DRAFT NOTIFICATION

NEW DELHI July, 2007

G.S.R. (E) - In exercise of the powers conferred by Sections 6 and 25 of the Environment (Protection) Act, 1986 (29 of 1986), the Central Government hereby makes the following Rules further to amend the Environment (Protection) Rules, 1986,

namely :-

(1) These rules may be called the Environment (Protection) Second Amendment Rules, 2006.

(2)They shall come into force on the date of their publication in the Official Gazette or otherwise as mentioned.

  1. In the Environment (Protection) Rules, 1986 in schedule I:-

( I) After Serial No.98 and entries relating thereto, the following serial No. and entries shall be inserted, namely :-

Note: All values corrected to 11% oxygen on a dry basis.

OPERATING STANDARDS

(i)All the facilities shall be designed to achieve a minimum temperature of 1100 0C in secondary combustion chamber and with a gas residence time in secondary combustion chamber not less than 2 (two) seconds.

(ii)The incineration facilities after initial operation of minimum one year, as per the guidelines and standards, can submit a proposal for relaxation in temperature and retention time requirement if it can be demonstrated that the flue gas standards and operation standards can be complied with at lower temperatures and residence times. The State Pollution Control Board/Pollution Control Committee, upon successful demonstration of compliance with flue gas standards by the facility, can recommended the proposal made by the incineration facility for relaxation in temperature and residence time, but in any case not less than 950 0C and 1.5 seconds for the consideration and approval of the Central Board.

(iii)Incineration plants shall be operated (combustion chambers) with such temperature, retention time and turbulence, as to achieve Total Organic Carbon (TOC) content in the slag and bottom ashes less than 3%, or their loss on ignition is less than 5% of the dry weight of the material.

(iv)Frequency of monitoring for various parameters shall be prescribed as per the “Guidelines for Common Hazardous Waste Incineration” of Central Pollution Control Board no-HAZWAMS/30/2005-06 except in case of TOC, where one year relaxation is permitted from the date of notification for implementation of continuous monitoring system.
