GUIDANCE

On assistance Policy to Investment in Infrastrure Construction of Industrial Cluster as per Resolution No. 12/2010/NQ-HĐND of the provincial People’s Council

Based on the Resolution No. 12/2010/NQ-HĐND dated July 22, 2010 of the provincial People’s Council on Assistance to Investment in Infrastructure Construction of Industrial Cluster in Vinh Phuc Province, Period of 2010-2015;

Based on Decision No. 28/2010/QĐ-UBND dated October 4, 2010 of Vinh Phuc people’s Committee on Assistance to Investment in Infrastructure Construction of Industrial Cluster in Vinh Phuc Province, Period of 2010-2015.

The inter-departments of Planning & Investment, Finance and Industry and Trade provide guidance on some contents of document files, progress, procedure to enjoy the assistance policy as follows:

1. Assistance Object

Objects specified in Item 2 of Article 1 of the Regulation on Assistance to Investment in Infrastructure Construction of Industrial Cluster in Vinh Phuc province Period 2010-2015 Promulgated to Decision No. 28/2010/QĐ-UBND dated October 4, 2010 of Vinh Phuc People’s Committee shall be considered to assist capital from the budget.

2. Condition of Assistance

a) For the investor who directly constructs the infrastructure of industrial cluster (called the Developer) should satisfy the following conditions:

Meeting enough conditions as specified in Point 2.2, Item 2, Article 2 of the Regulation on Assistance to Investment in Infrastructure Construction of Industrial Cluster in Vinh Phuc province Period 2010-2015 Promulgated to Decision No. 28/2010/QĐ-UBND;

The Developer enjoy the assistance only when the Developer completed the items to be assisted as stipulated in Article 3 of Decision No. 28/2010/QĐ-UBND of the Provincial People’s Committee, (if any).

b) For enterprises, trade households operating in the industrial cluster should satisfy the following conditions:

- Land use and implement the invested project and trade activities in accordance with the contents specified in the investment registration or in the issued investment certificate;

- Meeting enough conditions stipulated in Point 2.3, Item 2, Article 2 of the Regulation on Assistance to Investment in Infrastructure Construction of Industrial Cluster in Vinh Phuc province Period 2010-2015 Promulgated to Decision No. 28/2010/QĐ-UBND;

Assistance after completion of moving the production establishment into the industrial cluster.

3. Content and Assistance Level

Stipulated in Article 3, 4 of the Regulation on Assistance to Investment in Infrastructure Construction of Industrial Cluster in Vinh Phuc province Period 2010-2015 promulgated to Decision No. 28/2010/QĐ-UBND.

4. Principal, Progress to Prepare Assistance plan.

a) Principal of Preparing Plan

Every year, basing on time, task of preparing the plan of socio-economic development and budget estimation according to the Instruction of Chairman of the provincial People’s Committee and other guideline of the departments of Planning & Investment, Finance; Basing on the contents and total investment assistance to infrastructure construction of industrial cluster in the province period 2010-2015 and the implementation of the previous year plan, the Department of Industry and Trade should prepare document to propose assistance to the industrial cluster; Department of Planning & Investment, Department of Finance shall summarize, capital source balance report to the provincial People’s Committee, the provincial People’s Committee submit to the provincial People’s Council for decision and allocation the plan criteria of assistance source.

b) Progress of Preparing Plan:

- Based on the schedule and objective of invested project implementation of infrastructure construction, the Developer shall prepare a plan of assistance sending it to Department of Industry and Trade;

- Based on the objective, condition, content and assistance level, Departent of Industry and Trade considers and appraises to propose assistance to each industrial cluster; summarizes the assistance demand of the whole province to send to Department of Planning & Investment, Department of Finance to make a balance of capital source, include to the general socio-economic development plan, reports to the provincial People’s Committee and submits to the provincial people’s Council for decision and allocation of assistance capital source;

5. Document File:

a) For the Developer, basing on each item to be assisted according to the point 2.2, Item 2, Article 2 of Regulation on Assistance to Investment in Infrastructure Construction of Industrial Cluster in Vinh Phuc province Period 2010-2015 promulgated to Decision No. 28/2010/QĐ-UBND, the document shall include:

- Legal copy od Decision of the provincial People’s Committee on establishment of industrial cluster and its Developer; Commitment of advance payment to compensation and site clearance after being given the plan of compensation approved by competent authority;

- Legal copy of Decision on approval of design task, detail planning of 1/500 or decision on approval of detail planning 1/500 by the provincial people’s Committee, (if any)

- Legal copy of decision on approval of project on infrastructure construction of industrial cluster or Investment Certificate;

- Legal copy of decision on approval of report on environment assessment impact of the industrial cluster;

- Plan of bomb and mine disarming approved by a competent authority, (if any);

- Result of document appraisal, drawing and design, cost estimate of construction of solid waste disposal, wastewater treatment system by Department of Construction, (if any);

- Letter to propose assistance of the Developer according to Form QLCCN-03/2012 enclosed with investment schedule;

Acceptance Minute of items completed to propose assistance with confirmation of Departments of Industry and Trade, Planning & Investment and district people’s Committee (if any).

Document shall be made into two sets, sending to Department of Industry & Trade one set, Department of Planning & Investment one set. Within 15 working days from the date of receiving proper document, Department of Industry & Trade shall organize to appraise then sends to Department of Planning & Investment submitting to the provincial People’s Committee for consideration of assistance within 20 working days.

b) For the enterises, production establishments operating in the industrial cluster shall follow the stipulation in Point 2.3, Item 2, Article 2 of Regulation on Assistance to Investment in Infrastructure Construction of Industrial Cluster in Vinh Phuc province Period 2010-2015 promulgated to Decision No. 28/2010/QĐ-UBND, the document shall include:

+ Letter to propose assistance of the Developer according to Form QLCCN-03/2012 enclosed with the document of labor training of the enterprise, labor contract, professional certificate, legal copy of permanent address;

+ Confirmation letter of moving the enterprise or business household into the industrial cluster by commune People’s Committee and the developer.

The above are contents of guidance to unit, enterprise, entity, individual implementing the Resolution No. 12/2010/NQ-HĐND of the Provincial People’s Council. During implementation, if any difficulty, please reflex to Departments of Planning & Investment, Finance and Industry & Trade for coordination to resolve
