On motion of Mr. Lagasse, seconded by Mr. , the following ordinance was offered:

SUMMARY NO. 23146 ORDINANCE NO.

An ordinance approving the Preliminary and Final Plat of resubdivision of Lots J-2 and J-4, Trudeau Subdivision, Jefferson Parish, Louisiana into Lots J-2-A and J-4-A, Trudeau Subdivision, Jefferson Parish, Louisiana in accordance with plan by Dading, Marques & Associates, LLC, L.S., dated June 14, 2010, which Lot J-4 is owned by Steven A. Childress and Lot J-2 is owned by the Richard H. Finan and Marguerite V. Finan Revocable Living Trust, and approving and accepting the Final Plat of said subdivision. (Council District 2).

WHEREAS, Steven A. Childress is the owner of lot J-4, and the Richard H. Finan and Marguerite V. Finan Revocable Living Trust is the owners of Lot J-2, Trudeau Subdivision, Jefferson Parish, Louisiana; which Lot J-4 was acquired by Steven A. Childress before Jeanne B. Stephens, Notary Public, dated January 19, 2000, registered in COB 3023 Folio 635, Parish of Jefferson; and Lot J-2 was acquired by Richard H. Finan and Marguerite Finan before Earl Webster Simoneaux, Notary Public, dated August 25, 1970, registered in COB 720 Folio 6452, Parish of Jefferson; and

WHEREAS, said owners desire to resubdivide said Lots to be designated as Lots J-2-A and J-4-A, Trudeau Subdivision; and

WHEREAS, said subdivision shall contain no public improvements, therefore the Preliminary Plat and Final Plat may be approved and accepted in combination with accordance with Section 33-2.26(d); and

WHEREAS, the Planning Director of this Parish has caused to be duly advertised as prescribed by law, a public hearing in connection with the resubdivision of said lots; and

WHEREAS, a public hearing was held by the Planning Advisory Board, in accordance with the law: NOW THEREFORE

THE JEFFERSON PARISH COUNCIL HEREBY ORDAINS:

SECTION I. That the Preliminary Plat of Dading, Marques & Associates, LLC, L.S., dated June 14, 2010, showing the resubdivision of Lots J-2 and J-4, Trudeau Subdivision, Jefferson Parish, Louisiana into Lots J-2-A and J-4-A in accordance with said plan, is hereby approved.

SECTION II. That the Final plat of Dading, Marques and Associates, LLC, L.S., dated June 14, 2010, showing the resubdivision of Lots J-2 and J-4, Trudeau Subdivision, Jefferson Parish, Louisiana into Lots J-2-A and J-4-A in accordance with said plan, is hereby approved and accepted.

SECTION III. That in accordance with Section 33-2.31 of the Unified Development Code (UDC), Subdivision Waivers, the insufficient lot depth of 50 feet for Lot J-2-A (as shown on said plan), instead of the required 100 feet in R-1A district is hereby waived, accepted and approved.

SECTION IV. That the Parish of Jefferson has not examined or reviewed the title of any portion of land shown, or any restrictive covenants or restrictions placed on said property, and that the action of the Parish in this matter does not imply (1) that the applicants or owner’s title or ownership is valid, (2) that there are or are not any restrictive covenants or other restrictions that may be on said property are enforceable or are not enforceable.

SECTION V. That the Chairman of the Parish Council of Jefferson Parish, or in his absence the Vice Chairman, is hereby authorized, empowered, and directed to sign all documents and acts necessary and proper in the premises to give full force and effect to this ordinance.

This ordinance having been submitted to a vote, the vote thereon was as follows:

This ordinance was declared to be adopted on the 12th day of January, 2011, and shall become effective as follows, if signed forthwith by the Parish President, ten (10) days after adoption; thereafter, upon the signature of the Parish President or, if not signed by the Parish President, upon expiration of the time for ordinances to be considered finally adopted without the signature of the Parish President, as provided in Section 2.07 of the Charter. If vetoed by the Parish President and subsequently approved by the Council, this ordinance shall become effective on the day of such approval.
