Facility Event Rental Agreement
Agreement by and between Sugar Bush Farm hereinafter called SBF, and ______of
______(organization), hereinafter called the Renter.
For and in consideration of a rental fee described below, and other required stipulation
hereinafter made, SBF hereby authorizes and permits occupancy and use of the premises at 760 East Road, Stephentown, NY, 12168, (hereinafter called the premises) for purposes generally understood to consist of dog training and showing (hereinafter called the Event). The Renter hereby agrees to remit the rental fee and to be held responsible for any and all damage to property and premises and/or injury to persons, whether damage or injury is caused by the Renter or any of his, her, and/or its officers, agents, representatives, assigns, guests, employees, or other persons (hereinafter called the Participants) admitted by the Renter to the premises, and to comply with the following stipulated requirements. Renter shall hold SBF harmless from any and all claims of damages, including attorney’s fees and the cost of defense.

2. Rental Fee:
SBF and the Renter agree on a rental fee of $______
for use of the SBF training area. Unless otherwise specified in this agreement, the business office is not considered a part of the training area. Rental fee includes use of SBF equipment, utilities (lights, restroom, fans) and available parking. Renter agrees to remit full payment prior to the beginning of the Event.

3. Security Deposit:
A $100 security deposit is required to hold a reservation for the Event. This security deposit is fully refundable up to 30 days prior to beginning date of the Event, if the Renter provides SBF with written notice of intent to cancel, addressed to 760 East Road, Stephentown, NY, 12168. The $100 security deposit will be returned to the Renter at the end of the Event as long as no equipment is damaged and the site is clean (see Cleanup and Damage below).
4. Cleanup and Damage:
Renters are expected to leave the premises as clean as and in the same condition as they
found them, and all equipment should be left in the condition that it was found. The
Renter will be charged a $70 cleaning fee, to be withheld from the security deposit, if the
facility is not left in the same condition it was found. Renter’s clean-up responsibility
includes outside pickup after dogs. It will be the responsibility of the Renter to report
and pay for all damaged equipment. However, damage caused by normal wear-and-tear is
not the responsibility of the Renter. In the event that the security deposit is inadequate to
cover cost of damage or cleaning as stipulated herein, Renter agrees to pay additional
costs.
5. Damage to or Loss of Property Belonging to Renter and Participants:
During the course of the Event, SBF is not responsible for damage to or loss of property
owned by Renter and Participants while on the premises and adjacent areas. Renter and
Participants are responsible for taking prudent steps to safeguard their personal property
during the Event.
6. Humane Treatment of Dogs:
SBF is a positive training business, and any use of the facility by a Renter that is inhumane to dogs damages SBF’s ongoing business reputation. Therefore, the practices of hanging, kicking, beating and all similar procedures that cause a dog pain, distress and
imminent potential for physical harm (including but not limited to the use of shock collars) are strictly prohibited. Persons employing these training methods should not rent
or use SBF facilities. SBF management will ban from the premises anyone that we determine, in our sole discretion, to be engaged in such practices. Renter will be assessed
a $50 fine for each occurrence on the premises, and SBF will remit the entirety of such fines to the Humane Society of the United States. Renter (and Participants) assessed fines for inhumane treatment of dogs will be banned from the premises until fines are paid and inhumane treatment ceases. Participants with two occurrences of inhumane treatment will be banned from the premises permanently.
7. SBF House Rules:
Renter and Participants agree to observe the following house rules:
7.1 AGGRESSIVE DOGS: To foster a safe environment, aggressive dogs that are not controlled or controllable will be banned from the premises at the sole discretion of SBF management and associated instructors. If a Participant’s dog tends to be aggressive, he/she is responsible for notifying others and taking all prudent steps to prevent an incident, including voluntarily leaving the premises.
7.2 DOGS ON LEASH: All dogs must remain on leash when on the premises or within
the adjoining parking area, unless working within a designated training or showing area.
7.3 DOG EXERCISE AREA: Dogs are to be exercised on the grassy area to the north of
the parking lot and building. DO NOT USE THE AREA ABOVE THE BUILDING, STAY BELOW THE BUILDING.
7.4 PICKING UP WASTE: Owners must pick up after their dogs (an outdoor waste can,
a scoop, and a flashlight are available). Failure to do so jeopardizes SBF’s ability to
continue conducting business, so violators will be banned from the premises.
7.5 DOG HEALTH: To provide a safe environment, dogs brought on the premises must be healthy and current in their vaccinations. Owners must provide SBF with proof of current vaccinations and negative stool checks upon request
7.6 DEPENDENTS: Anyone aged 8-17 participating in an Event must have a parent or
responsible adult in attendance at all times. Disabled dependents and children under
8 years of age must be accompanied by a responsible non-participating adult. NO CHILDREN (OF ANY AGE) OR DISABLED DEPENDENTS ARE ALLOWED TO PLAY OR LOITER IN THE AREAS OUTSIDE OF THE SBF BUILDING.
Patrons who do not supervise the children in their care or who fail to observe these policies will be banned from the premises. If your children or dependents tend to pose a risk to themselves or others, or if their behavior is distracting to others and their dogs, do not bring them to SBF or the adjacent parking area.
7.7 NO SMOKING: Smoking is not allowed within the SBF building (including restrooms). Because of the substantial fire hazard, violators will be banned from the premises.
7.8 PORTAPOTTIES: A portapotty is located near the west entrance of the building.
8. SBF Rights to Inspect Event:
SBF expects that its Renter and Participants will abide by the terms and conditions of this contract, and SBF will assist in making amenities available to our Renter and Participants. SBF, through its officers, employees, volunteers and agents, reserves the right to inspect the Event to ensure compliance with terms and conditions of this contract.
If the provisions of this contract are not met by the Renter, access to the premises will be revoked.
9. Insurance:
Clubs and groups renting the premises should have their own liability insurance for
Events and upon request present same to SBF.
10. Dangerous or Inappropriate Activities:
SBF management reserves the right to prohibit activities that in their sole opinion are deemed to be dangerous or inappropriate to the general public. The Renter agrees to not allow dangerous or inappropriate activities to occur during the course of the Event.
11. Hold Harmless Clause:
It is fully understood and agreed by the parties that the Renter guarantees to indemnify and hold harmless SBF, its officers, employees, volunteers and agents, against any and all claims, damages, losses, and suits of any manner which might arise as a result of the covered Event(s) and that the Renter agrees to defend SBF, its officers, employees, volunteers and agents, and indemnify same against any and all expenses incurred in the defense of any suit of any type arising out of the covered Event(s) or any damages, judgments, or decrees which might be awarded against the same in the event that suit should be brought as a result of the covered Event(s) identified.
12. Individual Release and Indemnification Requirement:
Anyone using SBF facilities (including auditors, instructors, and students) must agree to and sign a Release and Indemnification statement, a copy of which is attached hereto.
SBF will provide the Renter with additional copies of this agreement upon request:
Renter agrees to not allow Event Participants or guests access to the premises without agreeing to and signing a Release and Indemnification statement. Renter will present executed Release and Indemnification agreements, as required under this section, to SBF on demand.
13. Assignment:
This agreement may not be assigned or transferred to another Renter without the prior
consent in writing of SBF.
