This Lease Agreement dated ______by and between Effinger Properties, LLC, as Lessor, and, as Lessee,______, for use of The Dogwood Room in The Corner @ Rock Creek for the following activity or event: ______.

The following conditions apply:

1. The Dogwood Room will be reserved on this date ______for the following times: ______.

2. The number of people expected for this event is ______. Please note that the maximum occupancy for The Dogwood Room is 250 people by order of the New Kent County Fire Department.

3. The Security Deposit for The Dogwood Room is $250 and is due at the time the room is reserved. The Lease Fee for reserving the Dogwood Room for the above date and time is ______. The Lease Fee is due at least two (2) weeks before the event. Payment can be in the form of a cashier’s check, cash, money order, personal check, or business check. Personal and business checks cannot be accepted if payment is made fewer than two weeks before the event. Please make checks payable to Effinger Properties, LLC.

4. If this Lease is cancelled by Lessee at any time after the date of the signing of this lease, then the security deposit and the lease fee shall be forfeited by the Lessee. In the event of default of payment of lease charges by the Lessee, the Lessee agrees to pay the reasonable cost of collection of same, including 100% of attorney’s fees.

5. The Lessor agrees to furnish folding chairs and tables. The Lessee may use the kitchen equipment but is responsible to see that all equipment is cleaned and undamaged. If decorations are used, the Lessor requires that only fireproof materials be used with the exception of fresh greenery and nothing is applied to the walls, doorframes, windows, window frames or ceiling (e.g. no thumbtacks, glue, tape or adhesives). Lessee will be responsible for seeing that water and lights are turned off upon departure from the facility, all furniture and equipment are back in place, all decorations are removed, all doors are closed, and all trash is placed in the dumpsters in the parking lot.

6. The Lessee assumes the full responsibility for any person attending the function as its guest, patron or service personnel who willfully or negligently destroys or damages the Lessor’s facilities, building, adjacent grounds, or equipment. The Lessee, by the Agreement, accepts full and absolute responsibility for its guests, patrons, service personnel while on the premises, further agreeing to save the Lessor harmless for any and all claims made against the Lessor by the Lessee, its guests, patrons or service personnel.

7. The Lessee agrees to be responsible for any and all damage incurred while the premises are being used under the terms of this lease. This provision shall apply to damage to the building, room, adjacent grounds and equipment therein. The Lessee further agrees to be responsible for any loss, damage or breakage of equipment, furniture and of fixtures on the premises. Under this provision, the owner shall be responsible for determining the replacement or repair cost and the Lessee agrees to pay this cost within 30 days after the Lessee receives written notice.

8. The Lessee assumes full responsibility for the service of alcoholic beverages to guests or patrons while on the premises, including but not limited to obtaining any necessary licenses or permits, further warranting that it will not permit persons under age or otherwise not permitted by law to consume alcoholic beverages. If above licenses are required they are to be turned in one week prior to the rental to the Lessor by the Lessee. Is an ABC License required for this activity? ______. If yes, license number: ______.
