The meeting was called to order by Mayor Davies-Dunhour at 4:30 p.m.

Mayor Davies-Dunhour announced that the meeting was now open. Adequate notice of the meeting was provided by posting a copy of the time and place on the Municipal Clerk’s bulletin board and mailing a copy of same to the Press on January 4, 2017.

Mayor Davies-Dunhour read the following statement:

After the Pledge of Allegiance please stay standing for a moment of silence for the victims of the terrible shooting in Las Vegas. 59 dead, over 500 injured and countless numbers of lives effected forever.

It is so very difficult to make sense of this tragedy. A friend shared this quote from Fred McFeely Rogers (Mr. Rogers) who brought Mr. Rogers’ Neighborhood to all of use for over 30 years.

“When I was a boy and I would see crazy things in the news, my mother would say to me “Look for the helpers. You will always find people who are helping.” Thank you to all the helpers. Every day heroes.

DOCK HEARING Channel Marine Construction – James Majeski – 349 – 89th Street

Frank Bowen, President of Channel Marine Construction Inc. was sworn in by Solicitor Karavan.

Frank Bowen stated he was before Council to get approval for putting in a new pier, ramp and float, approved by DEP at 349 – 89th Street. Taking out the old stuff and building the new. Councilmember Parzych said he can’t read the comments and/or the plan, too small. He asked if they were taking out a fixed pier, floating dock and ramp. It appears the fixed pier going back in is smaller, is that correct? Frank Bowen said that is correct. Councilmember Parzych asked about the floater. Frank Bowen said the floater that is going in is probably a little larger than the old one. It has been approved for an 8 X 24, there was an 8 X 20 there originally. Councilmember Parzych asked the dimensions of the fixed pier. Frank Bowen said 10 X 18. What was there was 25 X 18. They are putting in less.

Mayor asked if there was anyone in the audience to speak for or against the application.

Regular Meeting, October 3, 2017

HEARING OF THE PUBLIC ON MEMORIALS, RESOLUTIONS, PETITIONS & COMPLAINTS

Bob Ashman 10301 First Avenue commented good discussion during the Work Session. He asked who has the responsibility of enforcing our current construction ordinances. Mayor said Construction Office and Police Department. He asked what process is in place to review the performance of the Police and Construction Office on enforcing them, is there any? Mayor said isn’t any right now, but moving forward there will be. Mr. Ashman said that is the key to our problem. Many ordinances on the books that aren’t enforced. Until we get a clear line of enforcement, and what the penalties are for lack of following them are, no matter what we do it won’t work. Until you get a fix on who exactly is responsible, and who measures if they are doing their job, and if not put someone in who will follow them, we will never solve it. If that is not done, we will be talking about this next year at the same time.

Councilmember Kramar said the police department has already addressed these problems. Mayor said enforcement is falling back onto the police department. For several years it was not expected of them. Nobody was not doing their job, or not aware, it was not their responsibility. Mr. Ashman said whoever has the reasonability, it has to be clear. Administrator doesn’t go out and do it, she administrates it. Administrator said it is her responsibility to oversee all department to make sure they are enforcement whatever code is on the books. She has addressed this with several departments and is monitoring it. We have seen an increase in our enforcement of the ordinances and will continue to do that. Mr. Ashman said to tighten up the performance review of whoever is supposed to be doing it, so it doesn’t slip back to how it has eroded.

Councilmember Kramar said we have hundreds of Ordinances. Councilmember Gallagher said each department has to enforce the ones specific to them. She said things have fallen through the cracks, and that is the reason the “no parking” signs are still on her street, nobody has seen that. In her estimation if there are 30 plus construction sites going on right now, we need to give our construction man a bicycle and tell him to ride around town, he could see them all in the morning.

Councilmember Lane said she thinks there is a different philosophy now, we have a change of administration, as far as the Mayor and whole new philosophy with new Police Chief on how these issues are dealt with. The tenor of everything has changed. Now you will start to see the results.

Dr. Walter Finken - 162 – 94th Street reported the NW corner of 96th and Third, bicycles tied up there for 3 years. He has gone to the Police, wonders why they are still there. It is a hazard, they are rusted, locks are no good, could the police go and get rid of them.

