REVIEW AND ACCEPTANCE OF MINUTES

The April 15, 2017 Annual Meeting Minutes were reviewed for accuracy. A motion was made by Sherman Cox to approve the Minutes as written. The motion was seconded by Gary Pickett. The motion passed.

TREASURER’S REPORT

PROPERTY OWNERS ASSOCIATION

Jim Racek presented the March 30, 2017 POA Financials. A motion was made by Sherman Cox to approve the Financials as presented. The motion was seconded by Bill Riden. The motion passed.

The board approved moving $33,000 and $18,000 from the operating account to the reserve account.

DOCK COMMITTEE

Jim Racek presented the April 30, 2017 Dock Committee Financials. A motion was made by Sherman Cox to approve the Financials as presented. The motion was seconded by Margaret Worthington. The motion passed.

·  Obtain approval for the June 2017 Boat Slip Assessment for $300.00/ $250.00

Richard Crowton made the motion to approve. The motion was seconded by Sherman Cox The motion passed unanimously.

COLLECTION REPORT

Report Given

Al-HASAN – 3 LOTS $9,083.49

Currently being treated for cancer. Luke Durham is working with his Al-Hasan’s Agent.

The lien is in place, the attorney is in contact with the owner and trying to collect on all three lots.

Last Payment – 2/23/16 $150.00

Civil Summons has been filed

Mr. Al Hasan passed away in October, his wife appeared in court and agreed to pay $100.00 per month.

3KENNEDY – 3 LOTS $7,793.00 / $4,829.50/$1,737.50/$2,709.17

Civil Summons issued.

Court date for judgment is in August, but working on a payment plan with the owner prior to court date.

Owner paid $450 and asked for 30-day extension 8-15-15 to get the rest of what is owed. Expiration of this extension was 9-15-15.

No Payments in December or January 2016

Court Case to obtain a Judgment on Friday, January 15, 2016. Proposed a settlement which the Board declined.

He Requested a Trial which will be heard February 5, 2016.

Appeared in court and agreed to pay $500.00 for month of the 15th.

PAUL – LOT 89 $3,634.00/$4,274.00

Lien placed – Attorney trying to collect – owner is out of state.

Default judgement $4,275.00

SAMOA $57,114

The Association was granted a default judgment on the 10 Samona lots (7 Owners) June 30, 2014.

Civil Summons has been filed.

LAWSUIT

·  LEXON sent First Set of Written Discovery (INTERROGATORIES) to Plaintiff (ROANE COUNTY) on October 30, 2015. Roden is working with Roane County to answer the Discovery questions.

The Court has put down a Scheduling Order for all sides to complete all discoveries and be prepared to go to trial in September of 2017.

Lexon has agreed to Arbitration and it is scheduled for April 25, 2017 at 9:00 AM

Richard Crowton, Sherman Cox, and Bill Riden are attending.

The mediation was post-poned and there has been no update from Stan Roden. We are waiting on a new date.

Stan sent an email to Roane County asking why there was such a difference in the bids to repair to road.

-  Pool is open

-  Sections of the fence are replaced and need stain

NEW BUSINESS

-  Bill Riden had a question about the cost of the landscape. Richard Crowton responded that this is for the 21 miles for mowing for the vacant lots, and the entrance landscape.

-  Martha Worthington asked why there is not more rock put out since it is easier to maintain. Richard stated that this is what he wants to ask for at the next annual meeting but wants to space the river rock addition out to be cost effective.

-  Jim remembers seeing an email about the DRC from Gronda but there was no application. We have received the money but it is pending due to the application and the check list is not completed. We recommended a phone call to Roger for clarification.

-  The property tax has been lowered for 2018.

-  Vacant lots which are not maintained are causing weeds to grow in neighboring lots which have homes on them. Jessie will mail out letters to Lot 27 to maintain their lot and treat for weeds.

-  Jessie will call Roane County Fire Department about the underbrush and see what they can do to help.
