Town Board Meeting

June 10, 2013

The Town Board meetings were held at the Town Hall, 4 Church Street, Niverville, New York.

AUDIT MEETING:

Present: Supervisor Grattan

The Audit meeting was held at 6:30PM. The purpose for the meeting is to audit the claims from May 2013.

Bid Opening(s) - Supervisor Grattan opened the bids received.

Summer Transportation- 2 bids were received

1.  Michael Johnston Transportation- $182 per day $145 extra bus

2.  Durham School Services- $355.69 per day extra bus same price

Message Sign- 2 bids were received

1.  Donnelly Construction -$ 15,750.00

2.  Traffic Lane Closures- $16,925.00

TOWN BOARD MEETING:

1. Supervisor Grattan called the regular meeting to order.

2. A motion was made by Councilwoman Leader and seconded by Councilwoman Simonsmeier to accept the agenda. All in favor. Motion carried unanimously.

3. A motion was made by Councilwoman Leader and seconded by Councilman Smith to accept the minutes submitted of May 20, 30 and June 5, 2013. All in favor. Motion carried unanimously.

4. Budget Transfers-none

5. Councilman Smith made a motion to authorize to pay all audited vendors claims. Motion seconded by Councilman Ooms.

6. A motion was made by Councilwoman Leader and seconded by Councilman Smith to accept and direct the correspondence. All in favor. Motion carried unanimously.

7. Public Presentations: none

8. Councilwoman Leader announced the next neighborhood watch for June 27, 2013 at 7:00PM. She said there was going to be a joint public presentation by the Sheriff and the Office of the Aging.

Highway Superintendent Ruchel said they are ready to do the mulch for the summer program and they are getting ready to do Old Post Road and Maple Lane.

9. Public Comments:

Ed Simonsen- talked about the project on the sidewalks and the sewer connection and commended the Village of Valatie and the Village of Kinderhook.

10. Old Business

A. Speed /Message Sign Bid

A motion was made by Supervisor Grattan and seconded by Councilwoman Simonsmeier to award the speed/message sign bid to Donnelly Construction for $15,750.00. All in favor. Motion passed unanimously.

B. Summer Transportation-

A motion was made by Supervisor Grattan and seconded by Councilman Smith to award the summer transportation bid to Michael Johnston Transportation for $182 per day $145 extra bus . All in favor. Motion passed unanimously.

C. Martin H. Glynn Building Use Applications

1. Valatie Community Theatre- gym-Sat. August 24th 8pm-Midnight

The Town board agreed that they would have to responsible for paying 2 deputies $294.00.

2. VERA – 3rd Wed. of each month-meeting room-beginning June 19th

A motion was made by Councilwoman Simonsmeier and seconded by Councilman Smith to allow VERA to use the meeting room. All in favor. Motion passed unanimously.

3. Boy Scout Troop 113-Classroom 104-full time

A motion was made by Supervisor Grattan and seconded by Councilwoman Simonsmeier to allow Boy Scout Troop 113 to use classroom 104 full time. All in favor. Motion passed unanimously.

4. The Warren School of Art- classroom-Thurs. 9-4, Fridays 9-4

Insurance was not provided -this was delayed until further notice

5. Northeast Spartans-gym-times vary-

Tabled-Functions cannot be held when there are meetings held

6. Uncle Sam Hoopsters, AAU Basketball-gym-Tues. and Thurs.

D. Bells Acres/Rod and Gun Club

Supervisor Grattan explained that residents living in Bells Acres sharing their concerns regarding public safety issues concerning the Rod and Gun Club. He said he has spoke with a number of people in law enforcement and the legal profession about getting some expert advice on the issue. He said there is a gentleman in New Jersey, John Zamrok who sent up a proposal. He said before he gets hired that we have our Building Inspector Wayne Voss (a retired State Trooper) to collect things and get a report together. He said we would get together with the neighbors and a map and pull it together and then he can work with the expert with his findings.

A Special meeting has been scheduled for July 8, 2013 at 6:30pm right before the next regular Town Board meeting.

11. New Business

A.  Uniform Notice of Claims Resolution

Town Attorney Andy Howard explained that there has been a movement across the state to petition big government to modify the notice of claims regulations in regard to personnel injury property damage suits against municipalities. He said they are looking for signs of support across the Towns across the State of New York for the revisions. He said it provides additional liability protection for the municipality.

A motion was made by Councilwoman Leader and seconded by Councilman Ooms to support the Uniform Notice of Claims Amendments. All in favor. Motion passed unanimously.

B.  Comprehensive Plan

Supervisor Grattan said that the Comprehensive Plan addendum is at the Columbia County Planning Board for their review and decision.

C.  Surplus File Cabinets-Town of Chatham

A motion was made by Councilwoman Leader and seconded by Councilman Smith to donate the surplus file cabinets to the Town of Chatham. All in favor. Motion passed unanimously.

D.  Hire Assistant-Playground-one day

A motion was made by Councilwoman Simonsmeier and seconded by Councilman Smith to hire Camille McComb as an assistant to the playground at minimum wage. All in favor. Motion carried unanimously.

E.  Discussion on sale of Former Town hall

Supervisor Grattan said that it was suggested that they sell it by Online Auctions. He will get the information and get back to the Town Board.

10. Public Comments-

Bob Cramer- asked if he could get a copy of Mr. Voss’s report for the Board of Directors.

11. Board Comments- Councilman Smith said he would like to follow up with NYSERDA and suggested doing an energy audit.

12. Media Questions- asked what the man from New Jerseys name was.

13. Executive Session:

A motion was made by Councilwoman Leader and seconded by Councilwoman Simonsmeier to go into executive session to discuss litigation. All in favor. Motion passed unanimously.

A motion was made by Councilman Smith and seconded by Councilman Ooms to come out of executive session. All in favor. Motion passed unanimously.

A motion was made by Councilwoman Leader and seconded by Councilman Smith to accept the $17,500.00 settlement claim against the Engineers for the Highway Garage. All in favor. Motion carried unanimously.

14. Adjournment

Councilwoman Leader made a motion to adjourn the meeting. Councilman Smith seconded the motion. All in favor. So carried.
