NOTICE TO ATTEND A DISCIPLINARY HEARING
(ALLEGED MISCONDUCT)
EMPLOYEE’S NAME: / THEUNS KOTZEKINDLY TAKE NOTICE THAT a DISCIPLINARY HEARING will be held in respect of the allegations as detailed here below:
ALLEGATIONS: (Specify here or in a separate document annexed to this notice):
CHARGE 1: HATE SPEECH, in that you have send an inappropriate sms text message to a fellowemployee which constitute hate speech.
CHARGE 2: DERELICTION OF DUTIES / INCOMPETENCE, in that you have failed to exercise diligence
and lacked judgement and ability to show competency in your work.
CHARGE 3: INCOMPATIBILITY, in that you fail to co-operate with other team members and major
clients of the employer, and lack a personality suitable for the employer.
CHARGE 4: GROSS NEGLIGENCE, in that you failed to pay attention and / or reasonable levels
of professional judgement expected from a person in your seniority and in your position.
The Impact :
(i) The working relationship between you and the employer as well as fellow employees.
(ii) The trust relationship between the employer and employee.

By signing this notice you confirm that you have been advised of the following:
1. You are entitled to be assisted at the Disciplinary Hearing by a fellow employee or a trade union official if you are a member of a trade union.
2. You are entitled to have an interpreter, if requested prior to the Disciplinary Hearing, timeously after receipt of this notice.
3. You are entitled personally, or through your representative, to question the employer’s witness/es during the Disciplinary Hearing, to lead evidence either personally or through your representative to call witnesses, submit documentation or exhibits, cross-examine witlessness called by the employer and to inspect any documentation and exhibits presented to substantiate any allegations levelled against you.
4. You are entitled to call witnesses, furnish evidence and argue on the question of whether the allegations occurred.
5. If the employer finds the allegations to be proven, then you are entitled to furnish evidence and to argue in mitigation of disciplinary sanction.
6. You have been advised that should you refuse / fail to attend the Disciplinary Hearing, the Hearing will be held in your absence.
7. You are further hereby immediately suspended from your place of work, with full salary benefits, pending the outcome of the Disciplinary Hearing.
8. You have a right to be informed of the findings and the reasons therefor.
9. You have a right to be informed of the sanction, in respect of a guilty finding.
