CALL FOR INTERNAL/ EXTERNAL TENDER NO.74

TO SUPPLY HYDRAULIC DRIVE TONGS FOR SUCKER ROD AND TUBING WITH SPARE PARTS

For the First Time .

View badly needed "General Foreign Trade Organization " announces an external /internal tender No. /74/ for the first time to purchase hudraulic drive tongs for sucker rod and tubing with spare parts as per Unified Contracts System issued by law 51 dd. 9/12/2004, the form attached with the book of conditions ( financial & legal ) set for this purpose as follows:

Bid Bond:

-Bid bond attached with the offer in Euro for external offer in the value of (Euro 3000) or in Syrian pounds for internal offers in the value of (S.P 300 000) .

Performance Bond :at (10%) of total contract value.

Delivery Period: For external bidder four months FOB and six months CFR from date of receiving workable LC .

-For Local bidder (Agent or accredited distributor): (6) months and Contractor should adhere to deliver total contract quantity to land fields warehouses of Syrian Petroleum Company in " Al Hasaka" starting from date of notifying him the order of work commencement.

-For Local bidder : (30) days and Contractor should adhere to deliver total contract quantity to land fields warehouses of Syrian Petroleum Company in " Al Hasaka" starting from date of notifying him the order of work commencement.

-Period of bidder's commitment to his offer : (60) days i.e. until 1/ 4/ 2013.

Delivery Delay Penalty:

- One per thousand per each delay day provided not exceeding 20% of contract total value.

- Bidder, with whom the contract is concluded, will bear all taxes, duties and expenses incurred on execution of the contract.

-You can obtain the file from GFTO after payment of its value amounting S.P /2000/

- Offers to be submitted by sealed envelope as per Unified Contract System issued by law No.51/2004

-Provisions of Unified Contract System issued by law No. 51/2004 as well as Book of General Conditions of Unified Contract System issued by decree 450/2004, will be applied on the contract.

-Offers should be submitted to “General Secretariat at General Foreign Trade Organization – Damascus – Al-Meissat – Houtin Square – Al-Awkaf Ministry Building" before (15.00 HRS P.M) Damascus time, on Thursday 31 /1 /2013.

-Bidder should stick a fiscal stamp in the amount of S.P /1000/ only on the application to participate in the tender.

View badly needed General Foreign Trade Organization announces the need to purchase hydraulic drive tongs for sucker rod and tubing with spare parts. Quantities and specifications as mentioned in the technical conditions book attached herein.

Article 1 – Subject Of The Contract:

Purpose of contract is to submit hydraulic drive tongs for sucker rod and tubing with spare parts Quantities and specifications as mentioned in the technical conditions book attached herein. and as per Unified Contracts System issued by Law 51 dd. 9/12/2004, the form attached with the book of conditions (Financial& Legal), relative announcement, technical book of conditions set for this purpose attached herein issued by General Foreign Trade Organization (GFTO), provisions stated in this book and book of general conditions of Unified Contracts System issued by decree No. 450/2004.

Article 2 – Date, Place Method Of Submitting Offers:

Required offers should be submitted to “ General Secretariat at General Foreign Trade Organization – Damascus – Al-Meissat – Houtin Square – Al-Awkaf Ministry Building" in sealed envelope by hand or sent by express registered airmail within a period latest before (15.00 HRS P.M) Damascus time, on Thursday 31 / 1/ 2013. Offers to be put in a big sealed envelope signed by the bidder indicating subject of announcement, tender No., closing date, material /quantity , name /address of bidder and name /address of G.F.T.O, addressed to General Foreign Trade Organization, Damascus, Houtin Sq., P.O. Box 3136 or 15, sticking on it file purchase receipt .

- The big envelope should contain three sealed envelopes as follows:-

1 – First Envelope Contains:-

-Documents stated in article /11/of Unified Contract System issued by law No.51/2004 which are:-

1-A declaration from the bidder that he is aware of the books of general and special conditions (Legal, Financial And Technical) and the list of supplied items as well as related announcement, and that he accepted and adhered to all conditions and provisions contained therein without any contradiction or reservation.

2- A document proving his submittance of required bid bond as per provisions of article 3 of this book.

3-An application for participation in the tender, sticking on a fiscal stamp in the value of (SP 1000).

4 – Indicate name / address of bidder and his chosen domicile in Syria, (stating avenue, street, No. of Bldg in details and No. of fax ,if any) to advise him all legal and administrative correspondence and others. his chosen domicile stated in his offer will be binding to him even if he moved to another one unless he notifies G.F.T.O in writing of his new domicile, otherwise, all notifications sent to his first chosen domicile will be definitely correct. the embassy or its relative offices will not be considered as his chosen domicile.

5 –Name of foreign bidder's agent and his chosen domicile and a duly registered agency document which authorizes the agent practicing all powers to make contract with G.F.T.O. Noting that in case of non providing the registered agency document by bidder, the offer will be rejected.

6- A declaration from the bidder that he is not barred from participation in tenders and inquiries with public parties or there is no precautional or executive attachment on his properties in favour of public parties.

7-Only one offer can be accepted from a bidder, and the earliest offer registered in G.F.T.O secretariat will be considered the accredited one. Getting back, completing or amending offers after being registered at G.F.T.O secretariat is not permitted.

8-A duly certified document confirming that bidder is registered in one of the chambers of commerce or industry or any party stands in its position in his country.

9-A letter clarifying that bidder is a manufacturer. in case he is a supplier, name of materials' manufacturer to be indicated and an undertaking from manufacturing company to be submitted stating that required materials are manufactured by them as per the specifications indicated in technical book of conditions. this letter is to be original and duly legalized and that materials are new and not re-newed.