Said he like to fix thing up and said when we have bulk trash days he puts things out so people can use them. There is an ordinance that says you can’t do that unless you knock and ask the person. Some things are good and people can use them. He looked at a fishing rod, that he could have fixed and was stopped by the Police and told unless he knocks on the door he can’t take anything. PW Director said we set up our bulk days when the MUA takes the bulk for free. Problem is scrappers that come to town and take the metal materials that we would get credit for. Also issues with people coming into town during bulk time and stealing from residents. It needs to be controlled.

RESOLUTION AUTHORIZING THE ISSUANCE OF NOT EXCEEDING $29,250,000 BOND ANTICIPATION NOTES OF THE BOROUGH OF STONE HARBOR, IN THE COUNTY OF CAPE MAY, NEW JERSEY.

BE IT RESOLVED BY THE BOROUGH COUNCIL OF THE BOROUGH OF STONE HARBOR, IN THE COUNTY OF CAPE MAY, NEW JERSEY, AS FOLLOWS:

Pursuant to a bond ordinance of the Borough of Stone Harbor, in the County of Cape May (the “Borough”) entitled: “Bond ordinance appropriating $1,700,000, and authorizing the issuance of $1,618,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stone Harbor, in the county of Cape May, New Jersey”, finally adopted on March 6, 2012 (#1398), bond anticipation notes of the Borough in a principal amount not exceeding $926,470.59 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water and sewerage system in and of the Borough of Stone Harbor, in the County of Cape May, New Jersey, appropriating $1,050,000 therefor and authorizing the issuance of $999,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on March 19, 2013 (#1417), bond anticipation notes of the Borough in a principal amount not exceeding $669,093.85 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $1,848,000, and authorizing the issuance of $1,378,000 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stone Harbor, in the county of Cape May, New Jersey”, finally adopted on March 4, 2014 (#1436), bond anticipation notes of the Borough in a principal amount not exceeding $798,785.56 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $8,493,000, and authorizing the issuance of $8,068,350 bonds or notes of the Borough, for various improvements or purposes authorized to be undertaken by the Borough of Stone Harbor, in the County of Cape May, New Jersey”, finally adopted on March 3, 2015 (#1455), bond anticipation notes of the Borough in a principal amount not exceeding $6,528,239 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water and sewerage system in and of the Borough of Stone Harbor, in the County of Cape May, New Jersey, appropriating $3,000,000 therefor and authorizing the issuance of $3,000,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on September 15, 2009 (#1342), bond anticipation notes of the Borough in a principal amount not exceeding $148,827 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water and sewerage system in and by the Borough of Stone Harbor, in the County of Cape May, New Jersey, appropriating $29,250,000 therefor and authorizing the issuance of $29,250,000 bonds or notes of the Borough for financing such appropriation (General Capital)”, finally adopted on October 18, 2011 (#1391), bond anticipation notes of the Borough in a principal amount not exceeding $498,480 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $750,000, and authorizing the issuance of $750,000 bonds or notes of the Borough, for various water and sewerage system improvements or purposes authorized to be undertaken by the Borough of Stone Harbor, in the county of Cape May, New Jersey”, finally adopted on March 6, 2012 (#1399), bond anticipation notes of the Borough in a principal amount not exceeding $697,500 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water and sewerage system in and of the Borough of Stone Harbor, in the County of Cape May, New Jersey, appropriating $1,650,000 therefor and authorizing the issuance of $1,571,000 bonds or notes of the Borough for financing such appropriation”, finally adopted on April 2, 2013 (#1418), bond anticipation notes of the Borough in a principal amount not exceeding $1,500,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance appropriating $620,000, and authorizing the issuance of $620,000 bonds or notes of the Borough, for various water and sewerage system improvements or purposes authorized to be undertaken by the Borough of Stone Harbor, in the County of Cape May, New Jersey”, finally adopted on February 18, 2014 (#1437), bond anticipation notes of the Borough in a principal amount not exceeding $616,000 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.

Pursuant to a bond ordinance of the Borough entitled: “Bond ordinance providing for the improvement of the water and sewerage system in and of the Borough of Stone Harbor, in the County of Cape May, New Jersey, appropriating $4,000,000 therefor and authorizing the issuance of $4,000,000 bonds or notes of the Borough for financing such appropriation (Water and Sewer Utility)”, finally adopted on October 21, 2014 (#1450), bond anticipation notes of the Borough in a principal amount not exceeding $77,693 shall be issued for the purpose of temporarily financing the improvement or purpose described in Section 3 of said bond ordinance, including (to any extent necessary) the renewal of any bond anticipation notes heretofore issued therefor.
