A RESOLUTION OF THE BOARD OF COMMISSIONERS OF

THE TOWNSHIP OF COLEBROOKDALE, BERKS COUNTY, PENNSYLVANIA, ESTABLISHING THE FEES TO BE CHARGED FOR TOWNSHIP PERMITS, LICENSES, AND SERVICES

BE IT RESOLVED by the Board of Commissioners of the Township of Colebrookdale, County of Berks, Commonwealth of Pennsylvania, and it is HEREBY RESOLVED by the authority of the same, as follows:

WHEREAS, it is the intent of the Board of Commissioners of Colebrookdale Township to adopt by Resolution revised permit, licensing fees, fees for certain clerical services, and fees for specified Township Manuals, and to compile all such fees into one Resolution;

NOW, THEREFORE, the following Fee and Rate Schedule shall be established:

SECTION 1. ZONING PERMITS and FEES

The Colebrookdale Township Code Enforcement Officer shall also serve as the Colebrookdale Township Zoning Officer. Zoning Permits pursuant to the provisions of the Colebrookdale Township Zoning Ordinance shall be issued by the Code Enforcement Officer upon his/her receipt of a written application and payment of the required fee by the applicant.

Residential Application Fee$ 50.00

Non-Residential Application Fee$ 250.00

Zoning Permit Fee$ 50.00

Zoning Permit for any agricultural building

$ 0.10 per square foot with a maximum of $ 500.00

Request for Zoning Change $1,500.00

Conditional Use Request $1,500.00

Special Exception or Variance $1,500.00

Application for a Curative Amendment$2,000.00

In the event that an application for a Special Exception, Zoning Change, Variance, or Curative Amendment requires more than one public hearing before the Zoning Hearing Board or the Board of Commissioners, the Applicant shall pay an additional fee for the additional costs incurred by the Township for the following:

(A)fees paid to the members of the Zoning Hearing Board

(B)nightly charge for the rental of the meeting room in the Colebrookdale Township Building at $100.00 per night, per hearing

(C)additional clerical time required of the Township staff

(D)any additional costs incurred by the Township for postage and advertising in conjunction with the application.

Within THIRTY (30) DAYS of the date of the written decision by the Hearing Board or Board of Commissioners, the Township shall provide the applicant with an itemized bill listing the additional costs incurred by it resulting from the application. The applicant shall pay the itemized additional costs to the Township within THIRTY (30) DAYS of his or her receipt of the bill for the same. Any sums unpaid after 30 days bear interest at the rate of 6% per annum until the date of payment of same.

SECTION 2. BUILDING PERMITS and FEES

Building Residential – One & Two Family Single Dwellings

An application fee of $ 50.00 shall be paid when the application is submitted. This fee is non-refundable but will be applied to the cost of the permit if one is issued.

New construction: includes porches, patios, attics, basements, garages, and

SECTION 4. SEWAGE ENFORCEMENT AND PERMIT FEES

Fees for sewage enforcement activities are listed on a separate resolution approved by the Board of Commissioners.

SECTION 5.STORMWATER FEES

Residential Stormwater Plans (reviewed by Code Enforcement Officer) – when not associated with a subdivision or land development submission:

Escrow remaining balance to be returned to the applicant at the completion of the project.

Non-Residential Stormwater (reviewed by Township Engineer)

Escrow to be established at the time of submission determined by the Township Engineer. All costs associated with the review and installation of any stormwater controls required by the Township Engineer above the cost of the escrow, is to be paid by the applicant to the Township. If there is any remaining balance on the project, the balance of the escrow at the time of completion will be returned to the applicant.

Floodplain Ordinance Review Fees (reviewed by the Code Enforcement Officer)

To be billed at the hourly rate of the building inspector approved by the Township.

SECTION 6. MISCELLANEOUS FEES

(A) Inspection of any water supplied appliances

SECTION 7. BUILDING CODE BOARD OF APPEAL HEARING FEE

Established by the Berks County Building Code Appeal Board. Any appeals of the Township’s adopted building code are to be heard by the County Wide Appeals Board.

