RESOLVED: (1) THAT planning permission be granted subject to the conditions as detailed in the report now submitted, and an additional condition requiring the applicant to submit a considerate contractor management plan, and that the Strategic Director of Customer and Support Services be authorised to enter into a legal agreement under section 106 of the Town and Country Planning Act 1990, to secure the payment of a commuted sum for open space and recreation space purposes, as required by Policy H8 of the City of Salford Adopted Unitary Development Plan and the Salford’s Greenspace Strategy 2006.

(2) THAT the applicant be requested to investigate appropriate measures to address the concerns raised with regard to the access to the proposed development

49. PLANNING APPLICATION NO. 06/52963/OUT, HER MAJESTY’S COURT SERVICE AND URBAN VISION PARTNERSHIP LIMITED, JOHN WILLIAM CAR PARK, LAND BOUNDED BY JOHN WILLIAM STREET, VICARAGE GROVE AND BIRKDALE GROVE, ECCLES - OUTLINE PLANNING APPLICATION TO INCLUDE MEANS OF ACCESS IN RESPECT OF THE ERECTION OF A COMBINED COURT BUILDING, MULTI-STOREY CAR PARK AND ANCILLARY WORKS - SECTION 278 AGREEMENT

RESOLVED: THAT planning permission be granted subject to the conditions as detailed in the report now submitted, with (a) an amendment to condition 8 to delete the wording included within the report and substitute ‘prior to the commencement of development, further studies to investigate improvements to the junction of Wellington Road/Albert Street/Albert Road shall be undertaken and, if any significant capacity improvements are required to mitigate the impact of the development, these shall be submitted to and approved in writing by the Local Planning Authority. The agreed works shall be constructed in accordance with the approved scheme prior to any part of the development first becoming operational, unless agreed otherwise in writing by the Local Planning Authority and (b) an additional condition requiring the applicant to submit a considerate contractor management plan to include a requirement that construction traffic will only access the site via Albert Street and Albert Road, and that the Strategic Director of Customer and Support Services be authorised to enter into a legal agreement under section 278 of the Highways Act 1980, to secure the provision of appropriate highway works at the junction of Wellington Road/Albert Street/Albert Road, or any required traffic calming measures.
