MAY 27, 2015 VILLAGE BOARD MEETING

MEMBERS PRESENT: Mayor Kurt Wheeler, Trustee Amy Mann, Trustee Dave Porter, Trustee Fritz Koennecke, Trustee Jim Joseph

ALSO PRESENT: Bill Carr, Mike Hayes

Mayor Kurt Wheeler called the meeting to order at 6:04 pm. At the start of the meeting there were four board members present with Trustee Koennecke in route (arrived at 6:10 pm).

Motion made by Mayor Wheeler and seconded by Trustee Jim Joseph to pass the following resolution:

RESOLUTION NO. 58

OF THE BOARD OF TRUSTEES OF THE

VILLAGE OF CAZENOVIA

A RESOLUTION SUPPORTING AND ENDORSING THE APPLICATION FOR A SECTION 211 PENSION WAIVER REGARDING THE CONTINUING APPOINMENT OF MICHAEL A. HAYES AS VILLAGE OF CAZENOVIA CHIEF OF POLICE

WHEREAS, on September 7, 2010, Michael A. Hayes was duly appointed to fill the office of Chief of Police of the Village of Cazenovia and has continuously served the Village as its Chief of Police since his appointment, and

WHEREAS, on May 27, 2015 this Board of Trustees duly adopted Resolution No. 58 of the year 2015 supporting a full Pension Waiver for Chief Hayes, which was granted by the New York State Civil Service Commission.

WHEREAS, Chief Hayes has proven himself to be a tremendous asset to the Village, and the Village of Cazenovia and its residents would be would be greatly disadvantaged without the services of Michael A. Hayes as Chief of Police.

NOW, THEREFORE, BE IT HEREBY RESOLVED that the Board of Trustees of the Village of Cazenovia hereby supports and endorses the application of Michael A. Hayes for continuation of a full Pension Waiver pursuant to Section 211 of the New York State Retirement and Social Security Law, and hereby requests that the New York State Civil Service Commission grant such full waiver.

Four in favor. Approved.

The Village Board approved the request from a Town of Cazenovia resident to use the small pavilion at Lakeside Park on August, 2nd.

Motion made by Mayor Wheeler and seconded by Trustee Amy Mann to approve the end of the year Village bills (see attached list).

Vote taken. All aye. Approved.

Motion made by Mayor Wheeler and seconded by Trustee Joseph to pass the following resolution:

RESOLUTION # 59 – BE IT RESOLVED, that the Village of Cazenovia through its governing body, the Board of Trustees, hereby authorizes the budget transfers as shown on the attached list.

By vote of the Board – Mayor Kurt Wheeler – aye, Trustee Amy Mann – aye, Trustee Dave Porter – aye, Trustee Jim Joseph – aye, Trustee Fritz Koennecke – aye.

Motion made by Mayor Wheeler and seconded by Trustee Mann to pass the following resolution:

RESOLUTION # 60 - BE IT RESOLVED that the Village of Cazenovia through its governing body, the Board of Trustees, hereby resolves to write off in the General Fund old outstanding check # 19461 in the amount of $241.55 dated 7/19 /13.

Motion made by Mayor Wheeler and seconded by Trustee Mann to pass the following resolutions:

RESOLUTION #61 - BE IT RESOLVED that the Village of Cazenovia through its governing body, the Board of Trustees, hereby authorizes the transfer of $ 57,663.12 from the General Fund Unreserved Fund Balance (A-909) to the Highway Equipment Capital Reserve Fund.

RESOLUTION # 62 - BE IT RESOLVED that the Village of Cazenovia through its governing body, the Board of Trustees, hereby authorizes the transfer of $ 12,924.24 from the General Fund Unreserved Fund Balance (A-909) to the Tree Replacement Capital Reserve Fund.

RESOLUTION #63 - BE IT RESOLVED that the Village of Cazenovia through its governing body, the Board of Trustees, hereby authorizes the transfer of $ 3,187.16 from the General Fund Unreserved Fund Balance (A-909) to the Fire Equipment Capital Reserve Fund.

RESOLUTION #64 - BE IT RESOLVED that the Village of Cazenovia through its governing body, the Board of Trustees, hereby authorizes the transfer of $ 5,000.00 from the General Fund Unreserved Fund Balance (A-909) to the Police Equipment Capital Reserve Fund.

RESOLUTION # 65 - BE IT RESOLVED that the Village of Cazenovia through its governing body, the Board of Trustees, hereby authorizes the transfer of $ 8,761.59 from Water Fund Unreserved Fund Balance (F-909) to the Water Equipment Capital Reserve Fund.

Motion made by Mayor Wheeler and seconded by Trustee Fritz Koennecke to pass the following resolution:

RESOLUTION NO. 66

OF THE BOARD OF TRUSTEES

OF THE VILLAGE OF CAZENOVIA

A RESOLUTION ESTABLISHING THE SANITARY SEWER SYSTEM EQUIPMENT CAPITAL RESERVE FUND

RESOLVED, that pursuant to section 6-c of the General Municipal Law, as amended, there is hereby established a capital reserve fund in the amount of $ 5,596.56 to be known as the “Sanitary Sewer System Equipment Capital Reserve Fund” (hereinafter “Reserve Fund”). The purpose of this Reserve Fund is to accumulate monies to finance the replacement and enhancement of sanitary sewer system equipment necessary for the repair and maintenance of the sanitary sewer system in the Village, and it is hereby further

RESOLVED, that the sum of $ 5,596.56 in currently unappropriated Village sewer system funds be, and the same hereby are designated and appropriated to fund this Reserve Fund, and additional funds may be hereafter specifically appropriated to become part of this Reserve Fund, and it is hereby further

RESOLVED, that the chief fiscal officer is hereby directed to deposit and secure the monies of this Reserve Fund in State Bank of Chittenango under the account title “Sanitary Sewer Capital Reserve Fund” as provided by section 10 of the General Municipal Law. The chief fiscal officer may invest the monies in the Reserve Fund in the manner provided by section 11 of the General Municipal Law, and consistent with the investment policy of the Village of Cazenovia. Any interest earned or capital gains realized on the monies so deposited or invested shall accrue to and become part of the Reserve Fund. The chief fiscal officer shall account for the Reserve Fund in a manner which maintains the separate identity of the cash and investments of the Reserve Fund, and it is hereby further

RESOLVED, that except as otherwise provided by section 6-c of the General Municipal Law, expenditures from this Reserve Fund shall be made only for the purpose for which the Reserve Fund is established. No expenditure shall be made from this Reserve Fund without the approval of this governing board and without such additional actions or proceedings as may be required by section 6-c of the General Municipal Law, including a permissive referendum if required by subdivision 4 of section 6-c, and it is hereby further

RESOLVED, that this resolution shall take effect immediately.

Trustee Joseph presented and reviewed the reports pertaining to the police complaints, motor vehicle accidents and the totals for all complaints/MVA’s/Arrests from 5/1/14 to 4/30/15. Trustee Joseph pointed out some general trends but noted that this is just the beginning of a process to base manpower and scheduling decisions on data such as this.

Mayor Wheeler suggested the July Village Board meeting be moved to July 1st due to the July 4th holiday. The Board will check their schedules and the Board will discuss at the June 1st meeting.

Motion made by Mayor Wheeler and seconded by Trustee Mann to adjourn the meeting at 6:46 p.m. All aye. Approved. Meeting adjourned at 6:46 p.m.
