Authority to Administer the Rehabilitation Act of 1973, As Amended, with the Exception

SUBJECT: Redelegation of Authority

I.  DELEGATION

Under the authority vested in me by a delegation from the Secretary, delegation EA/EH/77, certified on June 3, 1999, I hereby redelegate to you, and to anyone serving for you in an acting capacity, the authority to administer the following provisions of law:

A.  the Rehabilitation Act of 1973 as amended, 29 U.S.C. 701 et seq., with the exceptions of Title II, Title IV, and Sections 501-508 of Title V;

B.  the Helen Keller National Center Act, 29 U.S.C. 1901;

C.  the Randolph-Sheppard Act, as amended, 20 U.S.C. 107 et seq., and

D.  the Assistive Technology Act of 1998, as amended, 29 U.S.C. 3001 et seq.

Unless otherwise noted in future delegations of authority, any amendments to the provisions of law delegated herein are included within the scope of this delegation.

II.  RESERVATIONS

Unless otherwise noted in existing or future delegations of authority, the following are not delegated:

A.  the authority to sign documents for publication in the Federal Register;

B.  the authority to appoint, and fix compensation of, members of advisory councils; and

C.  unless otherwise provided by law, the authority to submit reports to Congress or the President.

III.  REDELEGATION

Subject to applicable provisions of law, and unless otherwise noted, you may redelegate any of the authorities delegated to you. All redelegations must be prepared in accordance with the Administrative Communications System directive, OM:1-102, Delegations of Authority, dated July 26, 2005.

IV.  CERTIFICATION AND EFFECTIVE DATE

This delegation is effective upon certification by the Department’s Principal Delegations Control Officer and supersedes all previous delegations of these authorities, including EH/EHR/84. I hereby ratify actions, within the scope of this delegation, taken by you prior to the date of certification.
