ORDINANCE OF THE MARIN COUNTYBOARD OF SUPERVISORS

ESTABLISHINIG THE PRIMA FACIE SPEED LIMIT ON SEMINARY DRIVE, MILL VALLEY

THE BOARD OF SUPERVISORS OF THE COUNTY OF MARIN does hereby ordain as follows:

SECTION I.Pursuant to Section 22358 of the California Vehicle Code, upon the basis of an engineering and traffic survey, local authorities are authorized to reduce the maximum applicable speed limit of 55 miles per hour. An engineering and traffic study has been prepared for Seminary Drive consistent with Section 627 of the California Vehicle Code that identifies recommended maximum speed limits. It is therefore in the interest of public safety that the maximum speed limit on portions ofSeminary Drive be decreased as set forth in Section II.
SECTION II.It is hereby determined and declared that the prima facie speed limit on Seminary Drive shall be as follows:
1.30 miles per hour in both directions between MP 0.00 (Ricardo Road) southerlyto
MP0.60 (Gilbert Drive), and
2.35 miles per hour in both directions between MP 0.60 (Gilbert Drive) southerly andMP 1.37 (Chapel Drive), and
3.Furthermore, Traffic Resolution No. 538 is hereby repealed.
SECTION III.Pursuant to section 22357 of the California Vehicle Code, a local authority may also set a prima facie speed limit of 25 mph on any street adjacent to a children’s playground in a public park, but only during times when children are expected to use the facilities. Two public playgrounds, one with a tot lot and another with a soccer field, are located on Seminary Drive between Ricardo Road and Gilbert Drive. It is therefore in the interest of public safety that the prima facie speed limit on portions of Seminary Drive be established when children are present as set forth in Section IV.
SECTION IV.It is hereby determined and declared that the prima facie speed limit on Seminary Drive shall be as follows:
1.25 miles per hour in both directions when children are present between MP 0.00 (Ricardo Road) southerly and MP 0.60 (Gilbert Drive).
SECTION V.EFFECTIVE DATE, PUBLICATION, AND SEVERABILITY
The Board of Supervisors of the County of Marin does hereby further ordain the following:

1.Effective Date and Publication. This ordinance shall be, and is hereby declared to be, in full force and effect when appropriate signs giving notice thereof are erected upon the street, and the ordinance shall be published once before the expiration of fifteen days after its passage, with the names of the Supervisors voting for and against same, in the Marin Independent Journal,a newspaper of general circulation, published in the County of Marin.

2.Severability. If any term, provision, or portion of this ordinance is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remaining portions of this ordinance shall continue in full force and effect unless amended or modified by the County.
