O R D E R

The Delhi Medical Council through its Executive Committee examined a representation from SHO, Police Station, Madhu Vihar Delhi, seeking medical opinion on a complaint of Shri Pawan Kumar Shrivastava, r/o- House No. 1906, First Floor, MS Flats, Timarpur, Delhi-110054, alleging medical negligence on the part of Dr. Girish Rajpal and Max Balaji Hospital, Patparganj, Delhi, in the treatment administered to complainant’s Brother in law Shri. Rahul Saxena, resulting in her death on 25.01.2017.

The Order of the Executive Committee dated 08th June, 2018 is reproduced herein-below:

“The Executive Committee of the Delhi Medical Council examined a representation from SHO, Police Station, Madhu Vihar Delhi, seeking medical opinion on a complaint of Shri. Pawan Kumar Shrivastava, r/o- House No. 1906, First Floor, MS Flats, Timarpur, Delhi-110054,(referred hereinafter as the complainant) alleging medical negligence on the part of Dr. Girish Rajpal and Max Balaji Hospital, Patparganj, Delhi,(referred hereinafter as the said Hospital) in the treatment administered to complainant’s Brother in law Shri. Rahul Saxena, resulting in his death on 25.01.2017.

The Executive Committee perused the representation from Police, copy of complaint of Shri. Pawan Kumar, Post Mortem Report No. 105/17 dated 28.01.2017, copy of medical records of Max Super Specialty Hospital and other documents on record.

The Executive Committee observes that the patient late Rahul Saxena was admitted on 22nd January , 2017 at Max Balaji Hospital with history of sudden onset of headache along with vomiting and giddiness. He was diagnosed as a case of sub-arachnoid hemorrhage due to aneurysm in Left ICA (Internal Carotid Artery). Patient was conscious at the time of admission with G.C.S 15/15. His vitals were stable. He underwent coiling of aneurysm and was operated on 23rd January, 2017 after obtaining informed consent. Prior to admission for surgery patient was admitted in Sant Parmanand Hospital from where he was transferred to a highercentre. Post operative he was sent for elective ventilator. He deteriorated thereafter and subsequently died on 25th January, 2017 at 03:56 pm. We are of the view that the patient being a case of sub-arachnoid hemorrhage suffered from high risk of mortality. He was treated with standard method of treatment, but did not survive due to inherent disease condition which carried high mortality. Further the post mortem findings are consistent with the observations of disease condition.

In view of the observation made hereinabove, it is, therefore, the decision of the Executive Committee that late Shri. Rahul Saxena was treated as per accepted professional practices in such cases and primafacie no case of medical negligence is made out on the part of Dr. Girish Rajpal and Max Balaji Hospital, Patparganj, Delhi, in the treatment administered to the complainant’s Brother in law late Rahul Saxena.

Matter stands disposed.”
