Custer County Commissioner Meeting

Date: September 24th, 2014

Phil Lampert called the meeting to order at 8:00 a.m. with the Pledge of Allegiance. David Hazeltine, Jim Lintz, Travis Bies, Mark Hartman, Tracy Kelley, State’s Attorney and the Auditor were present.

The Board moved to approve the agenda with the following additions: add a computer rotation schedule, discuss creating a capital outlay account and discuss changes to county health insurance under Work Session. Motion carried. In the following proceedings, all action taken was first duly moved and seconded, received a unanimous vote of the Commissioners without dissenting vote or abstention, unless otherwise stated.

Minutes

-Dave Hazeltine moved and Travis Bies seconded a motion to approve the minutes of the August 27th, 2014 special commission meeting as presented. Motion carried.

-Jim Lintz moved and Mark Hartman seconded a motion to approve the minutes of the September 2nd, 2014 commission meeting as presented. Motion carried.

Declaration of Conflict of Interest-Mark Hartman declared a conflict of interest in the Section Line Vacation Public Hearing at 9:30 am.

Gary Woodford, Highway Superintendent

-A work order for Brosz Engineering #41052 for structure and approach grading located 4.5 miles SE of Custer over French Creek SN 17-268-086 was presented. Dave Hazeltine moved to authorize the chairman to sign the work order, Jim Lintz seconded. Motion carried.

-Gary requested the purchase of a bottom dump trailer from Butler Machinery in the amount of $51,600 by a bid let from Beadle County Highway Department on December 17th, 2013. Travis Bies moved and Mark Hartman seconded the motion to approve the purchase. Motion carried. Travis Bies moved and Mark Hartman seconded a motion rescinding the prior motion. Motion carried Travis Bies moved and Mark Hartman seconded a motion to approve the purchase of the bottom dump trailer contingent upon receiving the required documentation for the bidding process. Motion carried. Bid documentation and Beadle County Commission meeting minutes accepting Custer County’s bid are on file at the Auditor’s office.

Rick Wheeler, Sheriff

-Rick gave the Commissioners an update on the prisoner care ankle bracelet program, which has saved the county $15,060 year to date in prisoner care costs.

-Rick presented a Drug Control Fund grant award to purchase tablets, mobile mounts, keyboard adaptors and docking stations in the amount $46,793.95.

Supplement to the Budget

-A hearing will be held October 8th at 9:15 am for a supplement to the general fund budget.

Section Line Vacation Hearing

-As advertised, a public hearing was held on a section line vacation. The Board of County Commissioners adjourned and sat as the Board of Adjustments for the hearing at 9:30 a.m. The applicant requested vacation of the section line running north/south: Located between Section 1, T3S, R7E and Section 6 T3S, R8E BHM Custer SD and traversing south of Yellow Oak Road to SD Hwy 36 for approximately 500 Feet. The Board adjourned as Board of Adjustment and reconvened as the Board of County Commissioners.

Search & Rescue Equipment Purchase

-Travis Bies moved and Mark Hartman seconded the purchase of a 5th wheel trailer for search and rescue using contingency funds in the amount of $6,500. Motion carried Transfer from 101-112-429.90 to 101-227-429.

Al Shaefer, Legislative Audit Al advised the Board that the 2012-2013 audits have been completed and the county should get a final copy by the end of the week. The audit will be published in the Chronicle and available on the State website in the near future. The report is also on file in the auditor’s office. Dave Hazeltine moved and Jim Lintz seconded to authorize the chairman to sign the acceptance of the audit findings as presented. Motion carried.

David Green Planning

-Travis Bies moved and Jim Lintz Hazeltine seconded to approve Resolution 2014-9. . Dave Hazeltine, Jim Lintz and Travis Bies voted aye, Mark Hartman abstained from voting. Motion carried.

Resolution 2014-9 Vacation of Section-Line Highway Right-of-Way

WHEREAS, application has been made for the purpose of vacating that portion of the Section-Line-Highway Right-of-Way that runs south from Yellow Oak Road to SD Hwy 36 for approximately 500 feet between Sections 1, T3S R7E and Section 6, T3S R8E BHM, Custer County, South Dakota. Petitioner: Mark Hartman.

