Planning Board Meeting

The Shallotte Planning Board met for its regularly scheduled meeting on April 11, 2006 at the Shallotte Town Hall with Vice-Chairman Evelyn Madison presiding.

Members Present: Evelyn Madison, Bunny Begeal, Dennis Winters, Elwood Cheers, Ray Lyles, and alternate members – Monroe Enzor, and Tim Gore.

Members Absent: Alan Lewis, Bobby Lewis

Staff Present: Paul Sabiston, Cindy Babson and Debra White

Alderman Liaison: Larry Harrelson

1. Call to Order

Vice-Chairman Evelyn Madison called the meeting to order.

2. Roll Call

Monroe Enzor, Elwood Cheers, Bunny Begeal, Evelyn Madison, Dennis Winters, Ray Lyles, and Tim Gore, all present.

3. Approval of Minutes

Bunny Begeal made a motion to approve the March 14, 2006 minutes as amended, seconded by Elwood Cheers. The motion passed 7 yes 0 no.

4. Agenda Amendments

On going project, Highlands Subdivision – Owner McCarley’s and Stovall – Highlands Glen Drive, final plat, to be added to the agenda as item #12.

5.  Public Comments

None

6. (Planning and Zoning #06-010), Cardinal Pointe III, owner NRP group, 361 Scot Drive, Conditional Use Permit and Planned Building Group with a Highway Business Zoning.

a)  Approval/Denial for Rezoning.

Aaron Pechota, Agent for Cardinal Pointe III, located at 361 Scott Drive request to be rezoned from Highway Business to R7 for multi-family use.

The Planning Board members had visited Cardinal Pointe since the last meeting. Monroe Enzor and Ray Lyles saw nothing out of place at the time of their visit. Bunny Begeal saw containers of garbage on two of the patios but could not say how long the garbage had been there. There had been ten Town of Shallotte Police reports for Cardinal Pointe in the last two years.

Several residents from the neighboring development of the Highlands attended the meeting to oppose the development of Cardinal Point III. Monica Kassel, resident of Highland stated that she had called the police on two occasions for noise and fighting coming from the Cardinal Pointe residents and there has been calls made to the Sheriff’s Dept also. Christina Bond stated the kids from Cardinal Pointe cut through fences to get onto Highlands property, assault other children, and litter onto their property. Cars have been broken into and vandalized. Ms. Bonds expressed that there was no peace of mind or place to raise a family since Cardinal Pointe has been developed. Jim Russell stated that they were told that were moving into an upscale condition area until Cardinal Pointe. He was led to believe that Cardinal Pointe was to be homes for senior citizens and not “low-income and subsidized apartments”. Charles Ward stated that he lived in Highlands prior to Cardinal Point and it has been a growing catastrophe. Tom Christy, along with other Highland residents, is concerned that 72 more units in Cardinal Point will only cause more problems.

Ellen Macintosh, property manager for Cardinal Pointe, stated that she has a screening process for all resident applicants for Cardinal Pointe. She performs a credit and criminal background check, and has to follow Fair Housing guidelines. If there are any problems with the residents they are given a warning first and second time they are given eviction notices. She has been property manager for a little over a one year and has asked 8 to 10 residents to leave. If the Highland resident have any problems she needs to be notified. Ms. Macintosh stated that she has only received a three calls from the Highland residents, which she handled the complaint as soon as she received the calls. She also stated the children from Highlands has come into Cardinal Pointe to ride skate boards and play on their playgrounds and she has asked them to leave on numerous occasions. When Ms. Macintosh was asked of she resides in Cardinal Pointe, she replied “No, but her assistant manager does have a residence in Cardinal Pointe.” She also stated that about 25 to 30% of the residents get subsides rent and only one is unemployed.

Recommendation:

The Planning Board tabled the request for approval of the site plan until the Board of Alderman reached a decision to approve or deny the request to rezone.

