Notes for applicants for a Taxi or Private Hire Car Licence

General
The 1982 Act provides for the Licensing of taxis and private hire cars. A taxi is defined as a hire car which is engaged by arrangements made in a public place between the persons to be conveyed in it (or a person acting on his behalf) and its driver for a journey beginning there and then.
A private hire car is defined as a hire car other than a taxi.
A hire car is defined as a motor vehicle with a driver which is a view to profit available for hire by the public for personal conveyance.
Exemptions from Licensing
The following types of vehicles are specifically exempted from the provisions of the Act:-
(a) vehicles used for a “to and from” journey
hired outside the area of the District.
(b) vehicles while being used in connection
with a funeral or wedding.
(c) vehicles hired for more than 24 hours on a
contract basis.
An application Form lodged does not allow a person to operate until the Licence is granted and issued.
How to apply for a Licence
Application forms are available from this office.
The Licence itself may be held in the name of a firm or company (i.e. non natural person) or in the name of an individual. Please make sure that you complete the correct form or the correct section of the form. Please also make sure that you complete every part of the form, including any convictions against you, e.g., road traffic offences should be included. / When your application is lodged and the appropriate fee has been paid, a copy of the form will be sent automatically by this office to the Police. They will carry out their own investigations and inspections and report directly to this office. if the Council feels that any other inquiries should be carried out, you will be told of the nature of these inquiries and that the results of these enquiries may be taken into account in coming to a decision on your application.
If objections are lodged you will be sent a copy of the letter or letters of objection and an opportunity will be given to you to give your views in writing on such objection(s). Your application, the letter(s) of objection and your response will then be referred to the appropriate Committee. You may be called to a hearing before the Committee.
You can check on the dates of the Committee meetings at this office.
Your application must be considered within THREE MONTHS of its being lodged and the Council must reach a decision on it within SIX MONTHS.
If your application is granted you will be notified accordingly and asked to present your vehicle for inspection to the testing station. A separate information sheet is attached to these notes with details requirements for passing the inspection and what other documents are required to be produced to this office before your licence will be issued. Once all requirements have been met you will be asked to pick up your licence which will last for ONE YEAR and you will be reminded when your licence is due for renewal at the end of that time. You will also receive notification of the conditions which attach to the licence.
If your application is refused, or granted conditionally, you are entitled to ask the Council within 28 days to give reasons for such refusal, or the imposition of such conditions and thereafter you are entitled to appeal to the Sheriff against to the decision on various grounds. You should seek the advice of a Solicitor if matters should get to that stage.

PRIVATE HIRE VEHICLE SPECIFICATION

Vehicle Inspection

1. / The holder of the licence is required to present the vehicle to one of the approved Council garages to undergo and pass an annual inspection.
2. / Vehicles when first being licensed by Stirling Council can be no more than five years old from the date of first registration. There is no upper age limit for vehicles after they are licensed.
3. / Vehicles will be subject to frequent testing depending on the age and type of vehicle:
Saloon Car
1-3 yrs old 1 test per year
4-5 yrs old 2 tests per year
6-7 yrs old 3 tests per year
more than 7yrs old 4 tests per year
Wheelchair adapted
1-3 yrs old 1 test per year
4-5 yrs old 2 tests per year
6-8 yrs old 3 tests per year
more than 8yrs old 4 tests per year
Custom Built Vehicles
1-3 yrs old 1 test per year
4-5 yrs old 2 tests per year
6-12 yrs old 3 tests per year
more than 12yrs old 4 tests per year
4. / At the time of application and test the Registration Document, valid Certificate of Insurance and current MOT Certificate (for vehicles over 1 year old) must be presented along with the appropriate fee for the test and plates.

Vehicle Type

The vehicle may be:

1. / A saloon/hatchback/estate type.
2. / Accessible small minibus / MPV type.

Saloon/hatchback/estate cars must comply with the following:

1. / Have not less than 4 doors.
2. / Have engine capacity of at least 1.6cc.
3. / Have a minimum internal width of 1.37 metres.
4. / Be any colour other than white or silver.
5. / Be capable of carrying a minimum of 3 passengers.
6. / Have sufficient boot/luggage space for a folded standard size wheelchair.
7. / Have a fire extinguisher fitted in a suitable fastener readily accessible to the driver (minimum capacity of 1kg of a suitable all purpose fire extinguisher).
8. / A calibrated taximeter may be fitted to a Private Hire Vehicle, if the operator wishes, however, this must be fitted in a position which is approved by the Council.

Saloon/hatchback/estate cars must comply with the following: (Continued)

9. / Have the name of the holder of the licence and licence number on the rear nearside and offside doors, immediately below the window frame and on the inside of the vehicle, in a position clearly visible to passengers in letters a maximum of 25mm in height, and in contrasting colour from the vehicle.
10. / The appropriate fee for each garage must be paid.

Small Minibus/MPV must comply with the following:

1. / Have not less than 4 doors.
2. / Have engine capacity of at least 1.6cc.
3. / Have a minimum internal width of 1.37 metres.
4. / Be any colour other than white or silver/light metallic grey in colour.
5. / Sufficient space must be available for passengers luggage.
6. / Be capable of carrying a minimum of 3 and a maximum of 8 passengers with transverse seats in an approved layout.
7. / Have a fire extinguisher fitted in a suitable fastener readily accessible to the driver (minimum capacity of 1kg of a suitable all purpose fire extinguisher).
8. / A calibrated taximeter may be fitted to a Private Hire Vehicle, if the operator wishes, however, this must be fitted in a position which is approved by the Council.
9. / Have the name of the holder of the licence and licence number on the rear nearside and offside doors, immediately below the window frame and on the inside of the vehicle, in a position clearly visible to passengers in letters a maximum of 25mm in height, and in contrasting colour from the vehicle.
10. / All wheelchair accessible vehicles should be fitted and comply with all relevant legislation and Department of Transport and the Environment guidance.
11. / The appropriate fee for each garage must be paid.

Condition of Vehicles

The holder of the licence shall ensure that the vehicle, including all bodywork, upholstery and fittings, is maintained in a safe and serviceable condition, and subject to prevailing road conditions, is kept clean and tidy both internally and externally.

Display of Plates and Signs

The holder of the licence shall ensure that while the vehicle is in use as a Private Hire Vehicle, any licence and fare plates issued by the Council are displayed.

Private Hire Test Certificate

Once the vehicle has passed on all points, the approved garage will send a completed Test Certificate to the Licensing Section and the Private Hire Car Licence will be issued.
