Rules and Regulations

The social success of our community depends in a large part on the By-Laws, Rules & Regulations and Covenants, Conditions & Restrictions, (CC&Rs), that are the reason for forming a planned community. These regulations not only provide for more tranquil living conditions, but benefit everyone by maintaining the highest possible property values. The Fairway Park Homeowners Association has adopted the following Rules and Regulations which enhance but do not supersede or change the Bylaws or Covenants, Conditions and Restrictions (CC&Rs) in any manner.

The word “Owner” shall refer to the person or persons listed on the grant deed. “Tenant” shall refer to the current person or persons granted the authority by lease to occupy the “Owner’s” premises. Owners will be responsible for the actions of misconduct of themselves, their tenants and/or occupants, children, guests, and pets. Each owner shall also be responsible for furnishing their tenants and/or occupants with a current copy of the Fairway Park Homeowners Association Rules and Regulations.

I. GENERAL COMMUNITY

1. The Board of Directors must be notified regarding occupants as follows:

A.   Any owner who rents or leases a unit is responsible to notify the Board, in writing, of the name of the lease holder within 10 days of the contractual agreement, and prior to the tenant taking occupancy. (CC&R-3.16)

B.   Any owner or tenant who has guests for a period of more than 3 (three) days is required to notify the Board, in writing, so that the guests may be entitled access to any and all of the recreational and service facilities (swimming pool, spa, parking) without the owner present.

2.   Any common streets, driveways or walkways, shall not be obstructed as to prevent owners from accessing common areas or their individual units.

3.   No personal property (e.g. chairs, chaise lounges, etc.) shall be left in any common area unattended.

4. Homeowners are permitted one (1) sign advertising the unit for sale or lease. Signs may be no more than five (5) square feet, (24 inches by 30 inches), and must be placed on the unit or inside the courtyard area. Signs may not be placed in the common area or commonly maintained area. Once a home is rented or an escrow is opened, signs must be removed within 5 days.

5. Behavior and conduct is to be maintained as follows:

A. Owners and guests shall exercise care as to avoid or permit loud, disturbing, or

objectionable noises which may unreasonably disturb other owners and guests.

B.   Owners shall be held responsible for their conduct as well as the conduct of their

guests. Intoxicated, rowdy, destructive, abusive or lewd behavior in or around

Fairway Park shall not be tolerated. (CC&R-3.02)

6. Appearance of the complex shall be maintained as follows:

A.   No clothing, towels, rugs and the like may be hung or left out in or on windows or

patios. Rugs cannot be dusted in any of the common areas by shaking or beating.

B.   Use of foil , newspaper, or sheets on windows or glass doors is prohibited.

C.   At no time may refrigerators, mattresses, furniture, furniture dollies, building

materials (not to be installed within a reasonable period of time), auto luggage

racks, boxes, newspapers, or any other similar article, which may detract from the

appearance of the complex, be placed on patios or in common areas.

Repainting of your home’s exterior, or any portion thereof, must be approved by the Board of Directors BEFORE WORK IS BEGUN. Failure to adhere to this rule will result in fines. The owners must also repaint, at their expense, to the Board’s specifications. Garage doors must be the same color as the stucco.

E. Any change in the appearance of the house that is visible from the street or

any common area must be approved by the Board of Directors before work is

begun. Failure to adhere to this rule will result in fines and reversal of the

work at the owner’s expense.

F. Front doors with a limited amount of glass are permitted. All non-glass

portions of the door must be painted to match the house trim. As with all

other changes in appearance, plans for new doors must be submitted to and

approved by the Board of Directors.

G. Holiday decorations may be displayed no more than 30 days before the

holiday and must be removed within 15 days after the holiday.

7. Rules regarding pets shall be as follows:

A.   All Ventura County and City of Simi Valley ordinances pertaining to dogs and

other pets in general apply to Fairway Park residents. In particular, dogs must be

on a leash at all times when in common areas. If a pet becomes a general

nuisance, restrictive action will be taken.

B.   All animals are the responsibility of the owner at all times. Owners are responsible for the cleaning up of their animals’ waste immediately. Damage to the landscape, etc. will be at the owner’s expense. (CC&R-3.10

C.   Any resident owning a cat must keep it indoors at all times. Cats roaming in or

around the complex are subject to being trapped and taken to an animal shelter.

D.   A maximum of two (2) ordinary household pets, such as dogs or cats, may be kept

by each unit provided they are kept under reasonable control at all times. (CC&R-

E.   No animals of any kind shall be bred or maintained for any commercial purposes in

any unit. (CC&R-3.10)

F. Barking and other noise from pets that disturb neighbors will not be

permitted.

8.   California State and local ordinances regarding the storage of toxic chemicals, explosives, or flammable materials apply to Fairway Park and must be strictly observed. In particular, flammables such as charcoal lighters, gasoline, etc. may not be stored on patios or anywhere susceptible to creating a fire hazard.

II.   COMMON AREAS AND RECREATIONAL FACILITES

1.   Any construction or improvements that impact the common areas or detract from the aesthetics of the Fairway Park complex prior to approval from the board shall be subject to a fine. The fine will be in effect even if the construction or improvements are subsequently approved by the Board.

2.   Any damage to the recreational facilities, equipment, or general common areas caused by owners, their guests, children, pets, employee or contractor commissioned by an owner, shall be repaired or replaced at the expense of the responsible owner. (CC&R3.15)

3.   No littering (e.g. trash, cigarette butts, etc.) in any of the common areas. Trash Barrels are not to be put out before 6:00 p.m. the night before pickup. When emptied, trash containers must be stored out of view from the street by midnight on the day of pickup.