The Shallotte Planning Board recommends to the Board of Aldermen that a public hearing be set to consider approval of the rezoning of the property located 361 Scot Drive, tax parcel # 1820004209. The Planning Board recommends that the property be rezoned R-7. The property currently has HB Zoning. Other concerns from homeowners of Highlands regarding this decision are listed below:

o Trash and buildings are not kept up.

o Problem with drugs, trespassing, vandalism & thief in neighborhood

o Property value in Highlands decreasing

o Noise and fighting

The Planning Board discussed the items contained in the rezoning report. The Planning Board considered all items in the report and includes a copy of the report as part of the minutes of this meeting. The Planning Board recommends with the zoning report to rezone property to R-7. With the exception of item # E on the zoning report: “This new zoning promotes the public health, safety, and general welfare of the community,” The Planning Board recommends approval of the zoning report and to rezone the property to R7 for multi-family use

Motion

Bunny Begeal made the motion to approve the annexation and rezoning of property to R7 multi family use and to approve the written report for the Board of Alderman, seconded by Ray Lyles. The motion passed 7 yes 0 no.

7. (Planning and Zoning #06-012), # Carolina Creations Landscapes Inc- Agent Art Miller – 1054 Whiteville Road, request of annexation and rezoning

Art Miller, agent for property located at 1054 Whiteville Road, was present at the meeting and requested the annexation and zoning of the 1.74 acres.

Recommendation:

The Shallotte Planning Board recommends to the Board of Aldermen that a public hearing be set to consider approval of the rezoning of the property located 1054 Whiteville Road, tax parcel # 18100011 and 1810001103, which consists of 1.74 total acres. The Planning Board recommends that the property be rezoned Light Industrial. The property currently has County Rural Zoning. The Planning Board recommends with the zoning report to zone property to Light Industrial. The following issues need to be resolved and added prior to the issuance of a zoning compliance and/or certificate of occupancy.

o  Provide buffer strips that are designed to protect adjoining land use

o  The planted buffer strips shall be at least six to eight feet tall and give approximately seventy-five percent visual opacity within one year of planting.

The Planning Board discussed the items contained in the zoning report. The Planning Board considered all items in the report and includes a copy of the report as part of the minutes of this meeting. The Planning Board recommends approval of the zoning report and to zone the property to Light Industry.

Motion

Bunny Begeal made the motion to approve the annexation and zoning of property, with above conditions, to Light Industry and to approve the written report for the Board of Alderman, seconded by Dennis Winters. The motion passed 7 yes 0 no.

8.  (Planning and Zoning # 06-013), Beamon’s Place – Agent Michael Norton, 5041 Main Street, request site and landscape plan approval.

Michael Norton, agent for 5041 Main Street, request to approve the presented site and landscaping plans.

Recommendation:

The Shallotte Planning Board approved the site and landscaping plans for Beamon’s place located 5041 Main Street, tax parcel # 1970006204. The following issues need to be resolved and added prior to the issuance of a zoning compliance and/or certificate of occupancy.

o  The front of property will need 5 additional crepe myrtles in planting area.

o  Correct legend using the number of plants for each plant or tree material labeled in the legend.

o  Label the 8% on landscape drawing. Calculation will need to be stated on drawing and submitted to the Town for it’s hard copy.

o  Landscaping needs to be placed at the end of the parking spaces. The drawing does not show correct island requirement.

o  Adequate screening needs to be shown for dumpster.

Bunny Begeal made the motion to approve site and landscaping plans with above conditions, seconded by Elwood Cheers. The motion passed 7 yes 0 no.

9.  (Planning and Zoning #06-014) Jacksen’s Place – Agent Michael Norton, 4498 Main Street, request site and landscaping plan approval.

Michael Norton, agent for 4498 Main Street, request to approve the presented site and landscaping plans.

