TERMS AND CONDITIONS

SSA winning bidder pays fee directly to the ATA.

1. Collection/shipping (US only; Canadian may be additional) fee of $350 payable to WSSl. Mare owner must contact WSS w/payment arrangements: (916) 296-1241 prior to shipping. Any additional collections necessary will incur a separate collection & shipping fee.

2. The mare owner warrants that the mare is in sound breeding condition.

3. Once the mare is pronounced in foal, the mare owner agrees to provide a healthy and safe environment for the mare and fetus and for the mare and neonatal foal once born for the first 72 hours of life. This condition is intended to afford the mare every opportunity to carry to term and deliver a healthy foal. This healthy environment would include, but not be limited to:

a. Proper nutrition to keep the mare in good body condition (not too thin or too fat) to allow her to support a pregnancy and nurse a foal. It should be understood that this condition includes access to fresh water.

b. Proper health care including a vaccination and deworming schedule recommended and supervised by a licensed veterinarian, with the veterinarian understanding that the mare is in foal.

Also, the mare owner must have the mare vaccinated against the abortion form of rhinopneumonitis at 5, 7, and 9 months of pregnancy, or all guarantees of the contract are null and void.

c. Proper farrier care.

d. Adequate exercise and fresh air.

e. Adequate housing and fencing

4. Registration (including all fees and paperwork associated with registration) of the foal resulting from the breeding of the mare and stallion designated in this contract is the sole responsibility of the mare owner. Four Star Farm will provide the ATA with required breeding reports (allowing for registration of foal) when all fees due are paid in full.

5. The mare owner agrees that if the mare does not conceive after breeding during three heat periods, the mare owner will have performed a complete reproductive examination and a uterine biopsy and culture and will provide the results to Four Star Farm without cost to Four Star Farm. Four Star Farm will not ship any additional semen to the mare unless and until said reports are received and found to imply satisfactory reproductive capability.

6. Should the above-named stallion die, be sold by the owner, or become unfit for service before servicing the mare, or if the mare dies or becomes unfit to be bred before she is serviced, then this contract shall become void and without effect and all fees paid returned.

7. This contract shall not be assigned nor transferred without the written consent of Four Star Farm.

8. This agreement is executed in duplicate and constitutes the entire agreement between mare owner and Four Star Farm and may not be modified except in writing signed by all parties hereto. When the representative ofFour Star Farm signs and returns one copy of this contract to the mare owner, it will then be binding on all parties, subject to the terms and conditions in this contract.

9. All written notices required by this agreement shall be by First Class Mail to Four Star Farm at the address above or the mare owner at the address provided below, whichever applies.

10. This contract shall be governed by, interpreted by, and enforced under the laws of the State of California. Any suit or action commenced by or against Four Star Farm, their owners, employees, or agents must be filed and heard in the County of Sonoma, in the State of California. The prevailing party shall be entitled to reasonable attorney’s fees and costs of discovery.

11. The mare owner must refer to competition calendar advising of dates when stallion is available for collection and give at least forty eight (48) hours notice (from when the mare owner wants the semen to arrive at the below-designated destination) when ordering a shipment of semen.

Example: if the mare needs to be bred on Wednesday, call by noon PST on Monday. That way he is collected on Tuesday and your semen will be shipped late Tuesday and arrive by Fed X on Wednesday for breeding. FYI, if the mare needs to be bred on Tuesday, the vet has to check the mare Friday or over the weekend to give us 24 hours notice to collect on Monday (a call on Monday will be too late for appropriate notice for a Monday collection). So keep in mind, unless a vet works over the weekend, or knows on Friday that the mare needs to be bred on Tuesday (and we receive appropriate notice for a Monday collection), you will not be able to have a Monday collection and semen delivered on Tuesday.

12. Due to stallion’s competition schedule it is possible that during certain periods of time cooled fresh semen could be unavailable for this breeding. Virginian Sky is not always available for collection the week in which he competes. It is mare owner’s responsibility to refer to the published competition calendar – posted by Four Star Farm at – for available collection dates.

13. For shipped semen breeding each breed association may require additional paperwork and fees, as well as bloodtyping of the mare and foal, all of which are the responsibility of the mare owner. Four Star Farm will provide the mare owner with the applicable addresses and phone numbers so that the mare owner may contact the breed association(s) for the requirements.

14. This breeding contract is for one pregnancy and delivery of one or two foals from one mare by in utero conception. If semen delivered under this contract is used for in vitro fertilization and/or embryo transfer, only one surrogate mare may be implanted for one stud fee. Additional embryos (whether implanted contemporaneously or stored) will imply additional breedings, and an additional equal breeding fee for each such embryo is due and payable in full to Four Star Farm at the time of implantation of said embryo(s).

15. Four Star Farm assumes responsibility only to deliver live semen in viable condition to the destination designated below by the mare owner . The mare owner assumes responsibility for transport of the semen from said destination to the place of insemination.

16. The mare owner agrees that a licensed veterinarian shall inseminate the mare with the semen on the day of delivery to the destination, and in the event this is not done, Four Star Farm , their owners, employees, and agents shall be deemed to have fulfilled their contractual obligations under this contract, and all guarantees shall be null and void. Other arrangements may be accepted by mutual written agreement in advance.

17. The mare owner agrees to assume all responsibility for the condition of the mare and shall bear all risk of loss or damage to the mare whether by death, disease, injury, infection, or otherwise, and by any cause whatsoever, and further agrees to hold Four Star Farm, their owners, employees, and agents harmless for any and all damages resulting therefrom.
