458 of the Companies Act 1985, article 451 of the Companies (Northern Ireland) Order 1986 or section 993 of the Companies Act 2006;

(v)fraudulent evasion within the meaning of section 170 of the Customs and Excise Management Act 1979 or section 72 of the Value Added Tax Act 1994;

(vi)an offence in connection with taxation in the European Union within the meaning of section 71 of the Criminal Justice Act 1993; or

(vii)destroying, defacing or concealing of documents or procuring the execution of a valuable security within the meaning of section 20 of the Theft Act 1968 or section 19 of the Theft Act (Northern Ireland) 1969;

(viii)fraud within the meaning of section2,3 or 4 of the Fraud Act 2006; or

(ix)making, adapting, supplying or offering to supply articles for use in frauds within the meaning of section 7 of the Fraud Act 2006;

(e)money laundering within the meaning of section 340 (11) of the Proceeds of Crime Act 2002;

(ea) an offence in connection with the proceeds of criminal conduct within the meaning of section 93A, 93B or 93C of the Criminal Justice Act 1988 or article 45, 46 or 47 of the Proceeds of Crime (Northern Ireland) Order 1996;

(eb) an offence in connection with the proceeds of drug trafficking within the meaning of section 49, 50 or 51 of the Drug Trafficking Act 1994; or

(f)any other offence within the meaning of Article 45(1) of Directive 2004/18/EC as defined by the national law of any relevant State.

Further grounds for rejection

By submitting a response to this Tender the Applicant confirms that the Applicant, its directors and any other person who has powers of representation, decision or control of the Applicant:

(a)being an individual is a person in respect of whom a debt relief order has not been made or not bankrupt or has not had a receiving order or administration order or bankruptcy restrictions order or a debt relief restrictions order made against him or has not made any composition or arrangement with or for the benefit of his creditors or has not made any conveyance or assignment for the benefit of his creditors or does not appear unable to pay or to have no reasonable prospect of being able to pay, a debt within the meaning of section 268 of the Insolvency Act 1986, or article 242 of the Insolvency (Northern Ireland) Order 1989, or in Scotland has not granted a trust deed for creditors or become otherwise apparently insolvent, or is not the subject of a petition presented for sequestration of his estate, or is not the subject of any similar procedure under the law of any other state;

(b)being a partnership constituted under Scots law has not granted a trust deed or become otherwise apparently insolvent, or is not the subject of a petition presented for sequestration of its estate;

(c)being a company or any other entity within the meaning of section 255 of the Enterprise Act 2002 has not passed a resolution or is not the subject of an order by the court for the company’s winding up otherwise than for the purpose of bona fide reconstruction or amalgamation, nor had a receiver, manager or administrator on behalf of a creditor appointed in respect of the company’s business or any part thereof or is not the subject of similar procedures under the law of any other state;

(d)has not been convicted of a criminal offence relating to the conduct of his business or profession;

(e)has not committed an act of grave misconduct in the course of his business or profession;

(f)has fulfilled obligations relating to the payment of social security contributions under the law of any part of the United Kingdom or of the relevant State in which the organisation is established;

(g)has fulfilled obligations relating to the payment of taxes under the law of any part of the United Kingdom or of the relevant State in which the economic operator is established;

(h)is not guilty of serious misrepresentation in providing any information referred to within regulation 23,24,25,26 or 27 or has not provided such information in response to a request by the contracting authority;

(i)in relation to procedures for the award of a public services contract, is licensed in the relevant State in which he is established or is a member of an organisation in that relevant State when the law of that relevant State prohibits the provision of the services to be provided under the contract by a person who is not so licensed or who is not such a member.
