Probation & Youth Offending Team (YOT)

The CPS will provide the probation service or YOT with an electronic copy of the initial details of the prosecution case (IDPC) by secure email.

The IDPC will only be provided when the probation service or YOT have a need for the information.

Stand Down Reports/Digital Remand Process

A dedicated CPS telephone line will be provided to both Probation and YOT to make requests for information on stand down reports.

The dedicated telephone line is for the following use only:

  • Requesting IDPCs for defendants which have been stood down for an immediate assessment as to whether a stand down report is appropriate
  • Requesting IDPCs for defendants which have been stood down for a report to be written
  • Requesting IDPC for defendants which fall within the digital remand process. (e.g Bail information assessment for the court or a serious further offence notification)
  • Late notifications from HMCTS which require an assessment to be prepared within 24 hours

No other requests for information should be made through this dedicated line. This will ensure that the line remains available for requests where an immediate response is required.

The CPS will immediately provide the IDPC to the organisations agreed central secure mail box.

Once the IDPC has been provided to Probation or YOT through a telephone request further copies of the IDPC will not be provided.

Email request for IDPC

Where cases are:

  • already adjourned for a report to be prepared and the IDPC was not requested on the day
  • defendant sentenced to custody without a report
  • Referral Orders (YOT Teams)

Requests should be made via the agreed CPS central secure mail box.

CPS will provide a copy of the IDPC within 24 hours.

Ad-hoc Requests

Ad-hoc requests for information should be kept to a minimum. Where there is a need for a pack which has not been provided previously this should be requested via the agreed CPS central secure mail box.

The request should include details of the defendant’s name, date of birth, next hearing date and reason for request.

In accordance with our secure email protocol:

  • CPS Mail boxes will be checked a minimum of every two hours, the last check of the mail box will be at 16:00 Monday to Friday. An email received after this time will be opened the following business day.
  • Emails may be marked as URGENT if there is a genuine need to do so. However, marking an email ‘Urgent’ does not guarantee faster treatment than normal.

Information Provision

The initial details of the prosecution case will contain as a minimum a copy of:

  • MG4 – Charges
  • MG5 - Summary of evidence
  • MG11 – Key Witness Statement
  • Defendants Previous Convictions

It will be the responsibility of the recipient to retain copies of information received. The CPS will not be responsible for providing additional copies previously provided information.