WHEREAS, The Board of Custer County Commissioners have determined that the public's interest will be better served by vacation of this section line highway Right-of-Way,

NOW THEREFORE, BE IT RESOLVED THAT The Custer County Board of Commissioners approves the vacation of the aforementioned section line Highway Right-of-Way.

Applicants: Keith Katsch. Motion carried.

-Travis Bies moved and Jim Lintz seconded to approve Edgar Ranch Tract – containing the remainder of HES No. 583 and Tract Jerry SW1/4 Section 14, SE ¼ Section 15, NW ¼ Section 23 T3S, R3E, BHM Custer County South Dakota. Motion carried.

-Mark Hartman moved and Dave Hazeltine seconded to approve Tract of Record SE ¼ NW ¼ Section 5 T6 R4 Custer County South Dakota Applicant: David Hoten Motion Carried.

-The Board acknowledged a land use change for Fred Warner.

James McMillin, Replating Fees

-James came before the board to request a reduction in replating fees to $100 as he had started the process before the board authorized to reinstate the former fee. Mark Hartman moved and Dave Hazeltine seconded a motion to allow the reduction for Mr. McMillin. Motion carried.

Executive Session – Personnel

-Jim Lintz moved and Dave Hazeltine seconded to go in and out of executive session at 11:05 am and adjourned at 1:40 pm. Motion carried No action was taken

Adoption of the 2015 Budget

-Total tax levy for the county in 2014 was 5.296 and the total tax levy for the county in 2015 is 5.286, a decrease of .010.

-Travis Bies moved and Dave Hazeltine seconded to adopt the 2015 Annual Budget. Motion carried.

The accompanying taxes are levied by Custer County for the year January 1, 2015 through December 31, 2015. General Fund = $2,675,956 = 3.339 $’s/1000 Building Fund = $478,269 = .573 $’s/1000 Secondary Road = $512,161 = .977 $’s/1000 Fire Fund = $242,827 = .397 $’s/1000. Work Session

-Dave Hazeltine moved and Jim Lintz seconded to authorize the Chairman to sign the SD Emergency Management State and Local Agreement for Fiscal Year 2015. Motion carried.

-Dave Hazeltine moved and Jim Lintz seconded to authorize the Chairman to sign a response letter to the United States Department of the Interior regarding re-opening the comment period for listing the northern long-eared bat as endangered. Motion carried.

-Travis Bies moved and Jim Lintz seconded to authorize the chairman to sign the Forest Service lease Amendment #1 for Lease 57-82X9-1-004 for water service at the airport. Motion carried

-Travis Bies moved and Jim Lintz seconded to authorize the chairman to sign extension of the Wind Cave National Park Custer County dispatch support service contract to Dec 31st, 2014. Motion carried.

-Dave Hazeltine moved and Mark Hartman seconded to authorize the chairman to sign the Department of Public Safety contract for lease of the Pine Room at the County annex building for the year 2015. Motion carried

-Jim Lintz moved and Dave Hazeltine seconded to authorize the chairman to sign the offers for landowners within the RPZ zone at the airport. Motion carried

-The Board adopted a 4 year rotation schedule for Data Processing for the purchase of computers.

Travel Requests

-Mark Hartman moved and Dave Hazeltine seconded the following travel requests. Motion carried:

-David Green made a travel request to attend the 2014 SD Planning Association Planning & Zoning Conference Best Western Ramkota Inn in Watertown, SD on October 22nd – 23rd, 2014 at a cost to the county of $453.00.

-Joel Behlings and Jennifer Smart made a travel request to attend the 2014 Dakota 911 Conference in Mitchell, SD on September 16th – 18th, 2014 at a cost to the county of $498.00 plus use of a county vehicle.

- Cathy Carter made a travel request to attend the D-Ware, Inc. Annual Meeting in Mitchell, SD on October 8th – 9th, 2014 at a cost to the county of $310.00 plus use of a county vehicle.

- Dennis Zellner made a travel request to attend the SDACO Annual Fall Conference in Pierre, SD on September 14th – 17th, 2014 at a cost to the county of $621.00

-Dave Hazeltine moved and Jim Lintz seconded the new hire of Preston Martin, highway department, Operator II effective October 6th, 2014 at $15.90 per hour. Motion carried

-The Board acknowledged the promotion of Derrick Reifenrath, Deputy Sheriff, to Sergeant effective August 29th, 2014 with an increase in salary to $19.70.
