Subject:NOTIFICATION – RBGC - ERRA
1.In pursuance of Rule 48 of Public Procurement Rules 2004, the competent authority is pleased to constitute Redressal of Bidders’ Grievances Committee (RBGC) of ERRA, a procuring agency, to address the complaints of bidders that may occur prior to entry into force of the procurement contract.
2. Composition of the said committee is given below:
a) Director General Finance/ holding portfolio of Chairman
Legal Wing)
b)Director General (M&E), ERRA Member
c)Director General Concerned Sector Member
d)Senior Advisor (P&CM), ERRA/UNDP Co-opted Member
e)Program Manager/Director Concerned Secretary/ Member
3.Any bidder (of ERRA and its sub-procuring agencies including SERRA, PERRA, DRUs, Engineering Wings, Projects, relevant Departments/ Agencies and others) feeling aggrieved by an act of the procuring/sub-procuring agency, after the submission of his bid, may lodge a written complaint concerning his grievances to relevant Program Manager of ERRA not later than fifteen days after the announcement of the bid evaluation report under Rule 35 of the Public Procurement Rules.
4.The committee shall investigate and decide upon the complaint, and announce the decision to the bidder and others concerned, within fifteen days of the receipt of the complaint.
5.Mere fact of lodging of a complaint shall not warrant suspension of the procurement process.
6.Any bidder not satisfied with the decision of the committee may lodge an appeal in the relevant court of jurisdiction.

7.The Chairman of the committee shall present monthly report of the decisions to the Deputy Chairman, ERRA by 7th day of the subsequent month. First of such reports shall be submitted by 7thApril, 2010.
