RESOLVED: (1) THAT the Director of Corporate Services be authorised to enter into a legal agreement under section 106 of the Town and Country Planning Act 1990 to secure the following:
(i) the provision of a 300 square metre toddlers play area and a skate boarding facility within the adjacent park subject to specification to be agreed in writing with the Director of Development Services;
(ii) the marking out of the car park at the rear of the pavilion to a specification to be agreed in writing with the Director of Development Services;
(iii) a commuted sum not to exceed £45,000 to be used for the management and maintenance of the toddlers play area and skate boarding facility.
(2) THAT the applicant be informed that the Council is minded to grant planning permission subject to the conditions as detailed in the report now submitted, an additional condition requesting the erection of a 1.8 metre high closed boarded fence on the boundary of Roughlee Avenue and Carden Avenue, and on completion of such legal agreement.
(3) THAT authority be given for the decision notice relating to the application to be issued (subject to the conditions and reasons as detailed in the report now submitted and an additional condition requesting the erection of a 1.8 metre high closed boarded fence on the boundary of Roughlee Avenue and Carden Avenue) on completion of the abovementioned agreement.