SECTION 8. DRIVEWAY AND SIGN PERMIT

(A)Sign Permit (minimum 4 sq. ft. to 20 sq. ft.)$50.00

SECTION 9. EXCAVATION PERMIT

Before any permit shall be issued to open or excavate any street in the Township, the applicant shall pay to the Township Code Enforcement Officer a permit fee in the minimum amount of Twenty Five ($25.00) Dollars to cover the cost of inspection and other incidental services in connection therewith. When application shall be made to

open or excavate any longitudinal opening or excavation in excess of five (5) feet, before any permit shall be issued so to open or excavate, the applicant shall pay, in addition to such minimum fee, an additional fee at the rate of four ($4.00) dollars for each additional foot to be opened or excavated upon such street, up to a distance of fifty (50) feet.

In the event the longitudinal opening exceeds fifty (50) feet, the applicant shall pay an escrow fee of Two Hundred ($200.00) Dollars for each one-hundred (100) feet of opening. This escrow fee shall be held by the Township until the applicant has completed the restoration of the road surface to the satisfaction of the Township.

SECTION 10. WELL PERMIT FEE

Application, Inspection, and Permit Fee$50.00

SECTION 11. MULTI-FAMILY RESIDENTIAL and NON-RESIDENTIAL CONSTRUCTION PERMITS

An application fee of $ 250.00 shall be paid when the application is submitted. This fee is non-refundable but will be applied to the cost of the permit if one is issued.

All permit fees include plan review and inspection costs.

(A)Building Permit Fees

Plumbing Permit Fees and Mechanical Permit Fees are included and will be listed on the building permit. Electrical Permit Fees are additional.

(1)New Construction (Buildings and Additions):

First 1,000 – 2,000 sq. ft.$0.50 per sq. ft.

Next 2,000 – 10,000 sq. ft.$0.40 per sq. ft

Remaining Area over 10,000 sq ft.$0.30 per sq. ft.

(2)Alterations, Renovations and Tenant Fit Outs:

(3) Miscellaneous construction (Discretion of Building Code Official only):

0.7% of the cost of construction.

*The applicant for a permit shall provide an estimated project cost at the time of application. Permit valuations include the total value of work, including excavation for building, materials and labor, for the electrical permit. Final electrical permit valuation may be set by the building official, if in the opinion of the building official, the valuation is underestimated.

(G)Building Inspection Penalties

The following penalties are in effect for all inspections required of the Building/Plumbing Inspector:

(1)Permits obtained as a result of a stop work order being issued and/or construction, installation, etc. that has been completed:

2 times the normal Township fee

(2)Special test and/or other agency certification required to determine compliance with concealed construction and/or work completed prior to obtaining a permit:

Exact cost incurred by Township

Note:Applicant may also be required to produce their own approval proof

of compliance (e.g., compaction test).

(3)Inspectionsin excess of two (2) regardingthe same matter (e.g., framing inspection):

$50.00 per visit.

Fee must be paid before further inspections take place.

SECTION 12. SUBDIVISIONS

Subdivision and Land Development Application and Review Fee Schedule

Whereas, the Pennsylvania Municipalities Planning Code (Act No. 247 of 1968, P.L. 805, as amended) permits each municipality to regulate subdivisions and land developments within its respective boundaries by adopting a subdivision and land development ordinance, and to include within the ordinance (among other things) provisions regarding the charging of review fees associates with the review and approval of subdivision and land development applications; and

Whereas, within Colebrookdale Township, Berks County, Pennsylvania, subdivision and land development is regulated by the Subdivision and Land Development Regulations of Colebrookdale Township of April, 1998, as amended; and

Whereas, the Board of Commissioners of Colebrookdale Township has, from time to time, set a fee for subdivision application and, at the present time, wishes to amend the fee schedule for the filing of plans under the aforesaid Ordinance.

For all Subdivision/Land Development Plans submitted:

TOWNSHIP ADMINISTRATION FEE:$100.00 for each phase of submission (Preliminary/Final)

And a fee payable in advance for Engineering, Legal, and Professional Consultant Services relating to the Subdivision/Land Development:

SKETCH PLAN: (if engineering review is requested)$500.00

MINOR SUBDIVISION: Less than 3 lots

Paid at submission of Preliminary Plan$1,000 + $100 per lot

Paid at submission of Final Plan$1,000 + $100 per lot

MAJOR SUBDIVISION: 3 or More Lots

PLANNED RESIDENTIAL SUBDIVISION (PRD):

PRD for residential development$3,500 + $50 per unit for residential unit

LAND DEVELOPMENT PLAN:

All other land development$3,500 + $250 per acre

RECYCLING FEE:

A fee shall be paid for each residential dwelling unit proposed in all subdivisions for use in obtaining recycling bins for the dwelling units proposed. A fee of $25.00 per residential dwelling unit is required and will be placed in the Colebrookdale Township Recycling Fund.

