I,______, the renter of the Play N Hooky Golf Cartaccept financial and legal responsibility for all damages, injuries and death that result during the rental period. If the cost exceeds the deposit, I agree to pay for any and all loss or damages to property or person, including, but not limited to injury, death, or damage to any property whatsoever, caused by, arising from, incident to, connected with, growing out of, or related to the use and/or operation of the Play N Hooky Golf Cart during the rental period regardless of fault. I agree to abide by the Play N Hooky Golf Cart Rules.

I agree to indemnify, defend and hold Cason Enterprises, owners, and beneficiaries harmless from and against all claims, suits and liabilities, without limiting the generality of the foregoing, for any and all loss or damages to property or person, including, but not limited to injury, death, or damage to any property whatsoever, caused by, arising from, incident to, connected with, growing out of, or related to the use and/or operation of the Play N Hooky Golf Cart during the rental period regardless of fault.

By my signature below, I certify that I have read and that I understand and agree to the conditions set forth in the PLAY N HOOKY GOLF CART RENTAL AGREEMENT/CONTRACT. I further represent that I am familiar with the operation and use of the golf cart. I acknowledge that I have signed this document voluntarily and freely and that my signature creates a contract that binds me, my guests, and all passengers.

Play N Hooky Golf Cart Rules

Do not drive in any water. The computer, motor and batteries will be destroyed. This will cost you $1000.

Do not drive in soft sand. You will get stuck. Do not attempt to tow the golf cart.

Do not leave the key in the ignition when you are not using the golf cart. Someone will steal it. This will cost you $7000.

Do not drive on PedestrianBeach, Ft. Velasco Road, Hwy 332, or Blue Water Hwy.

Stay between the Jetty and StahlmanPark.

Do not leave the lights on.

Do not drag your feet in the sand or extend your arms or legs outside of the golf cart. Traumatic amputations have occurred due to this type of behavior.

Obey all traffic laws. You can be arrested for DWI while driving a golf cart.

Only licensed drivers may drive the golf cart.

Be back home before the power indicator hits zero. When it starts flashing you can only drive one (1) more mile. When the power goes to zero you are done until the next day.

Charge the golf cart until the LED light is green and not flashing. This usually takes 12-18 hours.

Do not leave the keys in the ignition—leave them in the tray inside the house.

Lock the cart around the leaf spring and the wooden piling using the cables provided.

Do not operate the vehicle with more than two (2) passengers per bench seat.

Do not allow young children to ride in the vehicle without a supervising adult. Children’s feet must be able to touch the floorboard of the vehicle, and they must be able to hold on to the safety handles on the vehicle canopy or restraint.

Under no circumstances should a child-safety seat or booster seat be used.

Passengers in a rear-facing seat must use particular care, since they cannot see the upcoming path of the vehicle or possible approaching hazards. Rear-facing passengers must always hold on to safety handles and keep their feet firmly placed upon the vehicle’s floorboard.

This is not an exhaustive list of safety guidelines and precautions. No list, however lengthy, could ever cover all of the possible operating situations and conditions. Again, no safety feature or rule will replace the old-fashioned common sense of responsible drivers and passengers.
