Deed Restrictions to Deed from the Bishop of Pueblo

EXHIBIT “A”

DEED RESTRICTIONS TO DEED FROM THE BISHOP OF PUEBLO,

A CORPORATION SOLE TO ______

The Grantee, its successors and assigns agrees and covenants the subject property will not be used for any of the following purposes:

  1. A church, edifice or place for a congregation, society or other assemblage of persons to meet for divine worship or other religious observances or activities, promoted or defined as Roman Catholic, but not possessing the express ecclesiastical and civil approvals of the Roman Catholic Church and of Canon Law of the Roman Catholic Church and the Bishop of Pueblo, a Corporation Sole; or
  1. An abortion clinic or medical service type facility which include the provision of abortion services or counseling which promotes or encourages individuals to obtain abortions; or
  1. A counseling service which includes as part of its options or recommendation to clients the consideration of abortion as an alternative to carrying a pregnancy through birth; or
  1. A political action group or similar organization of which a principal teaching or policy thereof is the advocacy of abortion or right of free choice of an individual to elect abortion; or
  1. An adult book store, x-rated movie theater, or similar use or business; or
  1. A topless bar or similar use or business; or
  1. A use or purpose which is materially and significantly contrary to the religious teaching of the Roman Catholic Church. The above-mentioned six listed restrictions are not limited to, but are examples of the nature of the specific types of uses prohibited under this paragraph 7.

The above restrictions are separate. If any of the above seven separate and distinct restrictions are adjudged invalid or unenforceable, such adjudication will in no manner affect the other restrictions which will remain in full force and effect as if the portions(s) so adjudged invalid or unenforceable were not originally a restriction.

The above restrictions may be removed in the sole discretion of the Grantor upon application by an interested party. The Grantor, upon application by an interested party, will also provide its opinion of whether a proposed use constitutes a restriction violation to interested parties including contract vendees and potential purchasers, including at foreclosure sales, within a reasonable period of time-after being requested to do so.

In the event of breach of any of these deed restrictions, the Grantor, and its successors and assigns, may enter and terminate the estate conveyed.

ACCEPTANCE AND ACKNOWLEDGEMENT

OF DEED CONDITIONS

Grantee, ______, further agrees these seven covenants and deed restrictions will run with the land and be included in the deed of conveyance as binding on it as grantee and its heirs, personal representatives, successors and assigns.