Recommendation:

The Shallotte Planning Board approved the site and landscaping plans for Jacksen’s place located 4498 Main Street, tax parcel # 1820003401. The following issues need to be resolved and added prior to the issuance of a zoning compliance and/or certificate of occupancy.

o  Total of each planting material to be used should be stated on landscaping plans.

o  Label the 8% on landscape drawing. Calculation will need to be stated on drawing and submitted to the Town for it’s hard copy.

o  The islands at the end of the parking spaces need to be landscape before final approval.

Ray Lyles made the motion to approve site and landscaping plans with above conditions, seconded by Bunny Begeal. The motion passed 7 yes 0 no.

10.  (Planning and Zoning #06-015), David Haddock, Owner- David Haddock, 2763 Ocean Hwy West, request annexation and rezoning.

David Haddock, owner of property located at 2763 Ocean Hwy, request the annexation and rezoning of the 1.03 acres.

Recommendation:

The Shallotte Planning Board recommends to the Board of Aldermen that a public hearing be set to consider approval of the annexation and rezoning for property located at 2763 Ocean Hwy, tax parcel #1820012901 that consists of 1.03 acres. The property currently has B2 Zoning. The Planning Board recommends with the zoning report to rezone property to Highway Business.

Elwood Cheers made the motion to approve the annexation and rezoning of property to Highway Business and to approve the written report for the Board of Alderman, seconded by Bunny Begeal. The motion passed 7 yes 0 no.

11.  (Planning and Zoning # 06-016) David Sabiston – Owner David Sabiston – 5483 Main Street, request to annex and rezone.

David Sabiston, owner of property located at 5483 Main Street, requested the annexation and rezoning of the 6.84 acres.

Recommendation:

The Shallotte Planning Board recommends to the Board of Aldermen that a public hearing be set to consider approval of the annexation and rezoning for property located at 5483 Main Street, tax parcel #19700069, 19700068, 1970006802, that consists of 6.84 total acres. The property currently has RA-15 Zoning. The Planning Board recommends with the zoning report to rezone property to B2.

Elwood Cheers made the motion to approve the annexation and rezoning of property to B2 and to approve the written report for the Board of Alderman, seconded by Tim Gore. The motion passed 7 yes 0 no.

12.  (Planning and Zoning # 06-017) McGlothlin Office Building – Owner Wayne McGlothin, 4702 Main Street, request site and landscape plan approval.

Wayne McGlothlin, owner of property located at 4702 Main Street, was present and gave a presentation of the request to approve the presented site and landscaping plans.

Recommendation:

The Shallotte Planning Board approved the site and landscaping plans McGlothin Office Building located at 4702 Main Street with the following conditions:

o  Submit a driveway permit from DOT

o  The parking lot in rear of property located at the handicap parking space must be changed to meet parking space requirements.

o  Submit a new site plan without the future Office building “B” on site plan.

o  Landscape needs to meet Town code.

o  All Fire codes will need to be met.

Ray Lyles made the motion to approve site and landscaping plans with above conditions, seconded by Bunny Begeal. The motion passed 7 yes 0 no.

13.  (Planning and Zoning # 06-018) Jimmy and Zettie Price – Owner Jimmy and Zettie Price – 1104 Whiteville Road, request of annexation and zoning.

Jimmy and Zettie Price, owner of 1104 Whiteville Road, requested the annexation and zoning of the .90 acres from County Rural to R-15.

Recommendation:

The Shallotte Planning Board recommends to the Board of Aldermen that a public hearing be set to consider approval of the annexation and zoning for property located at 1104 Whiteville Road, tax parcel #18000002 that consists of .90 acres. The property currently has County Rural Zoning. The Planning Board recommends with the rzoning report to zone property to R-15.

14.  (Planning and Zoning # 06-019) Ralph Beuoy – Owner Ralph Beuoy – 383 Red Fox Street, request to annex and rezone.

Ralph Beuoy, owner of the property located at 383 Red Fox Street, requested the annexation and rezoning of the .4591 acres from RAM-15 to R-10.
