The Monthly Maintenance Contribution of £000 is payable in advance no later than the first day of each month. The payment is towards the upkeep of the dwelling and communal services.

It is a condition of occupancy that you continue to be a person of good character; have limited financial means, and pay the full amount of the Monthly Maintenance Contribution promptly, whether or not the services are used. This figure may be increased by at least one month’s notice in writing to the Resident.

You are responsible for paying the utility bills, water rates, telephone/broadband, and Council Tax.

The Trustees may take such steps as they think proper in the administration of the Trust and for the residents’ welfare. Any alteration to the rules will be notified in writing to each resident. These rules are set out in the Residents’ Handbook and form part of the Letter of Appointment. The following regulations for Residents are to ensure the smooth running of the Almshouses:

1 The Trustees undertake to carry out all repairs, including internal and external decoration. Residents are not allowed to make any structural alterations to the dwellings, nor to alter the plumbing or electrical installation. No shelves, cupboards, locks or fittings shall be fixed or removed, nor shall any alteration be made to any room or its fittings without the prior written consent of the Trustees.

2 Residents must permit reasonable access for inspection of their Almshouses and for repairs and decoration to be carried out as deemed necessary by the Trustees.

3 Residents should keep their Almshouse clean and tidy and avoid storage of excess or unnecessary items. All defects which become apparent should be reported to the Trustees.

4 For reasons of health and safety, the use of paraffin, portable gas and electric radiant heatersis strictly forbidden.

5 Residents must not vacate their dwellings for more than a total of twenty-eight days in any one year without the prior written consent of the Trustees and must inform the Trustees if they will be away for more than a week at a time.

6 The name and address of the next of kin should be supplied to the Trustees, together with information as to whether a Will has been made and, if so, where it is deposited.

7 Residents are required to occupy their property quietly and with thought for other residents and/or neighbours. No radio, TV or music system should be operated in such a manner as to cause a disturbance, nor shall anything be done in, upon or about the premises which shall be a nuisance, annoyance or disturbance to the occupants of other almshouses, adjoining property, or to the general public.

8 Residents may expect to continue in occupation for as long as they need the accommodation, providing they continue to qualify as a beneficiary and are able tolive independently. The Almshouses do not have a warden,nor does the Trust provide personal care. If health deteriorates residents must be willing to accept advice and guidance, either from their own doctor or a medical consultant appointed by the Trustees. The Trustees will also consult with the next of kin, Social Services and other agencies if necessary.

9 Residents should provide the Trustees with authority to contact their doctor and next of kin directly in an emergency by signing the attached form.

10 Pets must not be kept without the prior written consent of the Trustees. Any consent is at the absolute discretion of the Trustees and may be subject to conditions. Consent may be withdrawn if the pet becomes a nuisance or annoyance.

11 Visitors are not permitted to stay in any Almshouse except with the prior consent of the Trustees.

12 Neither the Resident nor any relation or guest of theirs will be a tenant of the charity or have any legal interest intheir Almshouse.

13 The Trustees reserve the right, upon reasonable written notice, to ask a Resident to vacate the dwelling and move, either temporarily or permanently to another Almshouse belonging to the Charity.

14 The Resident’s attention is drawn to the Complaints Procedure set out in the Residents’ Handbook.

15 The Trustees retain the right to set aside (end)this Appointment with good cause by notice in writing, e.g. in the case of serious misconduct, non payment of Monthly Maintenance Contribution, a breach of regulations, if the Resident no longer qualifies as a beneficiary, or becomes a risk to themselves or others.

16 Should a Resident wish to leave their dwelling to live elsewhere, not less than one month’s calendar notice in writing must be given to the Trustees. Maintenance Contributions remain payable until the notice period expires, the dwelling is vacated, cleared of furniture and possessions, and the keys returned to the Trustees.

17 When the Resident vacates the Almshouse for whatever reason, all items belonging to the Resident must be removed by them forthwith. Monthly Maintenance Contributions must be paid up to the departure date, as well as any Service Charges and all utility bills. Should a Resident ask to vacate the dwelling immediately the Monthly Maintenance Contributions must be paid up to the end of the notice period. In the event that possessions and goods are left abandoned by the Resident, the Trustees reserve the right to sell them after a period of three months and out of the proceeds pay any outstanding amounts owing to the Charity, and any other expenses including removal costs.

18 Residents’Appointmentswill be reviewed by the Trustees every 5 years for those over 55 years and every 3 years for those under 55 years.

19 It is the responsibility of the Resident to notify the Trustees if their circumstances change. However, unless your income was to substantially increase to the extent that you no longer qualify as a beneficiary, the likelihood is that you would be allowed to remain in the dwelling. Trustees reserve the right to review Residents’ financial circumstances from time to time. All relevant financial details must be provided by the Resident.

20 Neither the Almshouses nor its gardens or allotments may be used as a place of business, either from where to conduct business or to store items connected with running a business.

21 Any white goods at the Property (other than the boiler/water heater and the electric cooker) will be the responsibility of the Resident.

22 It is a condition of occupancy that a new Resident signs a copy of this Letter of Appointment, signifying their willingness to abide by the above rules before taking up occupation. In the event of an appointment being made to two persons, both must sign the copy Letter. A second copy is enclosed for the Resident’s retention.
