Copyright
Images taken on or before December 31, 1948 are considered to be in the public domain and are therefore free from copyright restrictions
Images taken on or after January 1, 1949 are covered by the restrictions of the Copyright Act and are protected for a period of 50 years after the death of the creator (the photographer). This means that photographs from this era cannot be reproduced (mechanically, digitally or electronically) without the permission of the copyright holder. It is the responsibility of the client to find and secure this permission.
Images which have been printed or used in the creation of a new work (for example a book or work of art) may have a period of additional copyright protection. Images taken on behalf of the Crown (Government of Canada) have perpetual copyright protection.
The Copyright Act provides that it is not an infringement of copyright to provide a copy for the purposes of research, private study, criticism or news reporting.
Commercial Use
In addition to standard reproduction fees, a Commercial Use fee will be charged on every image obtained for purposes other than research, private study, criticism or news reporting. Some examples of situations where this fee is charged: using images to decorate a store, office or restaurant; advertising (print, video, digital, electronic) or promotions; for use in books, pamphlets, annual reports. Payment of the fee secures for the client one-time only rights to use the image.
Donor restrictions
At the time that records are donated to the Archives, the donor may place access restrictions upon use and reproduction. These may cover any or all of the material; may be for a specific period of time; or may simply limit the use of reproductions. Any restrictions so placed are documented. Archives staff will inform the client if donor restrictions apply.
Use of images
1. The Customer may not reproduce, sell or permit others to reproduce the image.
2. In authorizing the publication of images from the Collection, the Archives does not surrender its own right to publish, or grant permission to others to do so.
3. The Region of Peel must be credited for each image. For example in print material each image should be cited in close proximity to it, or in a special section devoted to the credits. For example, Peel Art Gallery, Museum and Archives, R. K. Cooper Collection, 1992.034. For television, movie, video or other electronic mediums, a single credit to PAMA Archives is acceptable.
One complimentary copy of every publication, regardless of format, in which an archival image supplied by the PAMA Archives appears, must be sent, within 15 days of publication in any format, to PAMA Archives, 9 Wellington St. East, Brampton, Ontario L6W 1Y1

Digital services
The Archives will provide digital files of original images, providing that the original is in stable condition. Our scanner can accommodate documents up to 11” x 17”. Standard scans are 300 dpi TIFF files.
Fees
To protect the integrity of the photographic collections held by the Archives, a fee structure has been developed and approved by Regional Council (see below) all orders must be paid in advance. Taxes will be charged where applicable.
Timing
Reprographic orders are completed on a first-come, first-serve basis: please allow 3 weeks from order date for completion.
Limitations
1) The Archives reserve the right to refuse to copy any record for which the copying process will be harmful.
2) Where the Archives is able to provide a digital image, the use of personal cameras in NOT PERMITTED.
3) The use of personal scanners is not permitted in the Reading Room.

Requests for non-standard work (such as oversize documents) will be evaluated on a case by case basis. If work is taken to a commercial facility the client will be charged the actual cost of the work plus a service fee.
