KNOWSLEY METROPOLITAN BOROUGH COUNCIL (OFF-STREET PARKING PLACES) (CIVIL ENFORCEMENT AND CONSOLIDATION) (AMENDMENT NO.2) ORDER 2017

Knowsley Metropolitan Borough Council in exercise of its powers under Sections 32 and 35 of the Road Traffic Regulation Act 1984 (“the Act”) and Part IV of Schedule 9 to the Act, the Traffic Management Act 2004 and of all other enabling powers, and after consulting the Chief Officer of Police in accordance with Part III of Schedule 9 to the Act, hereby makes the following Order:

1.  This Order comes into force on 2017 and may be cited as Knowsley Metropolitan Borough Council (Off-Street Parking Places) (Civil Enforcement and Consolidation) (Amendment No.2) Order 2017 (“this Order”)

2.  This Order is supplemental to and amends the existing Knowsley Metropolitan Borough Council (Off-Street Parking Places) (Civil Enforcement and Consolidation) Order 2015 (“the Principal Order”)

3.  The Principal Order shall be amended by this Order as follows

3.1 in Article 2 insert the following after the meaning of “car park notice”

“charging point” or “charge point” means an installation adjacent to a electric vehicle parking bay for the purpose of recharging an electric vehicle

3.2 in Article 2 insert the following after the meaning of “drive”

“electric vehicle” means a plug in electric vehicle or a plug in hybrid electric vehicle that is propelled by one or more electric motors powered by a rechargeable battery;

electric vehicle parking bay” means a bay designed for use by electric vehicles in order to recharge their supply by using the electric plug in charging point or charge points in a car park defined by signage and or symbols located within it

3.3 in Article 2 insert the following in the meaning of “pay and display” after the words “pay and display ticket”

(or tickets in the case of electric vehicle parking bays)

3.4 in Article 9 insert the following after the words “motor vehicle,”

an electric vehicle

3.5 delete Article 15 and replace with the following

Motor cycle parking bays and electric vehicle parking bays

15  No person shall cause or permit a vehicle to park in a parking bay marked for motor cycles unless the vehicle is a motor cycle.

16  No person shall cause or permit a vehicle to be parked in an electric vehicle parking bay unless it is an electric vehicle.

17  No person shall cause or permit any electric vehicle to be parked in a electric vehicle parking bay without arranging for the appropriate charge (if any) to be paid in accordance with the scale of charges as stated in the schedules to this Order and as advertised at the parking place.

18  No person shall cause or permit an electric vehicle to park in an electric vehicle parking bay unless any fee to charge has been paid and it is being charged throughout the period within which it is parked in an electric vehicle parking bay.

19  No person shall cause or permit an electric vehicle to park in an electric vehicle parking bay unless any conditions regarding the use of a charging point are complied with at all times that the electric vehicle is parked in an electric vehicle parking bay

20  No person shall cause or permit an electric vehicle to park in an electric vehicle parking bay provided for charging at charging points unless that vehicle is being charged

and re-number the remaining Articles as Article 21 onwards accordingly

3.6 delete Article 16 and replace with the following

Hours of operation and maximum period of stay

21  Where by notice on site a parking place or any parking bay within the parking place is described as being in operation on specified days, during specified hours or for a maximum period of stay, no person shall cause or permit a vehicle to be parked in that parking place or in any parking bay within the parking place on any day, during such hours or for any period other or longer than those specified. Notwithstanding the foregoing and any other provision in this Order

21.1 vehicles displaying a valid disabled persons parking badge for that vehicle in accordance with the provisions of this Order may be left in a parking place for up to one hour longer than the expiry time displayed on a parking ticket in relation to that parking place (and where an alternative approved method of payment has been used when the period for which payment has been made and recorded plus an additional period of one hour) and the stay period in the schedules to this Order shall be extended for such vehicles accordingly.

21.2 electric vehicles parked in an electric vehicle charging bay in accordance with the provisions of this Order may be left in an electric vehicle charging bay for up to four hours in a car park that does not permit a stay for four hours provided that pay and display tickets are purchased for periods of time that if combined together would permit a stay up to four hours and displayed in accordance with the provisions of this Order and the stay period in the schedules to this Order shall be extended accordingly for such electric vehicles parked in accordance with these provisions.

3.7  in Article 17 after the words “during such periods” insert the following

except for electric vehicles plugged in to a charge point in accordance with the provisions of Article 21.1 where the non-return period shall only apply when the extended period time during which the electric vehicle is permitted to be parked in the electric vehicle charging point ends

3.8  in Article 23(i) add the following after the words “pay and display ticket” insert the following

or, in the case of electric vehicle parking bays, tickets

3.9  in Article 26(i) add the following after the words “pay and display ticket” insert the following

or, in the case of electric vehicle parking bays, tickets

3.10  in Article 26(ii) add the following after the words “pay and display ticket” insert the following

or, in the case of electric vehicle parking bays, tickets

3.11 in Article 28 delete “16” and replace with “21”

3.12 the Schedules to the Principal Order shall be deleted and the Schedules contained within Schedule A to this Order shall be added to the Principal Order.

4. Save as amended by this Order the Principal Order remains in full force and effect.
