Upper Tyrone Township Supervisors Regular Meeting

April 11, 2017

Meeting was called to order at 5:30 p.m. with the Pledge of Allegiance.

Roll Call: Mr. Cook, yes, Mr. Edwards, yes, Mr. Beranek, yes.

Persons Attending: Solicitor Cicconi, Engineer Bill Utzman, Jackie Beranek, Ron Lewandowski, Edwin Zaffina, David Tullio and Secretary Lori Henry.

Mr. Edwards motioned to approve the minutes from the March 14, 2017 regular meeting minutes. Mr. Beranek seconded the motion. Vote – Mr. Edwards, yes, Mr. Beranek, yes, Mr. Cook, yes. Motion accepted.

Treasurers Report as of 04/11/2017:

Mr. Edwards motioned to approve the treasurer’s report. Mr. Beranek seconded the motion. Vote – Mr. Beranek, yes, Mr. Edwards, yes, Mr. Cook, yes. Motion accepted.

Public Comment:

Ron Lewandowski asked what he can do with the stream that is still running through his back yard causing flooding in his yard.

Mr. Utzman stated that he had contacted the Fayette County Conservation District for CDBG Funds to help fix the problem but the problem was not eligible for funding.

Mr. Cook stated that he will look at it and see if there is anything the Township would be able to do.

Motion to Pay Bills:

Mr. Edwards motioned to pay the bills for the month of April 2017. Mr. Cook seconded the motion. Vote – Mr. Cook, yes, Mr. Edwards, yes, Mr. Beranek, yes. Motion accepted.

Correspondence:

Hard-to-Recycle Drop-off Event to be held ay Fayette County Fairgrounds on April 29, 2017. AVAILABLE UPON REQUEST

Unfinished Business: None

Reports:

Mr. Cook discussed the meeting held with PennDOT regarding the Rt 119 & Kingview Road proposed Interchange.

Solicitors Report: None

Engineers Report: None

New Business:

Mr. Edwards motioned approve payment request #2 from Roger Suter & Son’s in the amount of $23,615.27 for work performed on the Municipal Building Expansion. This payment is conditional upon engineer’s review and acceptance of breakdown of costs incurred. Mr. Beranek seconded the motion. Vote – Mr. Beranek, yes, Mr. Cook, yes, Mr. Edwards, yes. Motion accepted.

Mr. Beranek motioned to approve payment request for ‘Change of Order” from Roger Sutor & Son’s in the amount of $29,364.49 due to removal of coke ash and structural backfill of stone. This payment is conditional upon engineers review of material slips, labor breakdown, and equipment used. Mr. Edwards seconded the motion. Vote – Mr. Edwards, yes, Mr. Cook, yes, Mr. Beranek, yes. Motion accepted.

Mr. Edwards motioned to approve payment request from Roger Sutor & Son’s in amount of $2,636.370 for installation of 4’ X 15” drainage pipes as authorized by supervisors due to excessive groundwater encountered during excavation. Mr. Beranek seconded the motion . Vote – Mr. Edwards, yes, Mr. Beranek, yes, Mr. Cook, yes. Motion accepted.

Mr. Edwards motioned to compensate any Supervisor that attends the PSATS Annual Convention at their current wage set by auditors for their position as Roadmaster during their attendance. Mr. Beranek seconded the motion. Vote – Mr4. Beranek, yes, Mr. Edwards, yes, Mr. Cook, yes. Motion accepted.

Mr. Edwards motioned to direct the Secretary to advertise the intent to adopt Ordinance No. 1-2017: “FLOODPLAIN MANAGEMENT ORDINANCE REQUIRING ALL PERSONS, PARTNERSHIPS, BUSINESSES, AND CORPORATIONS TO OBTAIN A PERMIT FOR ANY CONSTRUCTION OR DEVELOPMENT; PROVIDING FOR THE ISSUANCE OF SUCH PERMITS; SETTING FORTH CERTAIN MINIMUM REQUIREMENTS FOR NEW CONSTRUCTION AND DEVELOPMENT WITHIN AREAS OF UpPER TYRONE TOWNSHIP WHICH ARE SUBJECT TO FLOODING; AND ESTABLISHING PENALTIES FOR ANY PERSONS WHO FAIL, OR REFUSE TO COMPLY WITH, THE REQUIREMENTS OR PROVISIONS OF THIS ORDINANCE. Mr. Beranek seconded the motion. Vote – Mr. Edwards, yes, Mr. Beranek, yes, Mr. Cook, yes. Motion accepted.

Mr. Edwards motioned to renew the Sam’s Club memberships for 2017. Mr. Beranek seconded the motion. Vote – Mr. Beranek, yes, Mr. Cook, yes, Mr. Edwards, yes. Motion accepted.
