ELECTION FORM
Rider POG – Parallel Operation of Retail Customer Generating Facilities
This Parallel Operation of Retail Customer Generating Facilities Election Form (the “Election Form”), dated as of (the “Effective Date”), is submitted to Commonwealth Edison Company (the “Company”) by (the “Retail Customer”) for the premises occupied and used by the Retail Customer at (service address), Illinois (the “Premises”).
RECITAL
The Retail Customer is aware of the options available to it to deliver or sell output from its electric generation facilities and has elected to provide electricity generated by its facilities to the Company under the terms of Rider POG - Parallel Operation of Retail Customer Generating Facilities, as such rider may be amended from time to time, (“Rider POG”).
ELECTION
NOW, THEREFORE, the Retail Customer elects to deliver to the Company electricity generated by its facilities located at the Premises in accordance with the one, and only one, option checked of the following options of Rider POG, and be subject to the other applicable rates, terms, and conditions, of such rider;
Option A
The Retail Customer delivers the entire gross output of its electric generating facilities to the electric delivery system located in the Company’s service territory.
Option B
The Retail Customer uses the gross output of its electric generating facilities to provide a portion of its electric power and energy requirements. For a situation in which the gross output of such electric generating facilities exceeds the Retail Customer’s electric power and energy requirements, such Retail Customer delivers the net output of such electric generating facilities to the electric delivery system located in the Company’s service territory.
Option C
The Retail Customer sells the entire gross output of its electric generating facilities to the Company. In electing Option C, the Retail Customer hereby attests that it is properly certified as a Qualifying Facility (“QF”) under the Public Utilities Regulatory Policies Act of 1978 (“PURPA”) and that it meets the necessary eligibility requirements to elect Option C. In electing Option C, the Retail Customer further elects (Fixed or LMP) Compensation and also understands that it cannot change its election of Option C or Compensation for at least 12 months after commencing and continuing service hereunder. Notwithstanding the selection of Option C by the Retail Customer, should the Retail Customer become ineligible to sell the gross output of its electric generating facilities to the Company, service under Option A becomes applicable to the Retail Customer effective on the date of such ineligibility.
Option D
The Retail Customer uses the gross output of its electric generating facilities to provide a portion of its electric power and energy requirements. For a situation in which the gross output of such electric generating facilities exceeds the Retail Customer’s electric power and energy requirements, such Retail Customer sells the net output of the electric generating facilities to the Company. In electing Option D, the Retail Customer hereby attests that it is properly certified as a QF under the PURPA and that it meets the necessary eligibility requirements to elect Option D. In electing Option D, the Retail Customer further elects (Fixed or LMP) Compensation and also understands that it cannot change its election of Option D or Compensation for at least 12 months after commencing and continuing service hereunder. Notwithstanding the selection of Option D by the Retail Customer, should the Retail Customer become ineligible to sell the net output of its electric generating facilities to the Company, service under Option B becomes applicable to the Retail Customer effective on the date of such ineligibility.
The Retail Customer also understands that it has choices other than Rider POG for the sale of electricity from its generating facilities, including alternatives that may allow for the sale of electricity at market prices and/or to parties other than the Company. The Retail Customer represents that it has chosen to take service under Rider POG and has selected the checked service Option under RiderPOG voluntarily after full consideration of its alternatives. The Retail Customer represents that it has read and understands RiderPOG and acknowledges the potential benefits and risks associated with its voluntary choices. If the Retail Customer is selling the output of its generating facilities to the Company under Option C or Option D, and the Retail Customer decides to terminate service under Option C or Option D in order to sell its electricity output in the wholesale market, service becomes applicable to the Retail Customer under Option A (if the Retail Customer had been taking service under Option C) or Option B (if the Retail Customer had been taking service under Option D), effective with the date of such termination.
The Retail Customer further represents that it is not now providing electricity to any other retail customer and will not provide electricity to any other retail customer, and will not resell or redistribute electricity supplied or delivered by the Company in violation of the provisions in the Resale or Redistribution section of the Retail Customer Categorizations part of the General Terms and Conditions of the Company’s Schedule of Rates.
