These are IPS’ procedures for receiving and resolving disputes pertaining to transition of children and youth experiencinghomelessnessasidentifiedundertheMcKinney-VentoHomelessAssistanceActof2001.
TheMcKinney-VentoLiaison:
TheMcKinney-Vento LiaisonoverseesIPS’identificationofhomelessorunaccompanied youth,informs theparentsorguardiansofhomelessyouthandunaccompaniedyouthoftheirrights,assistsinlocatingservicesfor theyouth,andcoordinatesresolutionofdisputesregardingenrollment.
HowtoPresentaDispute
Ifadisputearisesoverschoolselectionorenrollment,theMcKinney-VentoLiaisonneedstobeadvisedof thedisputeonthesamedayit occurs. TheparentorguardianmayadvisetheLiaisonof thedispute. TheIPS representativesinvolvedinenrollingthestudentmustadvisetheLiaisonofthedispute.
WhattheMcKinney-VentoLiaisonWillDo
TheMcKinney-VentoLiaisonwill:
Provideacopyofthisproceduretotheparentorguardianorunaccompaniedyouth;
Assurethechildoryouthisimmediatelyenrolled(grantedtheopportunityfullytoparticipateinschool activities)orgrantedcontinuedenrollmentinthe schoolinwhichhe/sheis seekingenrollmentpending resolutionofthedispute;
AssisttheparentorguardianincompletingtheRequestforDisputeResolutionform;
InformtheparentorguardianoftherighttosubmitwrittenororalinformationtosupportaRequestforDispute
Resolution.
AssisttheIPSenrollingofficialsincompletingtheResponseform;
Gatherotherrelevantinformationfrombothparties;and
SubmittotheIPSDirectorofSpecialEducationaReportrecommendingresolutionofthedisputeandthebasis fortherecommendationandprovidecopiestotheparent/guardian.
Additionally,intheeventofaninter-districtdispute,theMcKinney-VentoLiaisonwillrepresentIPSinthe resolutionofthedisputebytheIndianaDepartmentofEducation.
WhattheDirectorofSpecialEducationWillDo
TheDirectorofSpecialEducationwill:
ReviewtheReportoftheMcKinney-VentoLiaison;
Gatheranyadditionalinformationthatwillassistinresolvingthedispute;
Providetotheparent/guardian,theMcKinney-VentoLiaison,andtheIPSenrollingofficialsaReportofIPS’
finalresolution.
HowtoAppealIPS'FinalDecision
IftheParent/GuardianisnotsatisfiedwithIPS’finalresolution,theParent/GuardianmaychallengeIPS’final decisionbycontactingtheMcKinney-VentoHomelessSupportSpecialistattheIndianaDepartmentofEducation. TheMcKinney-VentoHomelessSupportSpecialistattheIndianaDepartmentofEducationwillanswerquestions regardingtherightsofayouthundertheMcKinney-VentoActandwillconsiderappealsofaschool'sfinaldecision onanenrollmentdisputeinvolvingahomelessorunaccompaniedyouth. TheMcKinney-VentoHomelessSupport SpecialistattheIndianaDepartmentofEducationis:
