HIKE FOR A HOUND WAIVER, RELEASE AND INDEMNIFICATION AGREEMENT

INDEMNIFICATION, HOLD HARMLESS AGREEMENT:

I hereby certify the following:(1)As owner of the dog, I am over 18 years in age and shall be the only handler of my dog for this event,(2)In consideration of my dog's application to participate in the Hike For A Hound being accepted, I, on behalf of myself, my heirs and assigns, and my estate, hereby agree to indemnify and hold harmless the sponsors, organizers, and affiliates, as well as their agents, employees, and volunteers (the indemnities) from all claims for any liability, injury, loss, or damage in any way connected with my dog walk and also waive and forever discharge the indemnities from any and all claims that may accrue as the result of my dog's participation.

INHERENTLY DANGEROUS ACTIVITY-NO INSURANCE PROVIDED:

I am aware that walking a dog along a defined route in conjunction with other individuals who are walking their dogs involves many inherent risks, dangers and hazards. The below signed hereby acknowledges that dog walking can be a dangerous activity, with a risk of serious bodily injury to others or myself. You are strongly encouraged to have medical insurance prior to engaging in this activity. Failure to follow the policies, rules and regulations listed herein will result in removal of you and your dog from the walk with no refunds.

RELEASE OF LIABILITY:

For and consideration of electing and being allowed to participate in certain recreational activities

including participation in the “Hike for a Hound” event (The “Activities”), the below named participant (“Participant”) and Participant’s parent or guardian (if Participant is a minor) does hereby (i) acknowledge the danger and assume the risk of participating in the activities; and (ii) expressly and forever waive and release any and all claims, proceedings, or actions for personal injury, or any loss or damage whatsoever (the “damages”) that Participant may suffer arising out of or in connection with Participant’s participation in the activities, and Participant further releases and agrees to hold harmless Hike for a Hound organizers and volunteers, employees, and the heirs, successors, and assigns of each of them from any and all liability for damages to Participant arising out of participating in any activities. Participant also accepts financial responsibility for the loss of or damage to any equipment used by participant. Participant further acknowledges that the activities are provided by Hike for a Hound, or its agents, and that any controversy arising in connection with this Waiver and Release or the participation by participant in the Activities shall be governed by New York law and shall be adjudicated in the appropriate forum located in New York

NOTICE: By executing this WAIVER AND RELEASE, Participant agrees to abide by all of the rules relating to the activities and Participant acknowledges that participant may be relinquishing valuable legal rights. Execution of this form shall be conclusive evidence that Participant has read and understands this in its entirety and intends to be bound by its terms.

HIKE FOR A HOUND RULES:

- All dog walkers must be over the age of 18. Any minors must be accompanied by an adult.

- Limit 1 dog per walker.

- Dogs must be accompanied by a registered participant.

- Participants must pick up after their dog.

- Dogs must have current Rabies vaccine.

- All participants must sign Waiver/Release.

- All dogs must be kept on a maximum 6 foot leash at all times.

- Female dogs in heat will not be allowed to participate.

- At the sole discretion of the Event Coordinator, dogs whose behavior is unruly or might prove to be hazardous to participants, other dogs or spectators, will be requested to leave the premises and route.

- All dog walkers must comply with site location rules not listed above.

By signing this agreement in consideration of the right to participate in the above described Activities. I acknowledge that I have read this document in its entirety and that I understand the legal ramifications of my execution of this “Waiver, Release and Indemnification Agreement.” I enter into this agreement freely and of my own accord and hereby agree to be bound by the terms contained herein.
