You are not allowed to attend at any place of business not approved by the Case Manager or the Home Detention Officer on duty. Generally this will only be supported if you are living independently.

17. Be charged with theft and/or damage related to the equipment - YES

If you abscond and do not leave the electronic equipment (inc Bracelet) behind you may be charged in a court of law and may be required to pay compensation.

18. Use my time to show the court that I have a good attitude – YESA Progress Report may be provided to the Court and your attitude and behaviour may be taken into consideration at the time of sentencing.

Home Detention Program

The Youth Court of South Australia is considering placing you on a mandate with a condition of Home Detention. The Community Youth Justice Program is responsible for supervising your Court Order and for reporting your progress to Court as necessary.

Should you be placed on Home Detention, you will be allocated a Case Manager who will develop a case plan, a movements schedule and set goals to support the conditions of your order as stipulated by the Court. This process may involve your family/caregiver and others who support you.

By signing the mandate at the Youth Court, you will agree to comply with the condition of Home Detention. Your movements will be heavily restricted and you must adhere to the agreed movements schedule approved by your Case Manager.

All absences from the home will require approval by your Case Manager in advance. A leave of absence without prior consent from the Case Manager is a violation of the conditions of the Court Order. Such a breach of the conditions of Home Detention may result in matters being returned to Court, where an alternative sentencing option may be imposed.

As a general rule, scheduled permission to be absent from the home may occur for the following reasons:

  • School, employment and training
  • Professional appointments (doctors, Centrelink etc)
  • Approved activities as determined by your case plan

As a general rule, permission will not be granted for:

  • Hanging around shopping centres or other public places
  • Visiting friends
  • Social outings/activities with friends
  • Large Community events (e.g. Football Stadiums)

Failure to adhere to direction to attend at scheduled appointments is a breach of your Court Order which may result in matters being returned to Court.

Data relating to the approved leave is entered onto a computer program and approved leave is monitored by the Surveillance Team.

Information related to approved absences includes:

  • Departure time to and from the house
  • Transport method, route and schedules
  • Details of the person(s) transporting/accompanying you
  • Arrival time
  • Purpose of leave
  • Contact Details related to the appointment/activity

Whilst absent from the home, your movements may be monitored by the Surveillance Team. Any deviation to the proposed time scheduling or routing will be investigated and this may result in matters being returned to the Court.

A curfew of 9pm is imposed on all approved absences.

Alcohol and Drug use is not permitted whilst on Home Detention. A baseline assessment of use will be conducted at the commencement of the order. You will occasionally be subject to random urine analysis for the detection of drug use, and will also be required to submit to an alcohol analysis.
