LEHIGHTON 150th Anniversary Celebration Committee

VENDOR RULES & REGULATIONS 2016

1. Hours of Operation & Vendor Selection

The hours of operation for the Festival shall be 5-10 pm Monday-Friday; & 12 noon - 10 pm on Saturdays & Sundays. All concession and display vendors are required to be open for business each day for these hours.

A. All vendors are expected to be courteous and respectful.

B. Vendors will be given preference based on the following factors: I. Vendor ability to supply product or service unique to area. Specify all items to be sold.

II. Vendor ability to supply product or service in theme with the festival.

III. Vendor ability to demonstrate and document effort to fit into theme of the Anniversary

(i.e. - food name, decor, costume, etc.)

IV. First come, first paid, first reserved.

V. The Vendor committee reserves the right to limit the number of food items sold in the space you reserved.

It is not fair to other vendors if you try to put 20 pounds into a 5 pound space.

VI. Other factors as determined by the vendor committee.

C. The Festival reserves the right to conduct periodic inspections for cleanliness and safety & to verify products

sold. Failure to correct problems identified by vendor committee may result in vendor suspension of operation.

2. Site Reservations

A. All vendors who desire consideration for placement at the Festival shall complete a vendor registration form and pay the required vendor fee in the form of a check made payable to the “Lehighton 150th Anniversary Committee” at time of application (unless other arrangements are made with the vendor committee).

B. All vendors must purchase site space adequate to service their clearance needs. Vendors will only be allocated amount of space reserved and purchased.

3. Electrical Service

A. Vendors will be responsible to furnish their own heavy duty exterior use extension cords long enough to plug into electrical supply provided (110V) & will have power service within 150’ of their allocated space.

B. The electrical service is limited to lighting and basic electrical needs.

C. Generators are permitted provided the noise and/or odor generated does not interfere with the operations of

other vendors or the Festival in general as determined by the vendor committee.

D. No electric ranges, ovens, deep fryers, grills or air conditioners are permitted, unless powered and/or fueled by bottled gas or generator to be provided by each vendor. Gas bottles are not permitted inside stands. Vendors must make arrangements for their own delivery and pickup of propane tanks.

E. Electrical service will begin at 12:00 PM on Friday, June 24th and will be terminated by 12:00 PM on Tuesday,

July 5th.

5. Regulatory Requirements

All food vendors are expected to comply with applicable PA Department of Agriculture, Bureau of Food Safety requirements or the local Board of Health and all other state and local rules and regulations.

6. Stand Construction

All stands are to appear attractive and/or in theme with the one of the 4 time periods the Festival is celebrating; 1866-1916-1966 or 2016 & shall be constructed from durable materials. All stands must have the name of the sponsoring organization or business displayed in a visible location.

7. Water Service

Bottled water from approved sources is acceptable. All wastewater must be removed by the vendor for proper disposal elsewhere.

8. Safety Issues

Each stand should be equipped with a first aid kit. Each concession stand must be equipped with a fire extinguisher. Freestanding canopies are suggested for dining areas. If ropes and/or stakes are used to tie down canopies, they must be positioned in such a fashion as not to create a tripping hazard, must be clearly visible and may not encroach walkways. All vendors are required to keep all property within their respective areas hazard free.

9. Housekeeping

All vendors are required to keep their assigned areas clean at all times. This includes serving areas which may be located near respective areas as approved by the vendor committee. All litter should be placed in containers provided. All dining areas should be kept clean. All trash produced by vendors must be stored in the rear of the respective stand or taken to the dumpster provided. Upon closing of the festival at the end of the business day, all trash should be placed in dumpster or areas as designated. Grease or cooking oils must be properly disposed of by the respective vendor and may not be placed in the trash.

10. Security

The Festival will not be responsible for any theft or vandalism of any items or equipment left in your stand overnight. Please remove all money and valuables daily.

11. Support Services -- Bagged ice & Iced Tea products will be available for purchase from Zimmerman’s Dairy at

(610-377-0341).

12. Insurance ***

All vendors are required to provide a current certificate of insurance as a precondition to reserving space at the Festival. This certificate must be attached to the vendor registration application naming the “Lehighton 150th Anniversary Committee” & the “Borough of Lehighton”as an additionally insured.

13. Plastic Bottles Required -- Glass Bottles Prohibited.

A variety of safety concerns have prompted the vendor committee to prohibit the use and/or sale of glass bottles at the Festival. All beverage containers for vendor or patron use or sale must be plastic or aluminum -- NO EXCEPTIONS!

14. Refund Requests

Refund requests will not be honored after June 1st. All refund requests must be in writing and directed to the vendor committee. Refund requests will be honored less a 25% processing and handling charge. Otherwise, fees are nonrefundable.

15. Set Up & Tear Down

Set up and tear down should occur during or near the same hours as electrical service. Vendors may begin setting up on Thursday afternoon. All vendors must vacate the premises no later than 6:00 PM Sunday.

16. Hold Harmless

The Lehighton 150th Anniversary Committee assumes no responsibility for accidents to any person, property, loss or damage done by the vendor or by his/her or its employees or agents, not to such holder, his employees or agents by water, fire, theft, storm, utility failures, acts of terrorism, or third parties or any other causes, both they and their property being on the grounds of the festival entirely at their own risk and such holders or their employees or agents agree to indemnify the Lehighton 150th Anniversary Committee or any of their committees or volunteers against all legal or other proceedings with regards thereto.

17. Misc.

A. All vendors are encouraged to make a contribution to the Fire Co. Chinese Auction.

B. Upon arrival, vendor space will be assigned, first come-first served.

C. All trailers will be assigned space on a street. No trailers in the park, unless approved by the vendor committee!

D. Dining Areas – The vendor committee encourages all food vendors to set up seating areas in close

proximity to their designated area. The location of this dining area must be approved by the vendor

committee. There is no additional charge to set up a dining area.
