An ordinance approving the Preliminary and Final Plat of resubdivision of the Remaining PT. of Original Lot E-2 Wiegand Tract and the Remainder of Parcel C, Section 3 , Township 13 South, Range 23 East, Jefferson Parish, Louisiana, into Parcel RG, Parcel E-3, and Parcel E-4, Section 3 , Township 13 South, Range 23 East, Jefferson Parish, Louisiana in accordance with the plan by Landmark Surveying, Inc. dated October 28, 2008, Revision 5, dated May 5, 2009 which parcels are owned by Riverbend Associates, a Louisiana Partnership in Commendam and Francis A. Quinette Realty Co., Inc., a Louisiana corporation and approving and accepting the Final Plat (Council District 3)
WHEREAS, Riverbend Associates, a Louisiana Partnership in Commendam, is the owner of the Remaining PT. of Original Lot E-2 Wiegand Tract, Section 3, Township 13 South, Range 23 East, Jefferson Parish, Louisiana which it acquired by Act of Sale, before John McEnery Robertson, Notary Public, dated June 6, 1980, registered on September 15, 1980 in COB 988, folio 659, Parish of Jefferson, State of Louisiana, and
WHEREAS, Quinette Realty Co., Inc., now known as Francis A. Quinette Realty Co., Inc., is the owner of the Remainder of Parcel C, Section 3, Township 13 South, Range 23 East, Jefferson Parish, Louisiana, which it acquired by Act of Credit Sale, before Henry S. H. Verlander, Jr. , Notary Public, dated, November 20, 1968 registered on November 21, 1968 in COB 688, folio 718, Parish of Jefferson, State of Louisiana, and
WHEREAS, said owners desire to resubdivide said parcels into three (3) parcels to be designated as Parcel RG, Parcel E-3, and Parcel E-4, Section 3 , Township 13 South, Range 23 East, Jefferson Parish, Louisiana; and
WHEREAS, one of said owners, Riverbend Associates, wishes to dedicate and quitclaim to Jefferson Parish, as a drainage parcel, all of its rights, title and interest to that portion of ground designated as the Union Pacific Right-of-way land on its property, to be known as Parcel E-4; and
WHEREAS, the right-of-way agreement between Riverbend Associates and Union Pacific Railroad Company is recorded in this Parish at COB 3039, folio 561; Entry #10049819; and
WHEREAS, Riverbend Associates wishes to dedicate a drainage servitude on the northern side of Parcel E-4, to extend northerly 35’ feet from the top of bank from the railroad ditch; and
WHEREAS, said subdivision shall contain no public improvements, therefore the Preliminary Plat and Final Plat may be approved and accepted in combination in accordance with Section 33-2.26 (d) of the Jefferson Parish Code of Ordinances; and
WHEREAS, said owners desire to condition the final implementation of the approval of said resubdivision plan on the transfer of title to Parcel RG to Redman Gaming of Louisiana, LLC, or to its successors and/or assigns, which said transfer of title must be completed and filed of public record in the conveyance records for the Parish of Jefferson, State of Louisiana within 90 days from the effective date of this ordinance; and
WHEREAS, the Planning Director of this Parish has caused to be duly advertised as prescribed by law, a public hearing in connection with the resubdivision of said parcels; and
WHEREAS, a public hearing was held by the Planning Advisory Board, in accordance with the law; NOW THEREFORE,
THE JEFFERSON PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the Preliminary Plat of Landmark Surveying, Inc. dated October 28, 2008, Revision 5, dated May 5, 2009, showing the resubdivision of the Remaining PT. of Original Lot E-2 Wiegand Tract and the Remainder of Parcel C, Section 3, Township 13 South, Range 23 East, Jefferson Parish, Louisiana, into Parcel RG, Parcel E-3 and Parcel E-4, Section 3, Township 13 South, Range 23 East, Jefferson Parish, Louisiana in accordance with said plan, is hereby approved and accepted.
SECTION II. That the Final Plat of Landmark Surveying, Inc. dated October 28, 2008, Revision 5, dated May 5, 2009 showing the resubdivision of the Remaining PT. of Original Lot E-2 Wiegand Tract and the Remainder of Parcel C, Section 3, Township 13 South, Range 23 East, Jefferson Parish, Louisiana, into Parcel RG, Parcel E-3, and Parcel E-4, Section 3, Township 13 South, Range 23 East, Jefferson Parish, Louisiana in accordance with said plan, is hereby approved and accepted.
SECTION III. That the Parish of Jefferson hereby accepts the dedication and quitclaim of Parcel E-4 as a drainage parcel, which parcel shall be exempt from legal frontage.
SECTION IV. That the Parish of Jefferson hereby accepts the dedication of drainage servitude on the northern side of Parcel E-4, to extend northerly 35’ feet from the top of bank from the railroad ditch.
SECTION V. That Riverbend Associates, a Louisiana Partnership in Commendam and Francis A. Quinette Realty Co., Inc. will execute a development agreement in favor of Jefferson Parish guaranteeing the installation of public improvements and is hereby made a part of this ordinance.
SECTION VI. That the Parish of Jefferson has not examined or reviewed the title of any portion of land shown, or any restrictive covenants or restrictions placed on said property, and that the action of the Parish in this matter does not imply (1) that the applicant's or owner's title or ownership is valid, (2) that there are or are not any restrictive covenants or other restrictions on said property, or (3) that any restrictive covenants or restrictions that may be on said property are enforceable or are not enforceable..
SECTION VII. That the Chairman of the Parish Council of Jefferson Parish, or in his absence the Vice Chairman, is hereby authorized, empowered, and directed to sign all documents and acts necessary and proper in the premises to give full force and effect to this ordinance.
This ordinance has been submitted to a vote, the vote thereon was as follows:

This ordinance was declared to be adopted on the 12th day of August, 2009, and shall be come effective as follows, if signed forthwith by the Parish President, ten (10) days after adoption; thereafter, upon the signature by the Parish President, or, if not signed by the Parish President, upon expiration of the time for ordinances to be considered finally adopted without the signature of the Parish President, as provided in Section 2.07 of the Charter. If vetoed by the Parish President and subsequently approved by the Council, this ordinance shall become effective on the day of such subsequent approval.
