UTA Retirees Club Minutes for September 10, 2013

ANNOUNCEMENTS

Frank Gault, President, welcomed everyone and announced that HR has provided UTA Retirees Club T-shirts for everyone as well as a postcard listing the meeting times and programs for this year. HR also provided name badges for the officers. Frank spoke briefly about Lt. Gen. Rick Lynch, speaker for the October luncheon. Frank introduced the current officers and asked Bob Wegner, VP for Programs, to speak about the upcoming programs. Larry Barcroft, VP for Membership, announced that the Arlington Historical Society will host the Front Street Festival on Sept. 28, 2013 and encouraged everyone to attend. Josie O’Quinn, Past President, spoke about the parking areas available and that the end door is open during our meeting times. Gerrye Frantz passed out the 23 page hand-out and Rosanne Minyard, Secretary, announced that copies would be provided for those who asked.

PROGRAM

Harley Courtney introduced our speaker, Lisa H. Jamieson. Ms. Jamieson has 25 years’ experience as an attorney and CPA. She is also board certified in estate planning and probate. The program topic, “Planning for Death and Incapacity”, explored the forms needed to protect your estate and family.

Statutory Durable Power of Attorney (for financial purposes) was enacted in 1993 by the Texas Legislature and must be in the form set forth in the statute (p.11of handout). Since it is widely accepted, it is recommended over the Durable General Power of Attorney. Your Power of Attorney must be recorded to sell property.

Medical Power of Attorneydesignates your health care agent. Make multiple copies and have it with you (page 16-18 of handout).

Directive to Physicians (Living Will) allows you to give specific instructions and supersedes the Medical Power of Attorney.

DNR Order – Do Not Resuscitate is for terminal patients.

Designations of Guardian /Living Trusts – create a trust that namesyou as trustee and beneficiary to manage your assets during your lifetime; appoint a successor trustee who will assume management upon your incapacity or death. May cost more to probate but assures privacy of estate.

Will – necessary to direct the disposition of your assets upon death. A handwritten or holographic will is legal in Texas. If children predecease you, you may want to use a Trust instead. Not all wills have to be probated. Assets such as retirement benefits, IRA, annuities which designate a beneficiary are not subject to probate. Keep key documents including electronic passwords in a safety deposit box and carry copies when you travel.

Ms. Jamieson urged everyone to use an attorney and be wary of offers in the mail. She answered questions at the end.
