1. This permit is for a proposed contractor’s service with no outdoor storage to be located within a portion of a building originally occupied by Woods Florist, 9066 Baltimore Avenue. The florist began operating in September 1949 per documentation provided with permit 350-83-U. The property is located within the Central US 1 Corridor DDOZ. The property consists of Lot 1 which is zoned R-55/C-1/DDOZ and Lot 12 which is zoned M-U-I/DDOZ. The property is developed with an existing dwelling which is wholly located in the M-U-I/DDOZ and the old flower shop and greenhouse building which is zoned, R-55/C-1/M-U-I/DDOZ. The C-1/R-55 zoning line on Lot 1 runs through the rear 6-7 foot portion of the building to be occupied by the contractor. Since a contractor’s service is a prohibited use in the R-55/DDOZ, a rezoning of the portion of Lot 1 in where existing building extends will be required in accordance with Section 27-548.26 of the Zoning Ordinance. This process begins by filing of a Detailed Site Plan and the applicant should contact Cheryl Summerlin at 301-952-3578 for information and instructions regarding this process. The following is a zoning history of the property:

1. ZMA 1270 zoned Lot 12 from Residential A to Commercial D on 4/20/49. Lot1 was zoned Residential A.

2. Lot 12 placed in the C-1 Zone, Lot 1 placed in the R-55 Zone 11/29/49.

3. ZMA 2470 rezoned 20 feet of Lot 1 to C-1 on 3/16/55 to allow for the relocation of the buildings due to the relocation of University Lane.

4. Lot 12 rezoned to C-S-C and all of Lot 1 rezoned to R-55 on 5/1/90.

5. Lot 12 rezoned to M-U-I/DDOZ and Lot 1 rezoned to R-55/DDOZ 4/30/2002.

6. Lot 12 retained in M-U-I/DDOZ and Lot 1 retained in the R-55/DDOZ 6/1/2010.

7. GIS zoning map corrected in 2014 to reflect the 20 feet of C-1 Zone on Lot 1.

4/22/16 - Per discussion with Debbie, Matt, and Alan it was determined that the applicant has the option of either rezoning the property through a DSP or pursuing Validation of Permit Issued in Error for permit 350-83-U. Although the site plan did not show the zoning line the rear portion of the florist shop building extended into the R-55 Zone. We will however approve this permit with the understanding that the residentially zoned portion of the building will not be occupied until such time the property is either rezoned or the validation is approved. The zoning line must be shown on the site plan and a floor plan must be submitted showing the portion of the building that will not be used.
