AN ORDINANCE OF WEBER COUNTY AMENDING THE OVERNIGHT WATERCRAFT USE ORDINANCE FOR PINEVIEW RESERVOIR

WHEREAS,the Board of County Commissioners of Weber County amended this ordinance in 2016 to regulate watercraft use on the reservoir between the hours of 10:00 p.m. and 6:00 a.m.; and

WHEREAS,the revised ordinance required an overnight anchor permit for watercraft that anchor or tie up to a watercraft that is anchored between 10:00 p.m. and 6:00 a.m. and specified a cost of $15 per night; and

WHEREAS,the Board of County Commissioners finds that it would be beneficial to make an annual overnight anchor permit available for those who frequently anchor at night on the reservoir; and

WHEREAS,the cost for overnight anchor permits will be available for those who frequently anchor at night on the reservoir; and

NOW THEREFORE, the Board of County Commissioners of Weber County amends the Overnight Watercraft Use ordinance as follows:

Title 26, Chapter 3, Section 3, shall be amended as follows:

Sec. 26-3-3. –Overnight watercraft use.

(1)Between the hours of 10:00 p.m. and 6:00 a.m. Mountain Daylight Time, all watercraft with overnight occupants shall be docked in a paid slip, beached at Anderson Cove Campground, or be anchored 20 feet from the shoreline.

(2)Watercraft that anchor, or tie up to a watercraft that is anchored, between the hours of 10:00 p.m. and 6:00 a.m. Mountain Daylight Time must clearly display an overnight anchor permit on the right side of the boat.

(3)The overnight anchor permit shall designate: (a) the dates that the watercraft is authorized to anchor overnight, (b) the name of the individual who purchased the permit, and (c) the hull identification number of the watercraft.

(4)Overnight anchor permits may be purchased for $15 per night at the boat ramps. The cost for an overnight anchor permit will be determined by the board of county commissioners and will be included in the county fee schedule at Title 16, Chapter 2, Section 8.

(5)Boaters who are cited for violating county ordinances, State laws, or Federal laws or who violate the terms and conditions of the overnight anchor permit may have their permit revoked and be required to vacate the reservoir. If a permit is revoked for a particular watercraft or a particular individual on more than one occasion, that watercraft or that individual shall be denied future requests for overnight anchor permits.

This Ordinance shall be effective 15 days after publication of a synopsis in the Standard Examiner.
