INTEGRATED HOUSING SCHEME, 2004 FOR BEEDI WORKERS / IRON /

MAGANESE / CHROME ORE MINE WORKERS [ IOMC] AND

LIMESTONE & DOLOMITE MINES WORKERS [LSDM]

1. OBJECTIVE OF THE SCHEME.

The scheme is intended to relieve to some extent the housing shortage among the Beedi IOMC & LSDM workers employed in beedi industry. The scheme envisages grant of single rate of subsidy to all the sections of beedi and mine workers in IOMC / LSDM Mines. Integrated Housing Scheme for Beedi Workers was developed by integrating the Build Your Own House Scheme for Beedi Workers, Housing Scheme for Economically Weaker Section [EWS] for beedi workers and Group Housing Scheme [GHS]

2. LAND

[I] The houses may be constructed by the workers individually or on land possessed by him jointly, severally with other members of his family. Ideally, the plot area should not be less than 60 square yards. However, subsidy may also be granted to the owner of the plot of smaller area / size provided the plinth area of the constructed house is around 20 square meters. In case of economically weaker section, SC and ST who are allotted land by the State Govt. or local bodies, the exclusive ownership of land shall not be insisted upon and plot of smaller area / size can also be considered for grant of subsidy so long as the plinth area of the houses constructed is around 20 sq meters and the standards and specifications laid own in Indira Awas Yojana are broadly followed.

[ii] The houses may also be constructed on land allotted by the State Govt. / Grama sabha. The land allotted by the State Govt. and having leasehold right or not less than 20 years, with further provision for extension of lease will qualify for grant of subsidy.

[iii] The workers who do not have any individual land / plot for construction of tenements / house may decide to form a registered co-op society and obtain requisite land of sufficient size either from the State Govt./ Gramasabha or a Housing Board. There would be no objection to the grant of subsidy to such a society for construction of the houses for it’s members.

[iv] The workers may also avail housing subsidy facilities for the purchase of Multistoried flats constructed by the registered Group Housing Societies, State Govt. Housing Boards, Co-op societies formed by the workers, Private / Individual builders, etc, subject to grant of ownership rights, lease hold rights to the workers, at least for 20 years, with further provision for extension of lease.

3. MODE OF APPLICATION:

The application in the prescribed form for grant of subsidy complete in all respects shall be submitted by the individual beneficiary / group housing society / the State Govts. to the Welfare Commissioner of the region concerned giving full particulars of the land / site and other documentary evidence to prove ownership over the land / plot on which houses are to be constructed for which subsidy is to be utilized. In case of Group Housing Society, the application for subsidy shall also contain the following particulars.

[I] Whether the tenements will be constructed as separate single units or in multistoried buildings;

[ii] The total number of tenements to be constructed;

[iii] Estimated cost of construction of each tenement.

The application shall be accompanied by the following documents.

[I] The Xerox copy of the certificate or registration of the society by the registrar of co-operative Societies of the state concerned.

[ii] The site plan

[iii] The Blue print of the tenements to be constructed.

[iv] A Xerox copy of the approval of the plan and elevation by the municipal authorities of urban areas or by the Gramsabha or rural areas duly certified as true copy of the Chairman of the Governing body of the Society.

[v] A Xerox copy of the certificate of the local dist. co-op officer about the financial soundness of the society duly certified as a true copy by the Chairman of the governing body of the society.

[vi] A copy of the resolution of the governing body of the society requesting financial assistance under the scheme, duly certified as a true copy by the Chairman of the governing body; And

[vii] An undertaking signed by all members of the society that they shall be jointly and severally liable to repay the amount of subsidy if recoverable along with interest where payable, in the event of default in complying with the provisions of this scheme.

The Welfare Commissioner will scrutinize the application and on being satisfied that the application is in accordance with the scheme, will forward the same to the Ministry along with his recommendations for sanction. Where land is allotted by the State Govt. and houses are to be constructed by that State Govt, a copy of such application with comments of the Welfare Commissioner will also be forwarded by him to the concerned State Govt.

4. SUBSIDY

A subsidy at the uniform rate of Rs. 40,000/- per worker or 50% of the actual cost of the construction per tenement whichever is less, will be payable under the scheme.

Subsidy shall be released in three instalments as under:

I] First instalment [35% of subsidy] / After construction reaches plinth level.
Ii] Second instalment [40% of subsidy] / After construction reaches roof level but before roof is laid.
Iii] Third installment [25% of subsidy] / After completion of construction in all respects.

In case, where the construction is done by the State Govt. the whole amount of subsidy will be released to the concerned State Govt. directly when the houses are completed upto the roof level. The remaining finances in that case could be raised by the workers either by loan / contribution from the State Govt. or any other agencies like HUDCO nominated by the State Govt. For repayment of the said loan, the State Govt. or the agencies like the State Housing Board set up by the State Govt. shall be wholly responsible. However, then construction is done by the workers on the land, even if it is provided by the State Govt. subsidy will be directly released to the beneficiaries in three instalments.

In case of a ready built flats, full subsidy will be released by the Director General [Labour Welfare] on behalf of the beneficiary [s], to the Management of Housing Board Society/ Group Housing Society, Private or individual builders, after the allotment letter for handing over the possession of the flats, completed in all respects, including facilities like electricity, water, sanitation, sewerage system, street light systems, etc, is issued to the workers. In case so of a flat under construction, the subsidy will be released to the societies, in three instalments, as is admissible to the co-operative Group housing Societies formed by the workers.

