An ordinance approving the Preliminary and Final Plat of resubdivision of Lots 1-A, 2-A, 3-A, 4A-A, 4B-A, 5A-A, 5B-A, 6A-A, 6B-A, 7-A, Lot 30-A, Pt. of Alleyway 7-8-E, 6’ x 6’ portion of original 12’ Alley and Alleyway 30-A-W, Square 50, Bonnabel Place Subdivision, Jefferson Parish, Louisiana, into Lot 1-A-1, Square 50, Bonnabel Place Subdivision, in accordance with plan by C. Randall Dixon, P.L.S., dated March 3, 2009, revised July 16, 2009, which Lots are owned by Capital One, National Association, as Trustee of the Marie Webre Norris Trust, Mickey’s Mighty Deeds, L.L.C. and Bonnabel Development Company, L.L.C., and approving and accepting the Final Plat of said subdivision (Council District 5)
WHEREAS, Capital One, National Association, as Trustee of the Marie Webre Norris Trust is the owner of Lots 1-A, 2-A, 3-A, 4A-A, 4B-A, 5A-A, 5B-A, 6A-A, 6B-A, 6’ x 6’ portion of original 12’ Alley and Lot 30-A, Square 50, Bonnabel Place Subdivision, Jefferson Parish, Louisiana where its predecessor, First National Bank of Jefferson Parish acquired said property by Judgment dated November 2, 1978, registered in COB 2932, Folio 419, Instrument No. 9606004, Parish of Jefferson;
WHEREAS, Mickey’s Mighty Deeds, L.L.C. is the owner of Lot 7-A Square 50, Bonnabel Place Subdivision, Jefferson Parish, Louisiana, which it acquired by Act before Clarence F. Favret, III, Notary Public, dated November 6, 2008, registered in COB 3239, Folio 902, Instrument No. 10858892, Parish of Jefferson; and
WHEREAS, Mickey’s Mighty Deeds, L.L.C. is the owner of Part of Alleyway 7-8-E, Square 50, Bonnabel Place Subdivision, Jefferson Parish, Louisiana, which it acquired by Act of Capital Contribution before Justin B. Schmidt, Notary Public, dated July 28, 2009, registered in COB 3250, Folio 686, Instrument No. 10932607, Parish of Jefferson; and
WHEREAS, Bonnabel Development Company, L.L.C. is the owner of Alleyway 30-A-W, Square 50, Bonnabel Place Subdivision, Jefferson Parish, Louisiana, which it acquired by Act before Roy S. Lilley and Justin B. Schmidt, Notaries Public, dated May 7, 2009, registered in COB 3246, Folio 867, Instrument No. 10919566, Parish of Jefferson; and
WHEREAS, said owners desire to resubdivide said Lots into a Lot to be designated as Lot 1-A-1, Square 50, Bonnabel Place Subdivision; and
WHEREAS, said resubdivision shall contain no public improvements, therefore the Preliminary Plat and Final Plat may be approved and accepted in combination in accordance with Section 33-2.26(d); and
WHEREAS, the Planning Director of this Parish has caused to be duly advertised as prescribed by law, a public hearing in connection with the resubdivsion of said lots; and
WHEREAS, a public hearing was held by the Planning Advisory Board, in accordance with the law: NOW THEREFORE,
THE JEFFERSON PARISH COUNCIL HEREBY ORDAINS:
SECTION I. That the Preliminary Plat of C. Randall Dixon, P.L.S., dated March 3, 2009, revised July 16, 2009 showing the resubdivision of Lots 1-A, 2-A, 3-A, 4A-A, 4B-A, 5A-A, 5B-A, 6A-A, 6B-A, 7-A, 30-A, Pt. of Alleyway 7-8-E, 6’ x 6’ portion of original 12’ Alley and Alleyway 30-A-W, Square 50, Bonnabel Place Subdivision, Jefferson Parish, Louisiana into Lot 1-A-1 in said square in accordance with said plan, is hereby approved.
SECTION II. That the Final Plat of C. Randall Dixon, P.L.S., dated March 3, 2009, revised July 16, 2009 showing the resubdivision of Lots 1-A, 2-A, 3-A, 4A-A, 4B-A, 5A-A, 5B-A, 6A-A, 6B-A, 7-A, 30-A, Pt. of Alleyway 7-8-E, 6’ x 6’ portion of original 12’ Alley and Alleyway 30-A-W, Square 50, Bonnabel Place Subdivision, Jefferson Parish, Louisiana into Lot 1-A-1 in said square in accordance with said plan, is hereby approved and accepted.
SECTION III. That the Parish of Jefferson has not examined or reviewed the title of any portion of land shown, or any restrictive covenants or restrictions placed on said property, and that the action of the Parish in this matter does not imply (1) that the applicant’s or owner’s title or ownership is valid, (2) that there are or are not any restrictive covenants or other restrictions on said property, or (3) that any restrictive covenants or restrictions that may be on said property are enforceable or are not enforceable.
SECTION IV. That the Chairman of the Parish Council of Jefferson Parish, or in his absence the Vice Chairman, is hereby authorized, empowered, and directed to sign all documents and acts necessary and proper in the premises to give full force and effect to this ordinance.
This ordinance having been submitted to a vote, the vote thereon was as follows:

This ordinance was declared to be adopted on the 14th day of October, 2009, and shall become effective as follows, is signed forthwith by the Parish President, ten (10) days after adoption; thereafter, upon the signature by the Parish President, or, if not signed by the Parish President, upon the expiration of the time for ordinances to be considered finally adopted without the signature of the Parish President, as provided in Section 2.07 of the Charter. If vetoed by the Parish President and subsequently approved by the Council, this ordinance shall become effective on the day of such approval.
