4. DVD Multi License

If you wish to use the DVD Multi Logo, the “DVD Multi License” is necessary in addition to DVD Format/Logo License of the Formats/Product Categories that comprise the DVD Multi product. The fee for DVD Multi License is JPY385,000. The applicable DVD Format/Logo License must be obtained in advance, in order to qualify for DVD Multi License. Refer to APPENDIX 2 “Essential licenses for DVD Multi Products.”

7. Affiliates

If you wish to include Affiliates in DVD Format/Logo License Agreement, we require such companies to satisfy certain requirements. (cf. Article 1.1 of DVD Format/Logo License Agreement) Please fill out 7.1. Affiliate Registration Form and check off each item to see if such company meets the criteria.

Affiliate Requirement 1: An Affiliate needs to be a manufacturer of DVD Products.

Affiliate Requirement 2: An Affiliate needs to be owned and controlled by Licensee by more than 50% ownership of shares.

Affiliate Requirement 3: An Affiliate needs to be an NDA (Non-Disclosure Agreement) holder or registered as an Affiliates in NDA.

*If it is not registered, you would need to concurrently request for an amendment of NDA.

If you request disclosure of your Affiliate(s) on DVD FLLC’s website (http://www.dvdfllc.co.jp/license/lifc/index.htm), please check YES in “Web disclosure” column. Upon payment of JPY60,000 annual fee per Affiliate, the Affiliate’s name will appear together with your company name, in the “List of Licensees” section. If you check YES, Licensing staff will provide you further information.

8. Third Party Manufacturers (TPM)

If you have Third Party Manufacturer (TPM) to manufacture DVD Products on your behalf, please fill out 8.1. Third Party Manufacturer Registration Form and check off each item. Criteria for TPM are listed below. (cf. Article 1.9 of DVD Format/Logo License Agreement)

“Third Party Manufacturer” shall mean any manufacturer:

(1) who manufactures one or more DVD Products on Licensee’s behalf, pursuant to a written contract or other written agreement with Licensee

(2) who manufactures one or more DVD Products irrespective of whether or not it needs to have access to any information contained in the DVD Format Books.

*If TPM requires the Book information to manufacture DVD Products as consigned by Licensee, TPM must also become a Licensee.

*There is no Test Specification made especially for DVD-ROM discs. Manufacturers must verify according to Sections [3.2.1] and [3.3] of either DVD-Video Disc Test Specification or DVD-Audio Disc Test Specification.

**The License for DVD-RAM (4.7 Gbytes) Disc also covers the empty cases to be used with such discs (DVD Product No. 16). The Test Specification for such empty cases is included in the DVD-RAM (4.7 Gbytes) Disc Test Specification. Pursuant to Article 4, manufacturers of such empty cases must verify according to the relevant portions of that Test Specification.
