UNLV Office of Student Conduct Disciplinary Appeal Form
Students considering an appeal should read the section on “Appeal Rights and Appeal Procedures” in the Student Conduct Code. As noted, “Appeals may be based on only the following grounds.”
1. Denial of process as outlined in the Student Conduct Code: A student or organization who is alleged to have violated the Student Conduct Code is entitled to the following procedural guarantees:
i. The student or organization will be provided with a confirmed notice of charges sufficiently in advance of the administrative meeting or formal hearing and in reasonable detail to allow the student or organization to prepare a case for the informal meeting or hearing.
ii. Students or organizational representatives may remain silent during a hearing.
iii. Students or organizational representatives may choose to refute any information presented or question any witnesses, and will be given an opportunity to present a rebuttal to the charges.
iv. Students or organizational representatives will be give the opportunity to produce witnesses or written affidavits on their own behalf.
v. To help them prepare their response, students or organizational representatives may be assisted by an advisor of their choice. The advisor’s role is specifically limited to conferring with her or his advisee; they may not participate in the actual proceedings. It is the responsibility of the students to notify the Office of Student Conduct at least seven (7) calendar days in advance of the hearing and specify the name and address of the advisor, if any, and whether the advisor is an attorney.
vi. At a hearing, the student or organizational representative may challenge the objectivity of any committee member or administrator, given reasonable cause to believe that the member may be biased or have a conflict of interest.
vii. The outcome of the hearing will be determined solely on the basis of evidence presented during the hearing. This includes, but is not limited to, all information made available to the charged student/organization as part of the hearing file. A determination of responsibility is made on the basis of whether it is more likely than not that the accused student or organization violated the code.
viii. After the hearing, the student or organization may appeal the decision of the hearing officer or committee, provided there are appropriate grounds.
2. Denial of adequate opportunity to prepare and present a defense to the charges;
3. The evidence presented was not sufficiently substantial to justify the decision;
4. The sanction imposed was not in keeping with the gravity of the violation.

To initiate an appeal, you should meet with a member of the Office of Student Conduct to discuss the appeals process. To file an appeal, provide your answers to the following questions to the Office of Student Conduct, 325 Flora Dungan Humanities (2019) by your appeal deadline (late appeals will not be accepted). The decision on whether your appeal will be heard is based solely on the information you submit in your appeal request.