5. DATE OF IMPLEMENTATION OF THE SCHEME AND RELEASE OF SUBSIDY

[I] The subsidy at the rate indicated in Para 4 of the Scheme will be applicable to the construction of houses for beedi workers and IOMC and LSDM workers on or after 1st July 2004. Past cases where an instalment of subsidy has already been released but where construction is yet to be completed should not be reopened for the purpose of granting subsidy at the enhanced rates.

[ii] The release of subsidy will be subject to availability of funds for the purpose during the financial year.

6. PLAN, STANDARD, SPECIFICATION AND CONSTRUCTION OF HOUSES.

[I] In case where construction of house is done by the State Govt, the minimum standard of accommodation that would be provided in a tenement under the scheme will consist of one room, a closed area for kitchen, a bathroom and a latrine. The plan of the tenements and specifications to be followed for these tenements shall be worked out by the concerned State Govt. and in case the construction is undertaken by any agency nominated by the State Govt. like State Housing Board, the plan should be got approved by the State Govt. but the specifications chosen will be such as will make the house durable. The estimated life of such tenements should not be less than 20 years.

[ii] The house / flat should provide proper space for room, kitchen, ventilation, sanitary facilities, smokeless chullah, etc. In case of individual house / flat, local material used should be such as are approved by the respective State Govt. for that area for the construction of houses under Indira Awas Yojana. The standard type design will, however, depend on local climatic conditions and beneficiary’s specific requirements. Each house should have a plinths area of around 20 square meters.

However, the above standards are in the nature of minimum and there would be no objection for adoption of better specification and higher standards by individual workers while constructing their own houses under the scheme.

[iii] Where the worker form a Group Housing Society which is registered with the Registrar of co-operative societies of the State concerned, the following provisions have to be followed:

[a] The tenements to be constructed by the society may be separate single units or in multistoried buildings.

[b] The minimum accommodation in tenement shall be one room, a closed area for kitchen, a bathroom and a latrine suited to local conditions. There shall also be provision for drinking water and water for conservancy and sanitation. There shall also be provision for maintaining inter communication roads, lanes and paths. The total covered area of the tenements shall not be less than 160 square feet. The plan and elevation of the tenements and of the multi-storied building shall be approved by the municipal authorities concerned in urban areas and by the Gram Sabha concerned in rural areas.

[c] The tenements shall be constructed in a good, substantial and habitable manner and their life shall not be less than 20 years.

[d] The tenements shall be constructed and completed in all respects within a period of 24 months from the date of execution of the agreement in the prescribed form. The Welfare Commissioner may however, grant extension of the period upto six months in genuine cases.

[e] If the tenements are not constructed and completed in all respects within the period or extended period set out in the above paragraph, the amount of subsidy shall be forfeited and shall be recovered along with interest at 14% per annum from the date of payment made towards subsidy as arrears of land revenue under the Land Revenue Act of the State concerned.

[f] The Inspection Authorities as may be nominated by the Welfare Commissioner, shall inspect the tenements from time to time during their construction as well as after their completion and all facilities shall be given to them by the society to make such inspection. Any instruction given by the Inspecting Authorities shall be duly complied with by the society.

[g] The society shall forthwith insure the tenements with the General Insurance Corporation of India or any of its subsidiaries for a sum not less than the amount of subsidy against loss or damage by fire, flood, lightning and riots. The society shall produce the policy of insurance for inspection as and when required by the Welfare Commissioner

[h] The society duly and punctually pay all revenues, rents, rates, taxes, assessments, present as well as future in respect of the tenements.

[I] It shall be the responsibility of the society to maintain the tenements always in a good and habitable state of repair at its own cost and expenses which however, may be got reimbursed from the allotters.

7. OWNERSHIP OF TENEMENTS:

[I] Where the house is constructed by the State Govt. on land allotted by them it will enter into an agreement with the fund as prescribed. It will also furnish within one month of the close of the financial year in which subsidy is released, the utilization certificate as prescribed. Ownership of such houses finally vests with the beneficiaries i.e. workers. The terms and conditions for agreement to own these houses will be worked out by the State Govt. or the agency nominated by them.

[ii]Where the houses are constructed by the workers themselves on the land owned by workers/ by the State Govt, these shall normally be completed within a period of 18 months. In genuine cases, this period may be extended by the Welfare Commissioners for another 6 months. The ownership of the house shall vest with the worker. He shall execute an agreement in favour of the President of India for the sum of subsidy received by him. He shall also execute any other agreement as prescribed, wherever applicable. Further, he shall provide a surety for the amount of subsidy which shall be signed in favour of the Govt. Where it is not possible to arrange a surety, the applicant shall mortgage the land on which he proposes to construct a house in the prescribed form.

[iii] Where the houses are constructed by Group Housing Society and the inspection authority have issued the completion certificate, the society shall submit to the Welfare Commissioner a proposal for allotment of the tenements to its members. The Welfare Commissioner will thereupon verify the eligibility of the worker members in the light of the provisions of the Scheme and give appropriate directions. Members found by him to be ineligible may be replaced by the society by eligible workers after the Welfare Commissioner has screened them and has approved their enrolment as members of the Society. Following conditions will also have to be satisfied by the Society:

[a]The tenements shall be allotted only to those members who are found eligible by the Welfare Commissioner.

[b] It shall be the responsibility of the Society to ensure that the tenements are properly maintained in a good and habitable state by the allottees.