All required fees shall be paid prior to submission of an application for subdivision or land development. An application shall not be accepted for review unless all applicable fees are submitted.

If the review fees collected at the time of delivery of the subdivision or land development application to the Township are insufficient to cover all of the charges imposed by the Township for engineering, legal, or other professional consultants’ review of the Plans

during the course of plan review, the Applicant shall pay all additional review fees to the Township upon receipt of an invoice from the Township itemizing the amount of the additional fees owed to the Township.

No developer shall be permitted to file a Final Plan application until all outstanding fees owed to the Township on account of the Preliminary Plan application and review process have been paid in full. All outstanding Preliminary Plan application and/or review fees, and all required Final Plan application and review fees shall be paid in full before progressing from a Preliminary Plan to a Final Plan.

All application and/or review fees (including all fees required in addition to the initial application fees mentioned above shall be paid to the Township in full by the Developer prior to the Township releasing the Final Plan for recording. The fees for services of the Township Engineer, Solicitor, and other Professional Consultants shall be at the cost the Township is charged for said services.

Fees received in an amount in excess of the fees for the actual services of the Township Engineer, Solicitor, Professional Consultants, and administrative costs associated with all plan reviews and approvals shall be reimbursed to the Developer after completion of the review process and after recording of the final plan of subdivision and/or land development.

In the case of both subdivisions and land development, the Board of Commissioners shall have the right to require an additional deposit to cover the anticipated costs of engineering review and services if circumstances (including, but not limited to, location of floodplain, drainage problems, steepness of slope) warrant. The additional deposit shall be at least $500.00 and shall be paid together with the escrow fee at the time of submission of the subdivision plan.

In all cases, all escrow funds collected by the Township that are in excess of those required to meet the Township expenses shall be refunded to the land developer by the Township upon the written request of the Developer.

Meetings requested by individuals, property owners, and/or developers prior to submission of a subdivision plan, shall follow the regulations established in Resolution No. 09-01-2008.

SECTION 13. RECYCLING FEES

A fee of $12.50 is required for the purchase of a 22-gallon recycling bin used for the recycling program. Each Township resident has previously received two bins from the Township. If a bin is damaged beyond repair, the Township will replace the bin at no charge provided the bin is returned for the replacement. Landlords are responsible to

be sure to have each rental unit supplied with two bins. If they are missing at the time of a new tenant, the landlord will be invoiced for $25.00 replacement costs.

SECTION 14. CLERICAL SERVICES.

A charge of $27.00 per hour shall be imposed upon and paid by any person, firm, or agency which for any reason requests the assistance of Township personnel for the purpose of research of Township records or compilation of information from Township records. An itemized bill of said charges shall be presented to the person, firm, or agency requesting such assistance at the time the information is delivered to it (or at such time it is informed that no such information as it requested can be found). Said bill shall be required to be paid within 30 days of the date of the bill. The Township Secretary shall notify the Commissioners of any such bill, which remains unpaid after 60 days from its date.

SECTION 15. TAX COLLECTOR FEES

(A)Tax Certification Fee$20.00

(C)Fee for Certification to remove a Mobile Home/Trailer$20.00

SECTION 16. PAVILION RENTAL FEES

A charge of $40.00 per day for Township residents and $65.00 per day for non-residents shall be imposed upon the person/party requesting to use the pavilion located in the public recreational area owned by the Township and known as the Colebrookdale Twp. Liberty Park. In addition, a security deposit of $25.00 must be paid to the Township. Said Security Deposit shall be held by the Township and will be returned to the person/party using the pavilion if there is no damage or destruction to the pavilion, if the pavilion is returned in a clean condition, if all trash is removed from the premises, and the rest room key is returned to the Township Office by the person/party who used the pavilion. Both the rental fee and the $25.00 security deposit must be paid to the Township at the time the request to use the pavilion is approved by the Township.