In case offer was submitted by the foreign company branch located outside its country, then bidder should provide a registration certificate for the branch issued by the chamber of commerce or industry duly legalized by the chamber of commerce and Syrian Embassy in the country where the branch is existed and legalized by Ministry of Foreign Affairs as per the provisions of legislative decree no. 49/1977.

10-An undertaking that materials are new and not re-newed indicating country of origin.

11-a declaration from the bidder:

"We the beneficiary declare on our full responsibility that goods are from national origin ….. and no materials or raw materials from other countries contained in manufacturing goods subject of this credit".

12- Attach the form signed and stamped after filling it with all required information.

13-Indicate customs code under which materials are listed as per Brussels' system.

14-Local bidder should submit the following documents;-

a-  A document by which he undertakes that materials are available at local market.

b-  He should not be an employee at one of public parties nor a member in executive offices of the local administration in his province nor a member in the parliament.

c-  Trader registration certificate valid for three months from its issuance date, or a company registration certificate duly legalized.

d-  A registration certificate in one of the chamber of commerce, agriculture, industry or tourism as the case may be.

e-  A document of subscription in the formal advertisement daily bulletin, duly legalized, if the value of his offer exceeded one million Syrian pounds.

f-  Judicial record( not committed) valid for three months from its issuance date.

g-  All above mentioned documents are to be submitted by the bidder and the partner / partners, if any.

15– Bidder who has no previous contract with G.F.T.O should submit the following documents:-

a- Information about the company status - establishment date - capital - range of activities - legal status and the parties with whom they had contracts inside and outside Syria, duly certified, by the chamber of commerce and legalized by Syrian embassy in the country of company.

b-Information about financial status / obligations, commercial activities and extent of adherence to fulfill their contracts, provided that documents containing such information should be duly issued by the bank/banks accredited by the company in its country. If necessary time for legalization is short, a copy of said documents can be submitted with the undertaking to be legalized and sent later on .

-In case of contract, L/C will not be opened unless above requested documents are received, duly legalized .

2 -Second Envelope Contains ;-

-Technical offer, specifications and catalogs indicating goods origin and manufacturer name. And it is not permitted to contain any prices, reservations , legal/ financial conditions and same will not be considered in case they are stated.

3 -Third Envelope Contains ;-

Financial & Commercial offer with a list of unit/ total prices which should be clearly arranged by bidder without scratching, elimination or padding and should not contain any reservations which should not be taken into consideration in case any of them is stated.

Bidder should submit his firm, final and unbreakable prices acc. Law 51/2004 in euro only for external offer and in Euro or Syrian pounds for internal offer basis per piece indicating total value per each item and total value of submitted offer as follows:

1-External Offer:-

a-FOBS (Stowed) seaport stating shipping port, No. of shipments, transport, loading and packing conditions.

b- C&F Liner Terms Tartouss or Lattakia. Bidder should adhere to transport the quantity through Syrian General Organization For Maritime Transport or by its approval (in this case bidder should pay the commissions of Syriamar as per the rate specified by them) - address as follows: Syriamar - Lattakia, fax: 00963 - 041 ( 371013 – 371014).

c -Neighboring countries can submit their offers by land to the warehouses of Syrian Petroleum company fields (in Al-Hasakeh). They should submit their prices accordingly including all expenses and fees incurred on the trucks in the Syrian lands and borders (which are on their account ). Fees incurred on goods inside the Syrian lands will be on our account.

- Buyer has the right to confirm one of above terms.

2-Internal Offer:

-Prices to be submitted on basis delivery at land warehouses of Syrian Petroleum co. fields (in Al-Hasakeh).

-Fees and expenses incurred on trucks will be on seller's account without reducing his responsibility towards GFTO under the contract.

- Partial offer is allowed as per the groups : first group items ( 1 and 4 ) – second group irems ( 2,3,5 and 6 )

- Partial confirmation is allowed.

- Partial shipment : is allowed

Article 3 :-Bonds

a-Bid Bond

First – Bid Bond attached with the offer in (Euro 3000) for External Offer or in Syrian pounds for internal offers in the amount of (S.P 300 000).

Second: To be settled either to our account no. 70662/301 with the Commercial Bank of Syria - Branch No. 3 - Damascus, or by a guarantee acc. Syrian formal text accredited by the General Directorate of Commercial Bank Of Syria, or a certified cheque issued by our commercial bank of Syria branch /3/ Damascus, or a crossed cheque marked accepted by the located banks accredited by the competent public parties in Syrian Arab Republic, to be submitted by all governmental or non- governmental bidding companies , provided to be received by GFTO within a period latest 15.00 HRS Damascus time on 31 /1 /2013 definitely before offer closing date as per the validity indicated in the offer- valid until 1 / 5/ 2013 .

-For external bidder, bid bond is accepted to be submitted by the agent and in his name in favour of the External bidder in Syrian pounds instead of foreign currency.

-Bid Bond will be returned directly to the bidder if his offer was not accepted by offers call committee. Those who were not awarded with the call or not contracted with, Bid Bond will be returned to them after approval of General Director on the report of tender committee.

-No./ Date of tender / quantity and material should be stated in the bid bond.

b-Performance Bond:

1- Performance Bond at (10%) of total contract value ,to be submitted within a maximum period of (20) days from the date of final confirmation with the awarded bidder. Otherwise , contract will be executed on his own expenses and bid bond will be confiscated for GFTO's account and he will be charged with the announcement fees and all other expenses , costs and penalties without the need for any warning or notice by GFTO.