III. SWIMMING POOL AND SPA

1.   The swimming pool and spa are for the use of owners and their invited guests only. Non-residents using the facilities should be reported to the Board.

2.   Swimming pool and spa shall be open between 8:00 a.m. to 12:00 midnight. From 10:00 p.m. to midnight is designated as “Adult Swim.” Only adults, (over age 18), will be permitted in the pool area during this time. Exceptions will

not be made for children accompanied by parents. Due to the close proximity

of some of the units to the pool area, excessive noise will not be tolerated.

3.   There is a limit of tow (2) guestes per adult resident, unless additional guests are approved by the Board or the management company. An adult must accompany children under 18 years of age at all times. Adult guests no longer need be accompanied by and adult resident.

4.   No lifeguard is on duty. All owners assume full responsibility for themselves and their guests. Safety and sanitation rules must be observed. Children fourteen (14) years and under must be accompanied and supervised, at all times, by a responsible adult.

5. There is a fifteen (15) minute limit of spa use, whenever others are waiting.

6. Any person having any apparent skin disease, sores, inflamed eyes, cough, cold,

nasal or ear discharge, or any communicable disease shall not use the pool or spa.

Violators will be charged for the cost of draining, cleaning and re-filling the

pool.

7. Radios, stereos, and televisions brought to the pool and spa area must be

modulated as not to disturb other persons in the pool area or units area.

8. No boisterous or rough play is permitted in the swimming pool or spa area.

9. The use of glassware or glass bottles in the pool and spa is strictly prohibited due

to the transparent nature of glass. Broken glass cannot be completely removed

from pool or spa unless they are completely drained. The cost of cleaning the

pool area, including the draining and re-filling of the pool and/or spa, will be

charged to violators.

10. Owners and guests are required to cooperate in maintaining maximum cleanliness in

the swimming pool and spa. All trash must be placed in trash receptacles.

11. No pets shall be allowed in the swimming pool or spa area.

12. Swimming trunks and suits must be worn in the swimming pool and spa.

13. Suntan oils and lotions should be removed before entering the swimming pool and

spa. Soap or other foreign substances are prohibited in the swimming pool or spa.

14. Flotation devices or toys are allowed in the swimming pool as long as they do not

infringe on the rights of others.

15. Swimming pool and spa users must adhere to all posted rules and regulations.

16. Children under the age of 14 are not permitted in the spa unless a parent is in

the spa at the same, time pursuant to California Administrative Code, Part 2,

Title 24, Section 9025.

IV.   PARKING AND VEHICLE REGULATIONS

1.   Vehicle of owners and guests shall never be parked in such a way as to impede or prevent ready access to another owner’s unit

2.   The speed limit within the Fairway Park complex shall be fifteen (15) miles per hour. Reckless driving will not be tolerated.

3.   Homeowners and tenants must utilize their garages and driveways to their designated capacity. No additional vehicles may be parked anywhere on the common areas without the approval by the Board. (CC&R-3.06)

4.   Parking on the sidewalks, in guest parking lots, or along streets or any area not designated for parking is prohibited and vehicles in violation will be subject to actions listed below. (CC&R-3.06)

5.   No trailer, camper, boat, motor home, commercial vehicle or any similar vehicle, or equipment shall be permitted to remain upon the development unless placed or maintained within the enclosed garage, nor permitted to be parked other than

temporarily on any common area including driveways. Such vehicles may be

temporarily parked thereon for moving, deliveries or trip preparation and

unpacking upon return, but only while being actively loaded or unloaded. (CC&R-3.06) Temporary is defined as follows:

a.   Must be parked in the owner’s/tenant’s driveway only.

b.   Parking for unloading, loading or cleaning only.

c.   To be parked for a maximum of three (3) continuous hours.

d.   Parked a maximum of three (3) hours in any 12 hour period.

6.   Vehicle repairs will be governed as follows:

A.   No oil changes or other messy repairs may be performed on automobiles, motorcycles, etc. in any of the common areas. Excessive noise that would unreasonably disturb other residents is prohibited.

B.   Inoperable or leaky vehicles may not be parked in any common area.

(CC&R3.05). In order to be considered “operable” a vehicle must be

immediately street-worthy, including current registration.

7.   Guests are limited to parking in guest parking spaces no more than 10 days in any calendar month. Parking in a guest space for one hour or more in any day shall count as one day’s parking. Vehicles that exceed this 10-day limit will be towed at the

owner’s expense to Swink’s Tow Yard, which is also the Simi Valley Police tow

yard, 522-2262.

8. Owners are responsible for all parking violations of their guests.

V.   VIOLATIONS

1.   Violations must be reported to the Board of Directors. Each report must be submitted in writing outlining suspected violators, time, date, and place of occurrence. Such reports are to be signed by the reporting party and include their address. The reporter’s identity will be kept confidential if so requested.

2.   Appropriate actions will be taken in the following manner:

First Violation Courtesy Letter

Second Violation, (same rule) Courtesy Letter

Third Violations, (same rule) $25.00 fine

All additional violations, (same rule) $50.00 fine

Ongoing, uncorrected violations $5.00 per day

A. A letter shall be sent to the owner of the unit related to the alleged violation. The

letter shall describe the nature of the alleged violation and identify the restriction,

bylaw or rule involved. The owner shall be entitled to appear before the Board of
